Effect Of Military Culture On Responding To Sexual Harassment: The Warrior Mystique, Michael I. Spak, Alice M. Mccart Jan 2004

Effect Of Military Culture On Responding To Sexual Harassment: The Warrior Mystique, Michael I. Spak, Alice M. Mccart

Nebraska Law Review

Since September 11, 2001, criticizing firefighters, the police, or the military seems downright unpatriotic, if not treasonous. The purpose of this article is not to undermine the effectiveness of the U.S. military but to point out a weakness by suggesting that increased awareness of a problem and proposed solutions is one of the first steps toward resolution. It is time for more Americans to become aware of unfair treatment of women within the U.S. military, particularly regarding sexual harassment, so that some of the solutions that experts have proposed can have a chance at implementation and a chance at success, …

The Nebraska Minority And Justice Implementation Committee Progress Report Jan 2004

The Nebraska Minority And Justice Implementation Committee Progress Report

University of Nebraska Public Policy Center: Publications

The Nebraska Minority and Justice Task Force was formed in 1999 by the Nebraska Supreme Court and the Nebraska State Bar Association (NSBA) to examine issues of racial and ethnic fairness within the Nebraska court and legal systems. Through two substantial grants from the State Justice Institute (SJI), administered through the University of Nebraska Public Policy Center, the Minority and Justice Task Force undertook a two-year research project, which culminated in a 200-page final report (the Final Report is available on-line at www.nebar.com and www.unl.edu/ppc). The report investigated topics as diverse as potential bias in criminal prosecution, sentencing, jury …

Job Exit Queues: Corporate Mergers And Gender Inequality, Terceira A. Berdahl, Helen A. Moore Jan 2004

Job Exit Queues: Corporate Mergers And Gender Inequality, Terceira A. Berdahl, Helen A. Moore

Department of Sociology: Faculty Publications

Purpose: to explore the experiences of employees in a local bank merger in the United States and examine the concept of job exit queues. We introduce the concept of a job exit queue, which describes how workers position themselves or are positioned by employers to leave jobs and enter new jobs following the announcement of a corporate merger.
Design/methodology/approach: Qualitative interviews with mid-level managers, technical specialists and low status workers during the sale and merger process were conducted and coded thematically. We explore: 1) how workers and managers describe the job search as an “opportunity” or as a recurring cycle …

University of Nebraska-Lincoln Administration: Reports, Papers, Publications, and Presentations

Role and Mission Statement

The Role of the University of Nebraska-Lincoln

The University of Nebraska-Lincoln, chartered by the Legislature in 1869, is that part of the University of Nebraska system which serves as both the land-grant and the comprehensive public University for the State of Nebraska. Those responsible for its origins recognized the value of combining the breadth of a comprehensive University with the professional and outreach orientation of the land grant University, thus establishing a campus which has evolved to become the flagship campus of the University of Nebraska. UNL works cooperatively with the other three campuses and Central …

Navigating The Hidden Obstacles To Ex-Offender Reentry, Anthony C. Thompson Jan 2004

Navigating The Hidden Obstacles To Ex-Offender Reentry, Anthony C. Thompson

Faculty Articles

As federal and state correctional institutions steadily release record numbers of ex-offenders each year, the communities into which prisoners are released are unprepared to sustain the economic and social burden of the massive reentry movement. As a result, reentering ex-offenders lack the support needed to reintegrate themselves into society and to lead productive, law-abiding lives. This Article first explores political trends that account for the increase in incarceration rates over the last two decades and the resulting social, legal, and economic challenges of reentry both ex-offenders and their communities face. Only recently has the government begun to respond to these …

"The House Was Quiet And The World Was Calm The Reader Became The Book" Reading The Bill Of Rights As A Poem: An Essay In Honor Of The Fiftieth Anniversary Of Brown V Board Of Education, Burt Neuborne

Faculty Articles

The article argues that the Bill of Rights displays a coherent structure similar to the structure underlying a great poem. The vertical structure begins with the articulation in the 1st Amendment of the Founders’ ideal polity, continues in the 2nd and 3rd Amendments with protection of the ideal polity against military overthrow, moves in the 4th through 8th Amendments to protection against civilian attacks on the polity by chronologically summarizing the criminal justice process, and providing protections against its abuse in the 4th (investigation and arrest), 5th (interrogation); 6th (charging and adjudication); and 8th (punishment), and closes in the 9th …

When Two Become One: Views On Fletcher's "Two Patterns Of Criminality", Deborah W. Denno Jan 2004

When Two Become One: Views On Fletcher's "Two Patterns Of Criminality", Deborah W. Denno

Faculty Scholarship

George Fletcher's Rethinking Criminal Law (“Rethinking”) is the ultimate cut-to-the-chase treatise. The book does not belabor the frailties of existing criminal law, but rather predicts an overhaul of much of its doctrine. This essay marks a tribute to Rethinking's influence by examining two of the book's well known “patterns of criminality”: (1) “manifest criminality,” which proposes that crimes are acts that any “objective” observer would clearly recognize as illegal without knowing anything about the mental state of the person committing those acts, and, in stark contrast, (2) “subjective criminality,” which suggests that crimes are consciously intended and experienced only by …

Measuring Educational Gains And Setting Consequences: Charter Schooling And The No Child Left Behind Policy, Erin Lyttle Jan 2004

Measuring Educational Gains And Setting Consequences: Charter Schooling And The No Child Left Behind Policy, Erin Lyttle

Electronic Theses and Dissertations

The charter school movement and the federal legislation No Child Left Behind (2001) have put a process in motion through which parents and students can opt out of the established public education system. This thesis is an in-depth study of one Pittsburgh charter school within the context of a critique of public education in American history. Empirical data was collected through a triangulated research design, which included interviews, surveys, field observations, and content analysis.

Determining the features of a charter school that make classroom dynamics more or less effective than those in traditional public schools was the original micro-level focus …

Assessment Of Constructs Related To Childhood Aggression, Susan B. Mclaughlin Jan 2004

Assessment Of Constructs Related To Childhood Aggression, Susan B. Mclaughlin

Electronic Theses and Dissertations

This study provides empirical support for the comprehensive theoretical model of aggression proposed by Meloy (2001) by examining characteristics of children who have a longstanding history of aggression across home and educational settings. The theoretical model first proposed by Meloy (2001) found attachment, anxiety, and attention difficulties in adults who evidenced severe aggression problems. The current study clarified how the adult model applies to children. That is, this study examined how attachment, anxiety, and attention are related to the overall functioning of children requiring treatment for aggression. Results are discussed in terms of child development issues, treatment selection, and intervention …

Exorcizing Wechsler's Ghost: The Influence Of The Model Penal Code On Death Penalty Sentencing Jurisprudence, Russell Dean Covey Jan 2004

Exorcizing Wechsler's Ghost: The Influence Of The Model Penal Code On Death Penalty Sentencing Jurisprudence, Russell Dean Covey

UC Law Constitutional Quarterly

The constitutional law of capital sentencing currently is torn between its past and its future, its inheritance of a utilitarian, offender-based, sentencing theory and the powerful contemporary resurgence of retributivism as the dominant justification for criminal punishment. The basic procedural and jurisprudential structures all originated as the offspring of an explicitly nonretributive penal theory crafted in large part by Herbert Wechsler and codified in the Model Penal Code. To bring death penalty procedure more in line with contemporary understandings of the death penalty's theoretical and moral justification, the ghost of Herbert Wechsler must be exorcized from the constitutional law of …

Houses Built On Sant: Police Expert Testimony In California Gang Prosecutions; Did Gardeley Go Too Far, Patrick Mark Mahoney Jan 2004

Houses Built On Sant: Police Expert Testimony In California Gang Prosecutions; Did Gardeley Go Too Far, Patrick Mark Mahoney

UC Law Constitutional Quarterly

In 1998, faced with a gang-violence epidemic, California passed the Street Terrorism Enforcement and Prevention Act ("STEP"), becoming the first state to enact a law specifically targeting criminal street gangs. Through STEP, California courts began to gradually expand the scope of evidence admissible to prove gang membership and to loosen restrictions on expert testimony regarding gang behavior. This trend culminated in People v. Gardeley, in which the California Supreme Court upheld an extremely broad view of permissible uses of expert testimony. This note argues that not only did Gardeley goes too far, but also that in its Gardeley decision the …

Communitarianism And Republicanism, Richard Dagger Jan 2004

Communitarianism And Republicanism, Richard Dagger

Political Science Faculty Publications

Communitarianism and republicanism are closely related schools of thought - so closely related that friend and foe alike sometimes conflate them. The relationship is evident in their Latin roots: communitarians are concerned with communitas, the common life of people who form a community, and republicans are devoted to the res publica, the good of the public. Of the two, however, only republicanism traces its lineage as well as its name to ancient Rome. Indeed, scholars often look beyond Rome to the philosophers and city-states of ancient Greece, particularly Aristotle and Sparta, for the origins of republicanism. For the …
