Getting The Mentally Ill Misdemeanant Out Of Jail., James R. Walker
Getting The Mentally Ill Misdemeanant Out Of Jail., James R. Walker
The Scholar: St. Mary's Law Review on Race and Social Justice
This Comment advocates for the release of jailed persons arrested for nonviolent crimes due to the symptomology associated with their mental illnesses. Mentally ill misdemeanants suffer from severe and persistent mental disorders, usually either a psychotic or mood disorder, without symptoms or a diagnosis of a personality disorder. Due to the increase in arrests of individuals with mental illnesses, jail and prison populations are drastically increasing. These institutions have turned into modern mental hospitals or asylums. Criminalization of the mentally ill occurs because increasing numbers of mentally ill persons who commit minor crimes are subject to more frequent arrests. The …

Education About Chronic Mental Illness And Coping In These Families, Judith Marie Watiti
Loma Linda University Electronic Theses, Dissertations & Projects
Coping styles of family members and familial relationships of patients with Schizophrenia/Schizoaffective, Dissociative, and/or Bipolar Disorder maybe influenced by psychoeducation interventions. Specifically, Psychoeducation (i.e. comprehensive & standardized protocol) can lower family member/primary caregiver expressed emotions (i.e. criticism, emotional over-involvement, avoidance & detachment) that will strengthen their coping styles as caregivers. A control and treatment group were comprised of a total of 32 randomly assigned family members. During the first week. The Coping Styles Questionnaire and The Family Questionnaire were administered to both groups as pretests. In addition, a registration form was completed containing information such as name, address, telephone number, …

Moving Beyond The Criminal Justice Paradigm: A Radical Restorative Justice Approach To Intimate Abuse, Peggy Grauwiler, Linda G. Mills
The Journal of Sociology & Social Welfare
This article traces the history of the development of the treatment of domestic violence as a crime in the United States and the conceptual and practical limitations of this approach in addressing this important social issue. An extensive body of research on restorative justice practice suggests that restorative approaches may contribute to reducing and preventing family violence. Drawing on restorative justice principles, an alternative or supplement to criminal justice approaches is outlined for working with all parties involved in abusive relationships.
Managing Social Conflict - The Evolution Of A Practical Theory, David B. Moore
Managing Social Conflict - The Evolution Of A Practical Theory, David B. Moore
The Journal of Sociology & Social Welfare
This article describes the co-evolution of a process and a theory. Through the 1990s, the process known as "conferencing" moved beyond child welfare and youth justice, to applications in schools, neighbourhoods, and workplaces. In each of these applications, conferencing has assisted participants to acknowledge and transform interpersonal conflict, as a prelude to negotiating a plan of action. Much analysis of conferencing has been linked with social theorist John Braithwaite, whose work has influenced the development of a multidisciplinary theory of these process dynamics, and the development of guiding principles. Key links between theory and practice are described in chronological sequence.
Responsive Regulation In Child Welfare: Systemic Challenges To Mainstreaming The Family Group Conference, Paul Adams, Susan Chandler
Responsive Regulation In Child Welfare: Systemic Challenges To Mainstreaming The Family Group Conference, Paul Adams, Susan Chandler
The Journal of Sociology & Social Welfare
The purpose of this article is to examine the challenges inherent in trans- forming child welfare services. We apply Braithwaite's model of responsive regulation to the restorative practice of family group conferencing in child welfare. Shifting the role of the state away from controller of families in the child protective services system to one of regulatory partner with them is extraordinarily difficult. The paper looks at the complexities of reorienting child welfare services through the use of family group conferences on a large scale.
Family Involvement Interventions In Child Protection: Learning From Contextual Integrated Strategies, David Stuart Crampton
Family Involvement Interventions In Child Protection: Learning From Contextual Integrated Strategies, David Stuart Crampton
The Journal of Sociology & Social Welfare
The use of family group conferencing and related family involvement interventions in child protection is rapidly increasing in the United States and many other countries. There is some concern that the child welfare field will travel down the same road as it did with intensive family preservation services; that is, tremendous enthusiasm later derailed by rigidly designed evaluations that showed unimpressive effects. The work of John Braithwaite suggests an alternative path for finding justifiable excitement about these interventions. Drawing upon Braithwaite's writings and ongoing evaluation research, this article suggests a few steps we can take towards an integrative strategy for …

Appellate Courts, Historical Facts, And The Civil-Criminal Distinction, Chad M. Oldfather
Appellate Courts, Historical Facts, And The Civil-Criminal Distinction, Chad M. Oldfather
Vanderbilt Law Review
Among the pieties of our legal system is the notion that appellate courts do not engage in factual evaluation. Murky though the distinction between "fact" and "law" may be,' there is general agreement that somewhere along the fact-law spectrum lies a point beyond which appellate courts ought not venture. Past it exist questions of "historical fact," the "who, when, what, and where" series of questions that we have deemed only juries or trial judges to be capable of answering.
Just as well accepted is the reasoning behind this juridical line in the sand. Simply put, we believe that appellate courts …

From Smokestack To Suv: The Individual As Regulated Entity In The New Era Of Environmental Law, Michael P. Vandenbergh
Vanderbilt Law Review
"A cardinal principle in dealing with every type of legal arrangement is to keep steadily in view the kinds of people to whom the directions of the arrangement in question are initially addressed-who the people are, in other words, who are expected to act or refrain from acting in accordance with the arrangement if it works successfully, and under what circumstances they are expected to act."
If asked to envision a polluter, most of us would describe a tall stack from a large industrial facility billowing smoke or a pipe releasing foaming liquid into a stream. The environmental laws and …
