The Dilution Effect: Federalization, Fair Cross-Sections, And The Concept Of Community, Laura G. Dooley Jul 2004

The Dilution Effect: Federalization, Fair Cross-Sections, And The Concept Of Community, Laura G. Dooley

ExpressO

The question of the relevant community from which a fair cross-section of jurors should be drawn has received little theoretical attention. This article seeks to fill that gap by using communitarian and postmodern theory to give content to the idea of "community" in the fair cross-section context. This analysis is timely and has grave practical importance, given that the federal government is increasingly assuming the prosecution of crime previously dealt with at the state level. This "federalization" of criminal enforcement has the second-order effect of changing the "community" from which criminal juries will be drawn, particularly in urban areas surrounded …

Women, Domestic Abuse, And Dreams: Analyzing Dreams To Uncover Hidden Traumas And Unacknowledged Strengths, Mindy Stokes

USF Tampa Graduate Theses and Dissertations

Domestic abuse is the number one cause of injury to women in the United States. Women and their children flee everyday to shelters to escape the abuse. Once inside the shelters, material resources are rendered so that the women can continue to lead lives outside the shelter and different therapies are employed so that the women can better understand the abuse and their options once leaving. A type of therapy used in other therapeutic forums, such as patients sexually abused as children, is dream analysis. This type of therapy has allowed formerly traumatized victims a safe space to uncover hidden …

An Empirical Analysis Of The Role Of Mitigation In Capital Sentencing In North Carolina Before And After Mckoy V. North Carolina (1990), Janine Kremling

USF Tampa Graduate Theses and Dissertations

This study focuses on the influence of mitigating circumstances on the sentencing outcome before and after the McKoy (1990) decision. In McKoy (1990) the Supreme Court decided that the jurors did not have to find mitigating circumstances unanimously. Results are reported based on a sample of North Carolina first-degree murder cases where the state sought the death penalty. Logistic regression is used to determine the importance of mitigating circumstances as predictors of jury decision-making in North Carolina, controlling for the variety of other factors that influence that decision.

The descriptive statistics show that the average number of mitigating circumstances submitted …

Analyzing The Constitutional Tensions And Applicability Of Military Rule Of Evidence 505 In Courts-Martial Over United States Service Members: Secrecy In The Shadow Of Lone Tree, Joshua E. Kastenberg

Faculty Scholarship

This article analyzes MRE 505 in both a comparative and Constitutional context. Part I provides a procedural overview of both MIRE 505, and its federal counterpart, CIPA, for protecting evidence vital to national security in the criminal court context. Both mechanisms for protecting sensitive information are analyzed for their efficiency from a prosecutorial perspective. Part II analyzes the defendant's twin Constitutionally-based rights to present a complete defense and to a public trial. MRE 505, impacts to some degree, these twin rights. Finding Immunity: Manders V. Lee And The Erosion Of § 1983 Liability, Thomas B. Ward Jul 2004

Finding Immunity: Manders V. Lee And The Erosion Of § 1983 Liability, Thomas B. Ward

Mercer Law Review

In Manders v. Lee, the United States Court of Appeals for the Eleventh Circuit held that a Georgia county sheriff is an arm of the state when acting in his official capacity in implementing and enforcing use-of-force guidelines and, thus, is immune from suit in federal court under the Eleventh Amendment.' This decision creates considerable uncertainty in the area of government-entity liability under 42 U.S.C. § 19833 because of the potentially broad impact of this newly established analytical approach.
