Implicit Racial Attitudes Of Death Penalty Lawyers, Theodore Eisenberg, Sheri Lynn Johnson
Implicit Racial Attitudes Of Death Penalty Lawyers, Theodore Eisenberg, Sheri Lynn Johnson
Cornell Law Faculty Publications
Defense attorneys commonly suspect that the defendant's race plays a role in prosecutors' decisions to seek the death penalty, especially when the victim of the crime was white. When the defendant is convicted of the crime and sentenced to death, it is equally common for such attorneys to question the racial attitudes of the jury. These suspicions are not merely partisan conjectures; ample historical, statistical, and anecdotal evidence supports the inference that race matters in capital cases. Even the General Accounting Office of the United States concludes as much. Despite McCleskey v. Kemp, in which the United States Supreme Court …
Euthanasia: An Exploration Of Public Opinion, Debra M. Babylon
Euthanasia: An Exploration Of Public Opinion, Debra M. Babylon
Sociology & Criminal Justice Theses & Dissertations
The acceptance of euthanasia is examined using the 1972-2002 GSS cumulative dataset. The dataset contains a total of 43,698 respondents. The euthanasia question, "Should a terminally ill patient be allowed the right to die?" was asked beginning in 1977. The number of respondents answering the euthanasia question totals 22,039. The independent variables age, race, gender, political view, religious affiliation, and education were reviewed to assess their impact on support of euthanasia. Additionally, in order to test the "slippery slope" hypothesis, the abortion question, "Should abortion be allowed under any circumstance?" was added to the independent variable list. Cross tabulation was …
The Effect Of Humor On Elderly Well-Being, Mary M. Boone
The Effect Of Humor On Elderly Well-Being, Mary M. Boone
Sociology & Criminal Justice Theses & Dissertations
The main objectives of this study were to identify the connections between the sense of humor and well-being in the elderly population, examine the benefits of humor as a coping mechanism, explore the role of humor as a preventative and therapeutic measure, and to attempt to gain a greater understanding of these connections. Humor has been the focus of study within many different domains, including psychology and medical research (immunology, pain management, cardiology, and psychoneuroimmunology), but there is a distinct lack of theory and research within the sociological realm on this topic (except in social psychology), especially involving the aging …

Left Out, Louis Michael Seidman
Law and Contemporary Problems
Seidman presents information on the collapse of the progressive left's position on criminal justice. The faltering of the left in this area is due to inherent contradictions in their position which have weakened their stance overall.
Rwandan Gacaca: An Experiment In Transitional Justice, Maya Goldstein Bolocan
Rwandan Gacaca: An Experiment In Transitional Justice, Maya Goldstein Bolocan
Journal of Dispute Resolution
This paper argues that shifting the emphasis from the retributive nature of Gacaca to its restorative potential may, in the long term, offer better perspectives of peace and reconciliation to a deeply wounded society. It also argues that, where Gacaca retains its retributive element, it should do so while trying to respect the human rights of those brought before it. Part II of this paper briefly discusses the dominant model of transitional justice, namely the prosecutorial approach of criminal trials, and its effectiveness vis-A-vis alternatives that emphasize the search for truth and reconciliation instead of retribution. Part III provides a …

Organizing For Economic Empowerment Of Battered Women: Women's Savings Accounts, Cynthia K. Sanders, Meg Schnabel
Organizing For Economic Empowerment Of Battered Women: Women's Savings Accounts, Cynthia K. Sanders, Meg Schnabel
Center for Social Development Research
When describing reasons for remaining with or returning to an abusive partner, many women mention economic dependence on their abuser. Few battered women, especially those who are poor, have the economic resources necessary to live independently. Additionally, battered women are commonly isolated from financial resources lacking ready access to cash, checking accounts, or charge accounts. Creating strategies that address financial well-being is essential to addressing the issue ofdomestic violence. This article discusses a collaboration among domestic violence service providers in the St. Louis, Missouri region created to promote the economic development of low-income batteredwomen. The collaboration has culminated in formalized economic …

The Demise Of Corrections Fifteen Years On: Any Hope For Progressive Punishment?, Mark Findlay
The Demise Of Corrections Fifteen Years On: Any Hope For Progressive Punishment?, Mark Findlay
Research Collection Yong Pung How School Of Law
A decade and a half ago I wrote an article entitled The Demise of Corrections (Findlay 1988). The central thesis was that penal correctionalism had failed because it was piecemeal and lacked the support of a well developed commitment to alternative strategies to the prison. The criticism is sharper in the current context of imprisonment in NSW where correctional expectations continue to disappoint (and be disappointed), despite a recent revival of interest in 'what works' offender management programmes.
Confidentiality In Victim Offender Mediation: A False Promise, Mary Ellen Reimund
Confidentiality In Victim Offender Mediation: A False Promise, Mary Ellen Reimund
Journal of Dispute Resolution
The intent of the article is to provide the framework by which victim offender programs can delve into the complexities of mediation confidentiality and avert potential disaster. First, a foundation is needed to explain the philosophical goals of restorative justice, the VOM process, and mediation as it relates to restorative justice. With that background, areas that are likely to spark confidentiality concerns will be discussed as will exemplary confidentiality statutes, cases, and the Uniform Mediation Act. By carving a path of awareness through this previously unexplored topic as it relates to VOM, there will be less likelihood of false promises …
Gender And Hiv Risk Behavior In China, Yelan Guo
Gender And Hiv Risk Behavior In China, Yelan Guo
Sociology & Criminal Justice Theses & Dissertations
Gender differences in prevalence of HIV risk behaviors are well established. Gender differences in major causes leading to HN risk behaviors are much less researched in China. Using data from a large and population-based survey conducted in 2003, in southwestern China, this paper examined gender-specific correlates of HIV risky drug using and sexual behaviors in the general population. Both bivariate and multivariate analyses were conducted for males and females separately. The results suggest that men are more likely to inject drugs and share needles than women while women are more likely to exhibit RN risk sexual behaviors than men. Socio-economic …

Racial Discourse In Planet Of The Apes, Mandy Sheidah Allen
Racial Discourse In Planet Of The Apes, Mandy Sheidah Allen
Sociology & Criminal Justice Theses & Dissertations
The purpose of the study is to explore the racial discourse in the six Planet of the Apes films. The films range from 1968 to 2001 and portray the radical advances and the slow progression of race relations during this time frame. The racial discourse will be examined using themes of race and devolution, looking at the race class hierarchies of the ape society (a subversive metaphor for human society) and race as it is associated with power and political movements. The earlier films will be contrasted with Burton's 2001 version to explore how the concept race has shifted its …
A Cross-National Analysis Of The Impact Of Conscription On Crime Rates, Nicolette G. Rose
A Cross-National Analysis Of The Impact Of Conscription On Crime Rates, Nicolette G. Rose
Sociology & Criminal Justice Theses & Dissertations
Research has repeatedly shown that males in the age range of 16 to 24 years account for a disproportionately large volume of crime (Sampson and Laub 1993 ). The armed forces are major employers of young males in this crime-prone age range and could thus play an important role in crime prevention. The military provides many varied opportunities including a highly structured and regimented institution in which rigid behavioral norms and close monitoring are imposed. Some other incentives that service provides include educational opportunities through the" Advanced Individual Training", the GI Bill, in-service tuition assistance, and world-wide travel. All these …
The Effects Of Firearm Use On Police Officers, Quinn M. Beers
The Effects Of Firearm Use On Police Officers, Quinn M. Beers
Sociology & Criminal Justice Theses & Dissertations
The use of firearms by police officers is a subject that has not received much attention in past research. It is a rare occurrence for police officers to have fire their weapon in the line duty, which has also made this area of law enforcement difficult to study. In addition, little data is kept on the extent of firearm use by police officers. Several theories have been proposed to explain firearm use by police officers as well as how officers decide to use their weapon or not.
Ninety-two police officers from the city of Newport News, Virginia completed a survey …
Business Crime: The Perception And Experience Of Victimization And Corresponding Use Of Crime Prevention Measures, John A. Casten
Business Crime: The Perception And Experience Of Victimization And Corresponding Use Of Crime Prevention Measures, John A. Casten
Sociology & Criminal Justice Theses & Dissertations
This study uses the concepts of routine activities theory and social disorganization theory to examine some of the factors that influence a business owner's use of crime prevention measures. I predicted that neighborhood conditions as well as personal experience with crime would influence a business owner's decision to use crime prevention measures. In addition, I controlled for sex, race, age, education level, and police presence.
The results of the study were fairly consistent with the hypothesis except for two of the variables. In this particular study, age was not a significant factor in predicting the use of crime prevention measures, …

The Ipperwash Inquiry - Symposium On Government/Police Relations: The History And The Future Of The Politics Of Policing, Margaret Beare
The Ipperwash Inquiry - Symposium On Government/Police Relations: The History And The Future Of The Politics Of Policing, Margaret Beare
Conferences and Workshops
This chapter examines the operational realities of the police executive linkages—beyond the official dictates of the law and the desired position expressed in ideological discourses on police independence. Paper draws primarily on historical and criminological literature and research, and public inquiries.
The central argument of this paper is that, while there may be a somewhat clear-cut division between the’ policy’ versus the ‘operational’ control of the police by the State in law and in rhetoric, the reality is quite different. The relationship between the State and the police is a dynamic relationship that changes to reflect the nature of the …
The Ipperwash Inquiry - Symposium On Government/Police Relations: The Oversight Of Executive Police Relations In Canada: The Constitution, The Courts, Administrative Processes And Democratic Governance, Lorne Sossin
Conferences and Workshops
This chapter critically examines two central questions. First, what are the mechanisms which constrain and define executive accountability and police oversight in Canada? Second, can the need for the police to remain above partisan politics and beyond manipulation by the government of the day be reconciled with these mechanisms of governance and accountability? Sossin argues that an apolitical and autonomous model is best suited to the dynamics of policing in a constitutional democracy such as Canada, and has the potential to balance the need for political input into policing while countering inappropriate political interference in policing.
The executive-police relationship is …
