System–On–A–Programmable–Chip Development Platforms In The Classroom, Tyson S. Hall, James O. Hamblen
Faculty Works
This paper describes the authors’ experiences using a system-on-a-programmable-chip (SOPC) approach to support the development of design projects for upper-level undergraduate students in their electrical and computer engineering curriculum. Commercial field-programmable gate-array (FPGA)-based SOPC development boards with reduced instruction set computer (RISC) processor cores are used to support a wide variety of student design projects. A top-down rapid prototyping approach with commercial FPGA computer-aided design tools, a C compiler targeted for the RISC soft-processor core, and a large FPGA with memory is used and reused to support a wide variety of student projects.

Whistling In The Dark? Corporate Fraud, Whistleblowers, And The Implications Of The Sarbanes-Oxley Act For Employment Law, Miriam A. Cherry
Washington Law Review
Passed in 2002 in the wake of the accounting scandals that resulted in billions of dollars of lost value to shareholders, the Sarbanes-Oxley Act has as its major goal the prevention of corporate corruption. This Article analyzes the impact of section 806, the portion of the Sarbanes-Oxlcy Act that provides protections for employees who report securities fraud, and describes the effect that Sarbanes-Oxley has on existing employment law. In addition, this Article contributes to the debate over the general effectiveness of the Sarbanes-Oxley Act, a topic of contention among both academics and press commentators. This Article argues that the Act …

Short- And Long-Term Effects Of Acetylsalicylic Acid Treatment On The Proliferation And Lipid Peroxidation Of Skin Cultured Melanocytes Of Active Vitiligo, Mohammad Z. Zailaie
Saudi Medical Journal
OBJECTIVE: Recent in vitro and in vivo studies have shown that the nonsteroidal anti-inflammatory agent, acetylsalicylic acid (ASA) or aspirin has antioxidant properties on various cell lines and tissues. Hence, the aim of the present study is to investigate the effects of ASA at 2 different concentrations (75 and 300ug/ml) on the proliferative capacities and lipid peroxidation of in vitro skin cultured melanocytes obtained from patients with active vitiligo. METHODS: The present work was carried out from February 2001 through to November 2001, at the Vitiligo Unit, King Abdul-Aziz University Medical Center, Jeddah, Kingdom of Saudi Arabia. Employing methods described …

Bone Mineral Density Among Postmenopausal Saudi Women, Mir Sadat-Ali, Ibrahim M. Al-Habdan, Fatma A. Al-Mulhim, Abdallah Y. El-Hassan
Saudi Medical Journal
OBJECTIVE: Osteoporosis is reported to be common among postmenopausal Saudi women. The reported incidence varies between 50-60%. Different machines were used to reach these conclusions. At present it is believed that dual energy x-ray absorptiometry (DEXA) is the most accurate method to diagnose osteoporosis. This study was conducted to measure bone mineral density (BMD) measurement of lumbar spine and the upper femur of Saudi postmenopausal women attending orthopedic clinic with unrelated complaints. METHODS: This study comprises of 256 patients attending orthopedic clinics at the King Fahd Hospital of the University, Al-Khobar, Kingdom of Saudi Arabia between January 2002 and June …
Combined Parathyroid Adenoma And An Occult Papillary Carcinoma, Abdul-Wahed N. Meshikhes, Mohammed S. Butt, Basima A. Al-Saihati
Combined Parathyroid Adenoma And An Occult Papillary Carcinoma, Abdul-Wahed N. Meshikhes, Mohammed S. Butt, Basima A. Al-Saihati
Saudi Medical Journal
Although the pathological association of thyroid and parathyroid disease is common, the association of both parathyroid adenoma and thyroid cancer is rare. We report here a case of a 45-year-old Saudi woman who was diagnosed to have primary hyperparathyroidism due to a single parathyroid adenoma as confirmed biochemically and radiologically. At operation, the adenoma was found to be an intrathyroid and therefore a thyroid lobectomy was performed. Histology of the excised lobe revealed in addition to the intrathyroid parathyroid adenoma a concurrent occult thyroid papillary carcinoma. This interesting association is discussed based on a literature review.

The Effect Of Income Taxation On Consumption And Labor Supply, James P. Ziliak, Thomas J. Kniesner
The Effect Of Income Taxation On Consumption And Labor Supply, James P. Ziliak, Thomas J. Kniesner
Center for Policy Research
We estimate the incentive effects of income taxation in a life-cycle model of consumption and labor supply that relaxes the standard assumption of strong separability within periods. Our model permits identification of both within-period preference parameters and lifecycle preference parameters such as the inter-temporal substitution elasticity. Results indicate that consumption and hours worked are direct complements in utility, and both increase with an increase in the after-tax share and with a compensated increase in the net wage. The compensated net wage elasticity is about 0.3, nearly double the standard estimates for men in the United States that ignore within-period non-separability …

Judging Merit, Patrick S. Shin
Judging Merit, Patrick S. Shin
Suffolk University Law School Faculty Works
In this invited response to Stephen Choi & Mitu Gulati, "Choosing the Next Supreme Court Justice: An Empirical Ranking of Judge Performance," 78 S. CAL. L. REV. 23, 30 (2004), I analyze the central normative assumptions underlying Choi and Gulati’s "Tournament of Judges." To that end, I explore the concept of "merit" as it applies to the selection of individuals for important institutional positions. I suggest that an ascription of merit can be understood to entail a claim that an individual exemplifies the aptitudes, excellences, and virtues of a particular office or position. I argue that merit in this sense …

He goes on to provide a brief introduction for each paper.
The Republican Model And Punitive Damages, David F. Partlett
The Republican Model And Punitive Damages, David F. Partlett
San Diego Law Review
Fueled by complaints of outlandish punitive damage awards and a United States Supreme Court intent on bringing constitutional order to this corner of torts damages, a considerable literation has emerged. Commentators have examined the bases for the award of punitive damages and have applied empirical analysis to probe the legitimacy of popular criticism and the extent to which punitive damages fulfill the goals assigned to them. In this essay, I propose that punitive damages should be conceptualized in light of a republican theory of tort law with the jury as its central institution. This is ironic, since influential commentators and …
Do Punitive Damages Compensate Society?, Michael B. Kelly
Do Punitive Damages Compensate Society?, Michael B. Kelly
San Diego Law Review
This Article focuses on the concept that punitive damages can be justified as a substitute for compensatory damages for harms caused by the defendant to persons other than the plaintiff. The author concludes that punitive damages are a poor device for redressing harms caused to persons not a party to the action. Once punitive damages seek to address concerns beyond the plaintiff and the defendant, they raise a series of problems that defy rationalization. This article urges that we not take punitive damages as so great a good that we run roughshod over dues process in our zeal to preserve …
Brown Ii's "All Deliberate Speed" At Fifty: A Golden Anniversary Or A Mid-Life Crisis For The Constitutional Injunction As A School Desegregation Remedy?, Doug Rendleman
San Diego Law Review
In 1955 in Brown II the Supreme Court instructed school authorities and federal judges how to implement its decision in Brown I that racially segregated public schools violated the constitution. This article summarizes the half-century of federal injunctions that the courts granted to desegregate schools. It organizes the injunctions chronologically under three headings, "all deliberate speed," desegregate "now," and "unitary" districts. Rejecting both extravagant hoopla and charges of "failure," the article approves disciplined judicial discretion leading to large-scale structural injunctions when the times are ripe because unconstitutional conditions warrant massive judicial reconstruction. In particular, the article maintains that the courts' …
The Rise And Decline Of Structural Remedies, Russell L. Weaver
The Rise And Decline Of Structural Remedies, Russell L. Weaver
San Diego Law Review
One of the most significant remedial developments during the twentieth century was the rise and (partial) decline of the structural injunction in which courts, usually federal courts, restructure or reshape legislative or administrative agencies such as schools or prisons. Structural remedies appear to be inconsistent with the judicial function conceptually. Despite this concern, federal courts have entered structural relief in an extraordinary array of cases that have dramatically reshaped society. This Article examines the structural remedy and offers some reflections on its appropriate use.
"Preliminarily" Enjoining Elections: A Tale Of Two Ninth Circuit Panels, James M. Fischer
"Preliminarily" Enjoining Elections: A Tale Of Two Ninth Circuit Panels, James M. Fischer
San Diego Law Review
In the context of many election challenges, given time constraints involved, preliminary injunctions will be the remedy of necessity for those who seek postponement of the election. This Article examines whether the tests for granting preliminary injunctions are adequate for the task and whether the standards for reviewing district court decisions are sufficient.
The Law Of Remedies In The Second Half Of The Twentieth Century: An Australian Perspective, Gary Davis, Michael Tilbury

Why Do Emprirical Legal Scholarship?, Theodore Eisenberg
Why Do Emprirical Legal Scholarship?, Theodore Eisenberg
San Diego Law Review
People conduct legal scholarship for many different reasons. This Article focuses on the demand for and reaction to scholarship that helps inform litigants, policymakers, and society as a whole about how the legal system works. The author argues that the need for legally sophisticated empirical analysts is clear.
Why I Write (And Why I Think Law Professors Generally Should Write), Yale Kamisar
Why I Write (And Why I Think Law Professors Generally Should Write), Yale Kamisar
San Diego Law Review
Looking back on forty-five years of law review writing, Professor Kamisar concludes that, to use George Orwell's words, he has been moved to write by "a sense of injustice" and the need to "expose" "some lie," e.g., the lie that the trial judge or the prosecuting attorney can be counted on to protect the rights of unrepresented defendants. He maintains further that law professors generally should feel an obligation to write because they can think through and research exhaustively any and every problem they meet along the way without worrying about billable hours and they can do so "under working …
Legal Scholarship: A Corporate Scholar's Perspective, Jonathan R. Macey
Legal Scholarship: A Corporate Scholar's Perspective, Jonathan R. Macey
San Diego Law Review
Using Professor Jonathan Macey's own field, corporate law, as its focal point, this Article argues that alternative approaches to legal scholarship, whatever their other merits, do not help connect the law school to other parts of the universities in which they are situated, and in face actually alienate the law school from their more intellectually rigorous campus counterparts.

Raich V. Ashcroft: Medical Marijuana And The Revival Of Federalism, Samantha Everett
Raich V. Ashcroft: Medical Marijuana And The Revival Of Federalism, Samantha Everett
San Diego Law Review
In Raich v. Ashcroft, the Ninth Circuit ruled that the CSA was an unconstitutional exercise of congressional commerce power when applied to citizens who use marijuana that has not traveled interstate and was never intended for interstate or foreign commerce. This Casenote argues that Raich was correctly decided and should be upheld by the Supreme Court on appeal. In addition, the judiciary should continue to narrowly interpret the commerce power in order to further the fundamental purpose of our dual system of government: protection of individual rights. More specifically, courts should apply the reasoning of Raich and narrowly define the …

Sustained Growth In Nebraska, Saeed Ahmad, John Austin, Tom Doering, Ernie Goss, Bruce Johnson, Mike Lundeen, Donis Petersan, Franz Schwarz, Eric Thompson, Keith K. Turner
Economics Faculty Publications
National Macroeconomic conditions are favorable for future expansion of income, employment, and revenue in Nebraska. In particular, the U.S. economy is now in the heart of an expansion expected to persist over the three year forecast period. The principal engine of growth will be a sustained expansion in private sector investment and consumption demand. However, the rate of growth in the national economy likely will be moderate rather than rapid. At least three factors will act to moderate growth. The first is higher energy prices. Rapid growth in global demand is expected to keep prices for oil and natural gas …
Risk Realization, Emotion, And Policy Making, Chris Guthrie
Risk Realization, Emotion, And Policy Making, Chris Guthrie
Missouri Law Review
People are likely to overestimate the impact of negative life events on our enduring sense of well-being. If true, this empirical finding puts policy makers in an awkward position because they are generally called upon to make policy in anticipation of , rather than in response to, such events. Nonetheless, I will argue that policy makers should take into account our tendency to overestimate the emotional impact of such events.
