Toward An Indigenous Jurisprudence Of Rape, Sarah Deer

Faculty Scholarship

This article sets forth some preliminary issues and perspectives for the development of indigenous models of rape jurisprudence. Part I examines the reasons for and importance of developing an indigenous jurisprudence of rape. Part II addresses tribal jurisdiction issues, particularly the current limitations on tribal authority. Part III provides a historical context for the issue, including examples of the role of colonization in the responses to sexual violence. Part IV shares some visions for the development of a contemporary jurisprudence of rape for indigenous nations.

THE MIND OF Lewis Binford is nimble and constantly evolving. In part, one can map Binford's prodigious intellectual growth by looking at the research trajectories of his students, who often continue on paths they began under his tutelage. In my case, certainly, this is very true. When I arrived at the University of New Mexico in the late 1970s and early 1980s, Binford was exploring the nature of the archaeological record: how to understand past human organization at a supra-ethnographic scale, what we might learn from bones and site structure, and how to reliably give meaning to the archaeological record. …

INUPIAT ESKIMO WHALERS are allowed to kill up to 50 bowhead whales every year in the arctic waters off Barrow, Alaska. Some of the older bowheads are more than 20 m in length and weigh more than 50 tons. Since 1981 the Inupiat have found at least six lance and harpoon end blades embedded within the thick blubber that insulates these magnificent mammals (Raloff 2(00). These archaeological weapon points included projectiles fashioned from chipped stone, ground slate, ivory, and iron. Wildlife biologists have suspected that whales may live to be quite old. One can only imagine their surprise, however, once …

The Link Between Prostitution And Sex Trafficking, U.S. Department Of State Jan 2004

The Link Between Prostitution And Sex Trafficking, U.S. Department Of State

Human Trafficking: Data and Documents

The U.S. Government adopted a strong position against legalized prostitution in a December 2002 National Security Presidential Directive based on evidence that prostitution is inherently harmful and dehumanizing, and fuels trafficking in persons, a form of modern-day slavery.

Prostitution and related activities—including pimping and patronizing or maintaining brothels—fuel the growth of modern-day slavery by providing a façade behind which traffickers for sexual exploitation operate.

Human Trafficking: Mail Order Bride Abuses, Committee On Foreign Relations - United States Senate

Human Trafficking: Data and Documents

Today we will be hearing from three panels on the issues surrounding international marriage brokers, so-called mail order brides, and the links that can be made to human trafficking. I am please to welcome my colleague and friend, who will soon appear, Senator Maria Cantwell from the great State of Washington, to be our first panel. Senator Cantwell has seen abuses against mail order brides occur in her own State and has authored the International Marriage Brokers Regulation Act. Her passion for protecting women trapped in such abusive and dangerous relationships is to be commended.

Examining U.S. Efforts To Combat Human Trafficking And Slavery, Committee On The Judiciary - United States Senate

Human Trafficking: Data and Documents

This Subcommittee is expressly chartered to oversee both constitutional and civil rights issues across America. Just last month, for example, the Subcommittee examined the pervasive problem of hostility to religious expression in public squares across America, and I think the hearing was beneficial regardless of whether you perceive there to be a problem or not.

Today’s hearing will examine U.S. efforts to combat human trafficking and slavery across America. As we continue to fight to protect the American way of life in our war against terrorism, we have also been fighting another war to protect American ideals and principles, a …

A Mirage In The Sand? Distinguishing Binding And Non-Binding Relations Between States, Christine M. Chinkin Jan 2004

A Mirage In The Sand? Distinguishing Binding And Non-Binding Relations Between States, Christine M. Chinkin

Book Chapters

The article discusses the two decisions (thus far) of the International Court of Justice in the case concerning Maritime Delimitation and Territorial Questions between Qatar and Bahrain, especially its consideration of when an internationally binding agreement has come into existence. The Court's willingness to infer a legally binding agreement, regardless of the intentions of at least one of the parties, appears to displace the primacy of consent it has emphasized in its earlier jurisprudence. The decision seems to hold states bound by informal commitments, an approach that might inhibit open negotiations between states and undermine genuine attempts to pre-empt disputes …

Transitions To Adulthood In The Context Of Aids In South Africa: The Impact Of Exposure To Life Skills Education On Adolescent Knowledge, Skills, And Behavior, The Transitions To Adulthood Study Team

HIV and AIDS

This study is a collaborative research project of the University of Natal-Durban, the Horizons program, and Tulane University. One objective of the study was to contribute to understanding the effectiveness of life skills education in changing behavior in South Africa. The findings indicate substantial short-to-medium-term effects of exposure to life skills education on certain areas of sexual and reproductive health-related knowledge, confidence to use condoms, and condom use behavior. Further research is needed to assess whether the observed effects are transitory or long-term in nature, whether the observed behavioral changes have an impact on HIV infection rates among youth, and …

Doing Well And Happy About It? Explaining Variance In Entrepreneurs’ Stated Satisfaction With Performance, Gregory B. Murphy, Stephen K. Callaway Jan 2004

Doing Well And Happy About It? Explaining Variance In Entrepreneurs’ Stated Satisfaction With Performance, Gregory B. Murphy, Stephen K. Callaway

New England Journal of Entrepreneurship

The importance of performance measurement is largely undisputed. There is debate, however, regarding the equivalency of objective and subjective performance measures. This debate has not considered a frequently used subjective measure, satisfaction with performance, to be an important measure independent of its equivalency with objective measures. Using a sample of 368 manufacturing firms, this study found that objective measures explained only a modest amount of variance in satisfaction with performance and that other variables added significantly to the explained variance. These factors included perceived environmental hostility, vulnerability, perceived competitive advantage, and commitment.

[Review Of] Andrew Pilkington, Racial Disadvantage And Ethnic Diversity In Britain, Simboonath Singh Jan 2004

[Review Of] Andrew Pilkington, Racial Disadvantage And Ethnic Diversity In Britain, Simboonath Singh

Ethnic Studies Review

Andrew Pilkington's Racial Disadvantage and Ethnic Diversity in Britain (2003) is a comprehensive and systematic study of race and ethnicity in contemporary Britain. The approach taken is decidedly sociological but incorporates an inter-disciplinary perspective, drawing upon areas such as History, Politics, Geography and Cultural Studies. In Chapter 1 the author makes a fine conceptual distinction between core concepts such as race and ethnicity and theoretically subscribes to the more dynamic social constructionist approach to ethnicity as an acceptable alternative to previous models. Racialization is invoked as an alternative problematic of racism to alert the reader to the dangers of reification …

[Review Of] Garbi Schmidt, Islam In Urban America: Sunni Muslims In Chicago, Jess Hollenback Jan 2004

[Review Of] Garbi Schmidt, Islam In Urban America: Sunni Muslims In Chicago, Jess Hollenback

Ethnic Studies Review

Islam in Urban America: Sunni Muslims in Chicago is a well-researched, carefully nuanced, and timely contribution to our understanding of Muslim Americans and an excellent corrective to the all-too-common tendency to homogenize both Islam and Muslims. This study stresses the multiple elements of diversity in American Islam by focusing on how ethnicity, class, gender, class, age, and ideology have influenced the presentation and practice of Sunni Islam among immigrant communities in Chicago during the 1990s. Garbi Schmidt is currently a researcher in the ethnic minorities program at the Danish National Institute of Social Research in Copenhagen. This book is a …
