The Ethnic Question In Law And Development, Lan Cao May 2004

The Ethnic Question In Law And Development, Lan Cao

Michigan Law Review

World on Fire: How Exporting Free Market Democracy Breeds Ethnic Hatred and Global Instability, by Professor Amy Chua, is an analytically complex narrative of contemporary ethnic violence in the current era of globalization. Although such violence has historical roots, according to Chua it has also been fueled by free-market forces and democratization. The book is a forceful and provocative indictment of the current U.S. policy of promoting and exporting markets and democracy to developing and formerly communist, market-transitional countries. In her book, Professor Chua applies her thesis - that ethnicity, global capitalism, and democracy are a volatile mix - …

Are Single-Sex Schools Inherently Unequal?, Michael Heise May 2004

Are Single-Sex Schools Inherently Unequal?, Michael Heise

Michigan Law Review

In chess, a "fork" occurs when a player, in a single move, attacks two or more of an opponent's pieces simultaneously, forcing a necessary choice between unappealing outcomes. Similar to the potentially devastating chess move, single-sex public schooling forks many constitutionalists and feminists. Constitutionalists are forced to reexamine the "separate but equal" doctrine's efficacy, this time through the prism of gender. Although the doctrine - forged in the crucible of race and overcome in the monumental triumph we know as Brown v. Board of Education - rested dormant for generations, persistent (and increasing) single-sex education options are forcing scholars to …

Spectres Of Law & Economics, William H. Widen May 2004

Spectres Of Law & Economics, William H. Widen

Michigan Law Review

There are spectres haunting law and economics - the spectres of G.W.F. Hegel and Jacques Lacan. This is one of the central theses of Professor Jeanne L. Schroeder's challenging new book: The Triumph of Venus, the Erotics of the Market ("Triumph of Venus"). Schroeder uses insights inspired by the teachings of Hegel and the French psychoanalyst, Lacan, to critique some basic assumptiosn made by scholars who use economic ideas to investigate the law and legal institutions - the law and economics ("L&E") practitioners. The book devotes much space to criticism of Judge Posner's vision of law, using it …

Explaining The Gender Gap In Help To Parents: The Importance Of Employment, Naomi Gerstel, Natalia Sarkisian May 2004

Explaining The Gender Gap In Help To Parents: The Importance Of Employment, Naomi Gerstel, Natalia Sarkisian

Center for Families Publications

Although it is well established that adult daughters spend more time giving assistance to their parents than do sons, the sources of this gender gap are not well understood. This paper asks: To what extent can this gap be explained by structural variation, especially the different rates of employment and kinds of jobs that women and men tend to hold? Using data from the National Survey of Families and Households (N= 7,350), the paper shows that both employment status and job characteristics, especially wages and self-employment, are important factors in explaining the gender gap in the help given to parents …

Rewriting The Holocaust Online: A Discourse Analysis Of Holocaust Denial Web Sites, Mark Aaron Polger May 2004

Rewriting The Holocaust Online: A Discourse Analysis Of Holocaust Denial Web Sites, Mark Aaron Polger

Publications and Research

This study is undertaken to learn how Holocaust deniers use Internet websites to attain legitimacy and credibility. I attempt to show that this sort of “historical revision” is actually blanketed anti-Semitism. I examine Holocaust denial as it is viewed by different disciplines. I investigate the main figures of Holocaust denial. As well, I analyze Jewish race theories of the past two hundred years to demonstrate how Jews have been perceived as aliens and as outsiders. The construction of the “Jew as outsider” sets the stage for how Holocaust deniers frame their discourse on their web pages. My research investigates a …

The Relationship Between The Use Of Developmentally Appropriate Practice And The Inclusion Of Product-Producing Art Activities In Infant Programs., April D. Moore

Electronic Theses and Dissertations

Product-producing art activities (PPAA) produce visual products, disregarding developmentally appropriate practice (DAP) and the creative learning experience. Infant programs in Northeast TN were examined to determine if as PPAA levels increased DAP levels decreased, which was unfounded: t (2) = 1.80, n.s. In fact, significant differences were found between programs with high PPAA levels and DAP as indicated by scores on the Infant/Toddler Environment Rating Scale (Harms, Cryer, & Clifford, 1990) sub-scales: Furnishings and Displays, t (2) = 7.59, p < .05; Listening and Talking, t (2) = 6.71, p < .05; and Learning Activities, t (2) = 7.29, p < .05. Caregivers' main reason for including PPAA was: positive sensory experience; main reason for exclusion: infant/teacher relationship is more important.

Strategic Consequences Of The Iraq War: U.S. Security Interests In Central Asia Reassessed, Elizabeth Wishnick Dr. May 2004

Strategic Consequences Of The Iraq War: U.S. Security Interests In Central Asia Reassessed, Elizabeth Wishnick Dr.

Books, Monographs & Collaborative Studies

The U.S.-led war in Iraq complicates security cooperation between the United States and Central Asia at a time when other regional powers—especially Russia, China, and India—are competing for influence in the region more overtly. Concerned about the implications of the U.S. interest in "regime change" for their own rule, Central Asian leaders now have an added incentive to overstate terrorist threats, persecute political opposition, and crack down on peaceful religious activity. The author argues that the United States should do more to address the underlying human security problems in Central Asia, which increase its vulnerability to terrorist movements.

Family Businesses, Choices Of Legal Entity, Martina L. Rojo May 2004

Family Businesses, Choices Of Legal Entity, Martina L. Rojo

LLM Theses and Essays

There is not a “best” choice of legal entity for Family Business in the USA and in Argentina. The different legal choices provide with “better” or “worse” options of legal entity according with the entrepreneurs’ expectations and concerns. However, some legislation in the USA has recognized the special characteristics of Family Businesses, and allows more possibilities of customization of the governance structure and succession planning of such businesses. Argentina’s law should follow that path

The Skull Valley Goshute And Nuclear Waste: Rhetorical Analysis Of Claims-Making Of Opponents And Proponents, Jesse T. Weiss

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

One of the greatest challenges to modem society is the management and disposal of hazardous by-products that have accompanied the industrial advances of the twentieth century. One of the most difficult by-products to deal with has been radioactive waste. Previous research has shown that due to the real and perceived risks associated with this type of waste, the burden of storing said waste has fallen on minority communities, including Native American groups. This research examines the proposed temporary nuclear waste storage facility to be located on the Skull Valley Indian Reservation in Utah. Using an ethnographic case study approach, this …

A Longitudinal Analysis Of Socioeconomic Differences In Obesity And Weight Change During The Early Adult Years, Young-Taek Kim

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Obesity has reached epidemic proportions in American society. However, not enough attention has been given to weight change by temporal and dynamic detailed social characteristics, controlled for unobserved heterogeneities nested in county and state. Using the National Longitudinal Survey Youth (NLSY79), this study examined weight change and its development into unhealthy conditions like being overweight or obese, in relation to change in social characteristics including life course events. This study also examined the social characteristics of remaining at a normal weight through all time intervals over a 19-year period. Using hierarchical linear multilevel analysis, this study found that changes in …

A Church Crisis: A Rhetorical Criticism Of Communication Arguments From Proponents Of Both Sides Of The Homosexual Movement In The Christian Church, Garland Brent Wallace

Electronic Theses and Dissertations

The increased levels of homosexual discussion in mainstream media culture have aroused opinion diversity in both secular and religious circles. The case of Bishop Gene Robinson has brought the issue of homosexuality in the priesthood to the forefront. However, the main issue does not rest on the issue of homosexuality but rather on the inspiration, validity, and authority of the Bible as scripture. After the evaluation of two pieces of rhetoric, including an interview given by Bishop Gene Robinson on a local radio broadcast and a speech given by B. L. Mauser concerning homosexuality as sin, Kenneth Burke's pentad will …

Hong Kong Right Of Abode: Ng Siu Tung & (And) Others V. Director Of Immigration - Constitutional And Human Rights At The Mercy Of China, Teresa Martin

San Diego International Law Journal

This Comment argues that the Court's refusal to sidestep the Standing Committee's reinterpretation using either the Doctrine of Legitimate Expectation, or the judgments previously rendered clause in the Basic Law, signifies its capitulation to the Standing Committee, and its inability to protect constitutional rights and/or human rights in Hong Kong. This Comment will first give a brief background on the concept of one country, two systems and the drafting of the basic law. Second, it will introduce the Right of Abode cases, and explain the constitutional crisis of 1999. Third, it analyzes Ng Siu Tung & Others v. Director of …

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Wrist surgery is a common method for treating carpal tunnel syndrome (CTS) although few studies have examined patient outcomes or predictive correlates of such procedures. The objectives of this study were to characterize Utah workers who received surgery for CTS in terms of relevant presurgical and outcome variables and to identify presurgical correlates of patient outcomes. Participants were 75 Utah workers' compensation patients who underwent surgery for CTS from 1999-2002 and were at least 6 months postsurgery at time of follow-up. A retrospective cohort design was utilized consisting of a review of presurgical medical records and a postsurgical telephone survey. …
