The Changing Character Of Sovereignty In International Law And International Relations, Winston P. Nagan, Craig Hammer Jan 2004

The Changing Character Of Sovereignty In International Law And International Relations, Winston P. Nagan, Craig Hammer

UF Law Faculty Publications

This Article makes observations on the concept of sovereignty; we suggest that the concept be studied using the contextual mapping method articulated by the New Haven School of jurisprudence. We observe tension in applying the concept to developing and developed states, and explore the possibility that sovereignty can be abused. We propose state typologies to explore the concept further and to scrutinize the accommodations of authority and control.

Racism, Genocide, And Mass Murder: Toward A Legal Theory About Group Deprivations, Winston P. Nagan, Vivile F. Rodin Jan 2004

Racism, Genocide, And Mass Murder: Toward A Legal Theory About Group Deprivations, Winston P. Nagan, Vivile F. Rodin

UF Law Faculty Publications

This Article is focused on a specific and important issue: the relationship of law to the social reality of group deprivations. From this primary issue, several important sub-issues are generated having a real and substantial impact upon the role of law in the management of group deprivations at every level of social organization (local, national, regional, and international). To focus on the social reality of group deprivations requires a critical starting point. This starting point is determining whether we are adequately describing or assaying the etiology of the human personality types and self-systems that are normally characterized by feelings, sentiments, …

The New Bush National Security Doctrine And The Rule Of Law, Winston P. Nagan, Craig Hammer Jan 2004

The New Bush National Security Doctrine And The Rule Of Law, Winston P. Nagan, Craig Hammer

UF Law Faculty Publications

The war on terrorism has dramatically impacted the direction of U.S. foreign policy, as well as the strategic and tactical operations for securing its objectives. Three questions central to U.S. foreign relations are whether these interests are consistent with international law; whether the United States seeks to modify international law to secure its interests; or whether foreign policy makers see the need to significantly change international legal standards. The aftermath of the of the attacks of September 11, 2001 in the United States triggered an intuitive reaction that the normal rules of restraint embodied in international law might no longer …

Schooled In Silence, Patricia M. Amburgy, Wanda B. Knight, Karen Keifer-Boyd Jan 2004

Schooled In Silence, Patricia M. Amburgy, Wanda B. Knight, Karen Keifer-Boyd

Journal of Social Theory in Art Education

What is not said, is often more powerful than what is spoken about diversity, difference, and identity in U.S. classrooms. Examples are everywhere: Although no students of color may be enrolled in a course at a prominent research university, members of the class do not believe there is such a thing as institutional racism. A handful of women are discussed in course textbooks, all authored by men, but no one thinks it odd that only men have written accounts of women's achievements that appear on the syllabus. Gay, lesbian, bisexual, and transgendered people do not speak for themselves, either, in …

Attitudinal Changes That Occur As A Result Of High School Transition Classes, K. K. Bradshaw Jan 2004

Attitudinal Changes That Occur As A Result Of High School Transition Classes, K. K. Bradshaw

Theses and Dissertations

The purpose of this study was to determine if high school transition classes alter student attitudes toward school, their peers, teachers/administrators or level of parental involvement. A large suburban high school class was administered a Likert Scale pre and posttest at the beginning of the course and at its conclusion. In addition to the pretest/posttest survey, students were grouped into six categories depending on their entering high school grade point averages. This delineation sought to ascertain if academic achievement either exacerbated or enhanced student perceptual indices on the survey. The data analyzed used an ANCOVA technique. Students were divided into …

Superintendents In Arkansas: An Examination Of Expectations And School Effectiveness Research, Tracy Selby Tucker Jan 2004

Superintendents In Arkansas: An Examination Of Expectations And School Effectiveness Research, Tracy Selby Tucker

Theses and Dissertations

This phenomenological study examined the expectations that six superintendents within the state of Arkansas held for building level administrators in effective elementary schools. Expectations were compared to the seven correlates of effective schools. Findings indicated that superintendents had at least one expectation related to each correlate. The major finding was for building level administrators to be strong instructional leaders. Other expectations included: (a) focusing on student learning, (b) knowing and living the expectations of the district and school, (c) being aware of things in the school building and on the campus, (d) communicating with staff and parents, (e) analyzing data, …

Introduction 21st Annual Scholarly Programs: The Future Of Force: Waging War In The 21st Century

UC Law SF International Law Review

This year's 21st Annual Scholarly Programs featured two events that brought leaders in the field together to discuss the legal bases for waging war in the 21st Century. The first event, the Scholars Forum, featured Professor Thomas M. Franck, who discussed his paper, Preemption, Prevention and Anticipatory Self-Defense: New Law Regarding Recourse to Force? Professor Diane Marie Amann, Professor David D. Caron, Professor Joel R. Paul and Judge Abraham D. Sofaer responded to Professor Franck's paper and offered their own perspectives. Professor Naomi Roht-Arriaza served as the mediator. The second event, the Rudolph B. Schlesinger Memorial Lecture, featured Michael J. …

Bringing Reason And History Onto The Same Page: Lobato V. Taylor And The Struggle Over The Common Lands Of Spanish And Mexican Land Grants, Placido G. Gomez Jan 2004

Bringing Reason And History Onto The Same Page: Lobato V. Taylor And The Struggle Over The Common Lands Of Spanish And Mexican Land Grants, Placido G. Gomez

St. Thomas Law Review

Lawyers, scholars and commentators have struggled for decades to articulate the proper role of Spanish and Mexican law and culture in the context of land grant litigation. Historians and legal scholars have suggested that the clash of two distinct and incompatible land tenure systems was, and still is, at the core of the issue. Other scholars and commentators posit that land grant policy and litigation was driven by the United States' early twentieth century quest to organize its public domain and the unscrupulous efforts of land speculators. The efforts of academics, for the most part, did not provide the assistance …

[Review Of] John Carter, Ethnicity, Exclusion And The Workplace, Bridget A. Teboh Jan 2004

[Review Of] John Carter, Ethnicity, Exclusion And The Workplace, Bridget A. Teboh

Ethnic Studies Review

This important volume attempts to evaluate and measure the impact of equal opportunities in the National Health Service and in part, on higher education (4) (i.e. the progress of ethnic minorities through their respective career hierarchies). The major dynamics at work are the desire on the part of excluded social groups to try to gain access into other occupational areas and the success of dominant social groups in closing a particular niche. Those of us who are interested in or confronted by ethnicity in our professional spheres should read this book.

[Review Of] Henk Van Woerden. The Assassin: A Story Of Race And Rage In The Land Of Apartheid. Translated By Dan Jacobson., Ashton Wesley Welch

Ethnic Studies Review

This small volume deserves to be read by those engaged in the study of modern South Africa. It also has interests for students of biography. The Assassin: A Story of Race and Rage in the Land of Apartheid is the first biography of Demitrios Tasfendas. Were it not for his assassination of Dr. Hendrik Verwoerd, the South African Prime Minister, Tsafendas most likely would not have merited even a historical footnote. The Assassin saved Tsafendas from the historical anonymity accorded to the assassins of 20th century notables such as the Archduke Francis Ferdinand and his wife Princess Sophie, Mohandas Gandhi, …

Editor's Note, Faythe Turner

Ethnic Studies Review

In this election year, 2004, people are grappling with the various forces that make up these United States. What forces encourage inclusion and which exclusion? Who is to be included and who excluded? Is this to be a country with wide discrepancies between the rich and the poor? Is this to be a country where public education is poorly funded and a good education depends upon private resources? Are we going to forget that discrimination on the basis of gender, race, ethnic origin, and economic status still exists and needs to be perpetually, vigilantly addressed? There is a deep division …

Thomas Braga's Portingales: A Celebration Of Portuguese American Culture, Reinaldo Silva Jan 2004

Thomas Braga's Portingales: A Celebration Of Portuguese American Culture, Reinaldo Silva

Ethnic Studies Review

Profoundly fascinated by and connected to the ancestral culture, Thomas Braga in Portingales (1981) believes he can best express his condition as a so-called hyphenated American if he expresses himself in English rather than in Portuguese. Fully aware that English, as opposed to Portuguese, will connect him with broader audiences so as to convey his ethnic experience, Braga's poems are subtle reminders to mainstream America of the enormous contributions of the peoples of Portuguese descent to the building of the United States of America.

W. E. B. Du Bois On Brown V. Board Of Education, Stanley O. Gaines Jr. Jan 2004

W. E. B. Du Bois On Brown V. Board Of Education, Stanley O. Gaines Jr.

Ethnic Studies Review

The 1960s have been described as the "civil rights decade" in American history. Few scholar-activists have been identified as strongly with the legal, social, economic, and political changes culminating in the 1960s as has African American historian, sociologist, psychologist W. E. B. Du Bois. Inexplicably, in 2003, the 100-year anniversary of Du Bois' classic, The Souls of Black Folk (1903), came and went with little fanfare within or outside of academia. However, in 2004, the 50-year anniversary of the initial U. S. Supreme Court decision in Brown v. Board of Education (1954) presents an opportunity for ethnic studies in general, …

[Review Of] Patricia V. Symonds. Calling In The Soul: Gender And The Cycle Of Life In A Hmong Village, Jeremy Hein

Ethnic Studies Review

Hmong Americans are a diaspora group that came from Laos after leaving southern China in the early 1800s. The U.S. C.I.A. recruited a Hmong army during the 1960s to assist with the American military campaign against communism in Southeast Asia. Hmong refugees began arriving in the United States in 1975 following the collapse of the pro-American Laotian government. There are now about 200,000 Hmong Americans.

How And Why Lslamophobia Is Tied To English Nationalism But Not To Scottish Nationalism, Asifa M. Hussain, William L. Miller Jan 2004

How And Why Lslamophobia Is Tied To English Nationalism But Not To Scottish Nationalism, Asifa M. Hussain, William L. Miller

Ethnic Studies Review

Muslim minorities throughout Europe are under threat of collateral damage from the Blair/Bush 'War on Terror.' In Scotland they also have to cope with the added possibility that Scottish nationalism might develop an 'ethnic' as well as a 'civic' dimension. But is Scottish nationalism part of the problem or part of the solution? Paradoxically, Muslims are under less pressure in Scotland than in England, despite Scotland's move over recent decades--psychologically as well as institutionally--towards nationalism.

Implementation Of An Individual Professional Development System Using A Web-Accessible Database, Edward R. Lovitt Jan 2004

Implementation Of An Individual Professional Development System Using A Web-Accessible Database, Edward R. Lovitt

CCAC Theses and Dissertations

Higher education is looking for ways to encourage new careers in education and retain current faculty working in the field. A successful working relationship between supervisors and faculty is crucial to continued attractiveness of a career in education. These shared relationships exist in "learning organization" models, which are used in professional development offerings that stress the importance of learning by individuals, as a way to benefit the entire institution.

This developmental study focused on building partnerships with supervisors and faculty. These partnerships require contracts or individual development plans that can be reviewed for progress and modified for future needs. The …

A Framework For The Identification Of Electronic Commerce Visual Design Elements That Enable Trust Within The Small Hotel Industry, R. Todd Stephens Jan 2004

A Framework For The Identification Of Electronic Commerce Visual Design Elements That Enable Trust Within The Small Hotel Industry, R. Todd Stephens

CCAC Theses and Dissertations

Trust plays an important role in any customer relationship or transaction. This is especially true in the world of commerce. Buyers and sellers must make the conscious decision whether or not to trust the other party. Trust is an integral part of commerce and has been in existence since the beginning of human social interactions. With the emerging use of the Internet as a business medium of exchange, trust maintains an important role in electronic commerce. This research reviews the role of trust within the small hotel industry and the design elements having the highest impact toward developing trust between …

Reenchanting The Law: The Religious Dimension Of Judicial Decision Making, Mark C. Modak-Truran Jan 2004

Reenchanting The Law: The Religious Dimension Of Judicial Decision Making, Mark C. Modak-Truran

Journal Articles

Without a religious justification in the law, judges cannot fully justify their decisions in hard cases from within the law. The law must be indeterminate because the Establishment Clause proscribes this full justification. This does not mean that the Establishment Clause prohibits judges from fully justifying their decisions during their deliberations about hard cases. It only prohibits judges from including that full justification in their written opinions. Deliberation and explanation are separate stages of judicial decision making that should be kept distinct. Given this distinction, my thesis is that judges should fully justify their decisions in hard cases by relying …

On Collegiality, Michael L. Seigel Jan 2004

On Collegiality, Michael L. Seigel

UF Law Faculty Publications

The problem of collegiality in academia is like a crazy aunt in the family: ever present, whispered about in hallways, but rarely acknowledged directly. My goal in this article has been to initiate the demise of this pattern of unhappy toleration. The toleration stems, in large part, from an apparently widespread fear that attempts to control colleagues' uncollegial conduct will result in an unacceptable diminution of academic freedom. Although these concerns are legitimate, I have sought to prove that, if appropriate care is taken, academic freedom may flourish at the same time that a norm of basic collegiality is enforced. …
