Conceptualizing The Right To Access To Technology, Morton J. Horwitz Feb 2004

Conceptualizing The Right To Access To Technology, Morton J. Horwitz

Washington Law Review

Accepting that a wider distribution of access to technology is, like wider access to education in general, a social good that is usually to be applauded and promoted, my role is not to defend a broader access to technology but rather to suggest the ways in which an advocate might invoke legal categories and concepts in order to advance that goal. By focusing on legal categories, I should emphasize, I wish to slide past any general moral argument about the injustice of the overall distribution of wealth and how a more just distribution could most efficaciously solve many special problems …

"Democratic Despotism" And Constitutional Constraint: An Empirical Analysis Of Ex Post Factor Claims In State Courts, Wayne A. Logan

William & Mary Bill of Rights Journal

This Article explores the history of the Ex Post Facto Clause, including the Supreme Court's seminal 1798 decision in Calder v. Bull, and analyzes the results of a survey of ex post facto claims decided in state courts from 1992-2002, the first study to catalog the types of claims generated among the states, and the institutional response of state courts to them. The author provides an overview of the claims resolved in state courts, examining the nature of the laws challenged, how the challenges fared, and the rationales used by courts in their dispositions. Discussion focuses on two abiding sources …

Rise Of The Machines: Justice Information Systems And The Question Of Public Access To Court Records Over The Internet, Gregory M. Silverman Feb 2004

Rise Of The Machines: Justice Information Systems And The Question Of Public Access To Court Records Over The Internet, Gregory M. Silverman

Washington Law Review

In the first half of the present Article, I introduce the reader to this technology (Part II) and its likely role in evolving justice information systems (Parts I and III). In the second half of the Article, I enter the debate over whether the public should be permitted access to court records over the Internet. After explaining the origins, history, and principal sides of this debate (Part IV), I argue, first, that when used properly, XML permits the public to have access to court records over the Internet while promoting public safety and protecting personal security (Part V) and, second, …

Technology, Values, And The Justice System: The Evolution Of The Access To Justice Technology Bill Of Rights, Donald J. Horowitz Feb 2004

Technology, Values, And The Justice System: The Evolution Of The Access To Justice Technology Bill Of Rights, Donald J. Horowitz

Washington Law Review

To transform these values into reality, the Washington State Supreme Court Order gave the ATJ Board the mission to promote and facilitate equal access to justice, and, among other tasks, to develop and implement policies and initiatives that enhance, improve, and strengthen access to justice. On November 2, 2000, the Court entered an Order which reauthorized the ATJ Board as a permanent body, charging it with responsibility to assure high quality access for all persons in Washington State who suffer disparate access barriers to the justice system. The Court gave the ATJ Board the specific task, among others, to "develop …

Selective Sexual Harassment: Differential Treatment Of Similar Groups Of Women Workers, Elizabeth A. Hoffmann Feb 2004

Selective Sexual Harassment: Differential Treatment Of Similar Groups Of Women Workers, Elizabeth A. Hoffmann

Department of Sociology Faculty Publications

If male workers categorize different groups of women coworkers and, subsequently, treat them differently, the experiences of women from one of these groups would not be indicative of the experiences of women from another group. When this different treatment involves hostile environment sexual harassment of one group, but not the other, then the law must recognize the possibility of "selective sexual harassment." Without this understanding of the nuances of the workplace dynamics, a court could mistake the women of the unharassed group as representing "reasonable women" and the women of the harassed group as simply oversensitive. This paper draws on …

Evidence Tampering, Chris William Sanchirico Feb 2004

Evidence Tampering, Chris William Sanchirico

Duke Law Journal

Current writing on "evidence tampering"--inclusive of the destruction, fabrication, and suppression of evidence--creates the impression that our system of litigation is in a state of fundamental disrepair. This Article suggests that this perception may merely reflect defects in the conventional view of trial's purpose. The conventional view sees trial as a stand-alone device for uncovering microhistorical truths about what has already come to pass. In contrast, this Article advocates viewing trial as but one component of the overall mechanism by which the legal system influences everyday behavior. When trial is viewed less in terms of discerning past events, and more …

Chasing A Rainbow?: Victimisation And The Gay And Lesbian Community In Ireland, Kiran Sarma Feb 2004

Chasing A Rainbow?: Victimisation And The Gay And Lesbian Community In Ireland, Kiran Sarma

Irish Journal of Applied Social Studies

In recent years it has become widely recognised that the gay, lesbian and bisexual community in Ireland experiences a disturbing amount of anti-gay crime. This said, with the exception of a few largely exploratory studies, there is a complete absence of high quality research that examines these experiences in Ireland and we have been forced to formulate our response on a vague notion that "it is a problem" rather than a truly informed appreciation of its extent. This paper argues in favour of such research, and suggests the form it might take based on a review of findings from international …

A Crowded House: Socioeconomics (And Other) Additions To The Law School And Economics Curricula, Thomas S. Ulen Feb 2004

A Crowded House: Socioeconomics (And Other) Additions To The Law School And Economics Curricula, Thomas S. Ulen

San Diego Law Review

In this Article, the author remarks on two developments in the teaching of law and economics in the North American legal academy. First, a paradoxical trend: as law and economics becomes more firmly accepted among legal scholars, the need for separate courses on law and economics may decline. Second, the legal academy is developing important independent literature in law and economics. Ulen argues that as law and economics has become more influential and pervasive, the popularity of separate courses has declined, and the difficulty of fitting more into the curriculum has increased.

Establishing A Uae Database Using Str Loci, Ibrahim Abdullah Ali Al-Housani Feb 2004

Establishing A Uae Database Using Str Loci, Ibrahim Abdullah Ali Al-Housani

Theses

The analysis of DNA polymorphism has become an indispensable tool in forensic science and criminal cases. Today, the amplification of Short Tandem Repeat (STR) loci using PCR is the perfect method for typing biological evidence found at crime scenes. Forensic laboratories all over the world have been progressively expanding their databases for better discrimination among individuals and suspects of crimes.

The objective of this thesis was to analyze the DNA profile of native and non-native populations, and to study the similarities and dissimilarities among them. Blood samples were collected from three non-natives (Egyptian, Indian and Pakistani) and native populations from …
