Crime-Facilitating Speech, Eugene Volokh
Crime-Facilitating Speech, Eugene Volokh
ExpressO
Many recent free speech controversies -- over Patriot Act subpoenas, contract murder manuals, encryption and decryption algorithms, contributory copyright infringement, publication of abortion providers’ names, discussions of gaps in security systems, certain kinds of invasion of privacy lawsuits, online term paper mills, and more -- turn out to be special cases of a general problem: Should there be a new First Amendment exception for speech that gives criminals information that can help them commit crimes? And, if so, how broad or narrow should this exception be?
Surprisingly, scholars have almost entirely ignored these broad questions, and the Supreme Court has …

Library Faculty & Staff Publications
The rapidly changing world of reference databases — such as the numerous statistical sources, the collections of reference electronic books, and the database indexes to subjects — is explored. To address these issues the authors conducted an interview-style “joint discussion” among six librarians from five Universities.

National Juvenile Online Victimization Study (N-Jov): Methodology Report., Janis Wolak, Kimberly J. Mitchell, David Finkelhor
Crimes Against Children Research Center
The National Juvenile Online Victimization Study (N-JOV Study) was conducted by the Crimes against Children Research Center at the University of New Hampshire, under grants from the National Center for Missing & Exploited Children and the Office of Juvenile Justice and Delinquency Prevention, U.S. Department of Justice. The N-JOV study collected information from a national sample of law enforcement agencies about the characteristics of Internet sex crimes against minors and the numbers of arrests for these crimes during a one-year period. The goals of our methodology were to 1) design a representative national sample of law enforcement agencies that would …

Hoist With Their Own Petard?, Steven L. Chanenson
Working Paper Series
In 2003, Congress and the Department of Justice tried to increase their control over the United States Sentencing Commission and federal sentencing generally. Congress appeared to have achieved this goal when it passed the Prosecutorial Remedies and Tools Against the Exploitation of Children Today Act of 2003 (“PROTECT Act”), which resulted in reduced grounds for downward departures, Congressionally-revised text of the Federal Sentencing Guidelines, and a constrained Sentencing Commission potentially devoid of judges. Yet pro-government interpretations of the PROTECT Act may have been premature because the Supreme Court has now struck down parts of Washington State’s legislatively-enacted sentencing guidelines in …

Sentencing Guidelines, Judicial Discretion, And Social Values, Thomas J. Miceli
Sentencing Guidelines, Judicial Discretion, And Social Values, Thomas J. Miceli
Economics Working Papers
This paper studies the institutional structure of criminal sentencing, focusing on the interaction between legislatures, which set sentencing ranges ex ante, and judges, who choose actual sentences from within those ranges ex post. The key question concerns the optimal degree of judicial discretion, given the sequential nature of the process and the possibly divergent interests of legislatures and judges regarding the social function of criminal punishment. The enactment of sentencing reform in the 1970s and 80s provides both a context for the model and an opportunity to evaluate its conclusions.
Double Jeopardy And The Death Penalty: A Fundamental Constitutional Protection With Life Or Death Consequences, Kristen Lindsay Todd
Double Jeopardy And The Death Penalty: A Fundamental Constitutional Protection With Life Or Death Consequences, Kristen Lindsay Todd
Campbell Law Review
What is the effect of a deadlocked jury in a sentencing hearing for the application of the death penalty on the termination of jeopardy? This comment will explore this issue as presented in Sattazahn v. Pennsylvania, and analyze not only the arguments made in both the majority and dissenting opinions, but other considerations which arise when deciding if double jeopardy protections should apply. Also considered in the comment is the effect of the Sattazahn decision on future criminal defendants. What consequences will this decision have for the death row defendant when trying to decide whether to appeal his possibly erroneous …
