This article calls for a new character evidence rule allowing the admission of prior acts of abuse within the context of a current domestic violence prosecution. Section II discusses the history of domestic violence in America and explores the three ways that the law has condoned domestic violence, including implicit sanction through the effect of the character evidence rule. Section III examines the intellectual background of the character evidence ban. This section also explores the conflict between the character evidence rule and the law's recognition of domestic violence. The study examines Imani Kuumba College, (IKC), an Afrocentric Christian College. Since previous research does not examine any higher institution that provides a type of learning that focuses totally on the study of the Afrocentric world, this historical case study describes a unique educational institution that proposes to teach from a focus designed to raise self-esteem for African-Americans and racial understanding for other groups by studying the African-American experience, historically, spiritually and culturally. By declaring that sentence-enhancing facts must be proven to a jury beyond a reasonable doubt, the Supreme Court in Blakely v. Washington has raised a number of questions about the future of guided sentencing. One of these questions - only beginning to be explored - is what procedures would be needed in a system that both implements Blakely and preserves sentencing guidelines. What factors would be submitted to the jury and what instructions would be given? Would sentencing issues be presented to the jury in a separate hearing, distinct from trial? If so, what evidentiary rules would apply?

This article is an adaptation of a lecture given at St. Antony's College, Oxford on 5 July 2003 in honor of the fiftieth anniversary of the Centre for Russian and East European Studies at Oxford University. The author evaluates the effect of the European Convention on Human Rights on Russian law and politics. Russia has been a signatory to the Convention for five years. The author argues that the full power of the Convention as a force for reform in Russia was unanticipated at the time of Russia's accession. The Pros And Cons Of The Learned Helplessness Construct And The Battered Woman Syndrome: A Critical Analysis And Possible Reformulation, Lucille Andreozzi Stern

Two prevailing, contrasting theories, learned helplessness and health psychogenesis, have been proposed to describe and explain the battered woman's experience and response to domestic violence. This research examined the status (scientific adequacy) of each theory's database to determine where the preponderance of evidence lies.

The investigator articulated nine factors that differentiate the two theories. Trained independent raters then rated study outcomes as falling into one of three categories: pro-learned helplessness, pro-health psychogenesis, or supportive of both theories. Testing A Model Of Unwanted Pursuit And Stalking, Leila B. Dutton-Greene

Unwanted pursuit and stalking are common, especially among young adults attending college. Cupach and Spitzberg (2004) developed their relational goal pursuit theory to explain unwanted pursuit and stalking. They theorize that unwanted pursuit and stalking develop out of a disjunctive relationship in which one person wants a type of relationship that the other does not. They propose that the interrelated and co-occurring processes of rumination, emotional flooding, and rationalization serve to disinhibit a pursuer' s idea of what is appropriate behavior. Thus, the object perceives the pursuer's behavior as excessive, inappropriate, and perhaps threatening.

Domestic violence is one of the most important health care issues in the United States. One of every four women is a victim of domestic violence each year and thirty-one percent of women have a lifetime prevalence of domestic violence. Since most women receive their health care in primary care settings, nurses can play a critical role in decreasing the cycle of violence through screening and intervention. Judicial And Law Review Citation Frequencies For Articles Published In Different 'Tiers' Of Law Journals: An Empirical Analysis, Gregory S. Crespi

An empirical study of the judicial and law journal citation frequencies for a large and comprehensive sample of 550 articles that were published from 1996 through 1998 in fifteen selected law journals resulted in several findings. First, these articles averaged only 0.4 judicial citations and 14.5 law journal citations through May 30, 2003. Second, both courts and scholars cite articles that are published in the three most prestigious law journals at much higher rates than they cite articles that appear in either mid-level or lower-tier law journals. In the development of Automated Dental Identification System (ADIS), we focus on registration to align the subject dental regions of interest with respective reference regions. With the goal to achieve high performance for dental image registration, a dualstage approach is proposed which is based on the hypotheses generation-verification paradigm. The registration of the dental regions of interest is the basis for hypotheses generation. The hypotheses generated by using a fast method are verified to retrieve the candidate parameter sets to give accurate alignment of the regions. As has been the case with respect to many political and social institutions in American society, diversity has been demanded, and at times pursued, in the nomination and appointment of state and federal judges. Nonetheless, commentators have long lamented the lack of diversity among judges in the United States.

U.S. Supreme Court appointments epitomize the glaring lack of diversity on the federal judiciary. Not until 1967 did President Lyndon Baines Johnson appoint the first African American Justice, Thurgood Marshall, to the Court. In the aftermath of violent crime, survivors are confronted by questions of comprehension, healing, normalcy, accountability, and restoration. These same issues are communicated to audiences via mass media coverage of the crime and ensuing legal proceedings that focuses upon survivors while they are in the public eye - and while those suspected of the crime are in the defendant's chair. Such stories bring a human face to the innocents most affected by the outcome of the proceedings, relaying their involvement in and response to legal developments from arrest to execution. Be Careful What You Wish For: Legal Sanctions And Public Safety Among Adolescent Offenders In Juvenile And Criminal Court, Jeffrey Fagan, Aaron Kupchik, Akiva Liberman

Three decades of legislative activism have resulted in a broad expansion of states' authority to transfer adolescent offenders from juvenile to criminal (adult) courts. At the same time that legislatures have broadened the range of statutes and lowered the age thresholds for eligibility for transfer, states also have reallocated discretion away from judges and instituted simplified procedures that permit prosecutors to elect whether adolescents are prosecuted and sentenced in juvenile or criminal court. These developments reflect popular and political concerns that relatively lenient or attenuated punishment in juvenile court violates proportionality principles for serious crimes committed by adolescents, and is …

Right now, marriage and monogamy feature prominently on the public stage. Efforts to lift prohibitions on same-sex marriage in this country and abroad have inspired people on all sides of the political spectrum to speak about the virtues of monogamy's core institution and to express views on who should be included within it. The focus of this article is different. Like an "unmannerly wedding guest," this article invites the reader to pause amidst the whirlwind of marriage talk and to think critically about monogamy and its alternatives.

Early Sexual Abuse, Street Adversity, And Drug Use Among Female Homeless And Runaway Adolescents In The Midwest, Xiaojin Chen, Kimberly A. Tyler, Les B. Whitbeck, Dan R. Hoyt

Research on homeless and runaway adolescents has shown that this population is at high risk for illicit drug use. Though sexual abuse has been widely considered in the etiology of illicit drug use, we know less about how early sexual abuse affects young people’s decisions to run away, to use drugs, and to engage in other deviant behavior on the streets. Based on interviews with 361 female homeless and runaway adolescents in four midwestern states, the current study revealed a high prevalence of drug use, especially use of cocaine among youths with sexual abuse histories. Path analyses showed that early …
