Court Review: Volume 40, Issue 3-4 - How Useful Is The New Aggressive Driving Legislation?, Victor E. Flango, Ann L. Keith

Court Review: Journal of the American Judges Association

Aggressive driving usually refers to a disregard for others on the road and is distinguished from the more extreme “road rage,” which involves violent, criminal acts. Nevertheless, with an 1,800 reported incidents of violent road behavior involving the use of an automobile in the United States in 1996, it is a national problem requiring attention. Aggressive driving is responsible for more than 27,000 fatalities per year as well as over 3,000,000 injuries, costing over $150 billion dollars.

A survey of 6,000 drivers by the National Highway Traffic Safety Administration (NHTSA) found that 60% of the drivers interviewed believed that unsafe …

Court Review: Volume 40, Issue 3-4 - Problem-Solving Supervision: Specialty Probation For Individuals With Mental Illnesses, John Petrila, Jennifer L. Skeem

Court Review: Journal of the American Judges Association

One of the most important developments in American law over the last decade has been the exponential growth of problem-solving courts. Such courts achieve efficiencies by consolidating certain types of cases before specially designated judges. Additionally, in many instances, problem-solving courts adopt a therapeutic focus by attempting to achieve outcomes (e.g., obtaining treatment for a defendant) that go beyond the traditional goals of the judicial system. A recent commentary in this journal noted that “problem-solving courts generally focus on the underlying chronic behaviors of criminal defendants.” These courts include, but are not limited to drug courts, mental health courts, domestic …

Court Review: Volume 40, Issue 3-4 - Racial And Ethnic Bias In The Courts: Impressions From Public Hearings, Elizabeth Neeley

Court Review: Journal of the American Judges Association

Attitudes toward the courts can affect the way individuals perceive their role in the justice system: their willingness to comply with laws, report crimes, file legal suits, serve as jurors, and so on. In short, a positive public perception of the courts is “critical to the maintenance and operation of the judicial system.” Given the import of these perceptions, a substantial body of research has examined the factors that explain differing levels of support for the court system. Although many of these studies examine national samples or examine attitudes toward the U.S. Supreme Court, it is beyond the scope of …

Age Dependence; Of Spiral Grain In Widte Oaks (Quercus Alba) In Southcentral Illinois, Julia Rauchfuss

All-Inclusive List of Electronic Theses and Dissertations

Spiral grain, the alignment of wood fibers (trachejds) to the longitudinal axis of h·ees, is thought to be an indicator of old age and is a phenomenon that has been only stndied with destrnctive sampling methods (cutting down trees). In this study, the usefulness of non-fatal sampling methods and existing methods to quantify spiral grain patterns in Jiving and dead deciduous trees are examined, particularly in white oaks (Qi1ercus alba). 111e overall goal is to detem1ine if spiral grain growth is a reasonable indicator of h·ee age. Methods that were tested included the use of a 12 mm increment borer …

Hydrologic And Geochemical Cycling Within Karst Versus Non-Karst Basins Within The Interior Low Plateau Province Of South-Central Kentucky, David Ek

Masters Theses & Specialist Projects

This thesis summarizes my research in which I investigated differences and characteristics in hydrologic, nutrient and geochemical cycling between karst versus nonkarst basins within the Interior Low Plateau Province. Field data including stream discharge, evapotranspiration, and dissolved major ion concentrations were collected for a period of one year for two basins within Mammoth Cave National Park. Twelve percent carbonate rocks underlie one basin, while the other consists of 48 percent carbonate rocks. The carbonate rock exposures within both basins exhibit karstification. The hydrologic and geochemical differences between these basins were compared to determine to what extent that cycles are modified …

Design work from the 2004 fall semester, Studio Martin Price, School of Architecture, The University of Texas at Arlington. Art Center Expansion. Jenda Michl. The Art Center College of Design in Pasadena asked the studio to design an alternative solution for the expansion of their South Campus. The form of this project is based on lyrical lines of defined program and pedestrian roofscape which grow like branches of a tree from the existing Raymond Building, to form dormitories and street-front studios before intertwining with a depressed Glenarm Street to create a circulation node. Branches pivot to infill behind the existing …

Metal Fabrication Shop Owner Dies When Crushed By Falling Steel Plate, Kentucky Injury Prevention And Research Center

Fatality Case Reports--Other

On December 15, 2003, a metal fabrication shop owner died when a 4,000 pound steel base plate fell on him. While inside the shop building, the work crew of least three men, including the owner, fabricated a 10’x 20’ steel base plate to be used at a water treatment plant. The base plate was to house or serve as a bas anchor a large water pump. After welding connectors and channel iron beams to one side of the plate, the crew pushed the plate through a bay door with a forktruck to an outside area in back of the shop. …

The Crisis Of Public Transport In India: Overwhelming Needs But Limited Resources, John Pucher, Nisha Korattyswaroopam, Neenu Ittyerah Dec 2004

The Crisis Of Public Transport In India: Overwhelming Needs But Limited Resources, John Pucher, Nisha Korattyswaroopam, Neenu Ittyerah

Journal of Public Transportation

The rapid growth of India's urban population has put enormous strains on all transport systems. Burgeoning travel demand far exceeds the limited supply of transport infrastructure and services. Public transport, in particular, has been completely overwhelmed. Most bus and train services are overcrowded, undependable, slow, inconvenient uncoordinated, and dangerous. Moreover, the public ownership and operation of most public transport services has greatly reduced productivity and inflated costs. India's cities desperately need improved and expanded public transport service. Unfortunately, meager government financial assistance and the complete lack of any supportive policies, such as traffic priority for buses, place public transport in …

A Complete Conceptual Model For The Integrated Management Of The Transportation Work, Yannis Tyrinopoulos Dec 2004

A Complete Conceptual Model For The Integrated Management Of The Transportation Work, Yannis Tyrinopoulos

Journal of Public Transportation

Public transport faces a challenging period in which relevant operators invest in telematics systems in order to upgrade their internal operations and improve the services provided. Moreover; the public transport system has become quite dynamic during recent years, in the sense that the performance, effectiveness, and quality of its processes depend, to a large extent, on the factors affecting the vehicle's daily trans~ portation work. Under the Ph.D. program at the Aristotle University ofThessaJoniki, TeJematics Applications in Public Transport, the Jack of a complete management information model, that will effectively integrate traditionally static and dynamic public transport operations was identified. …

Appellate Conflicts In Local Government Law: The Disagreements Of A Decade, R. Perry Sentell Jr. Dec 2004

Appellate Conflicts In Local Government Law: The Disagreements Of A Decade, R. Perry Sentell Jr.

Mercer Law Review

In awesome solemnity, Chief Justice John Marshall thundered in 1803, "[i]t is emphatically the province and duty of the judicial department to say what the law is." Marshall's historic declaration has borne both lavish praise and unstinting criticism, and it serves as the commonly understood sentiment underlying the legal order of our country. At both federal and state levels, the "judicial department" rules our daily lives by virtue of saying "what the law is."

At the state level, constitutions and statutes typically establish a judicial branch of government and populate that branch with all manner of courts-local, trial, and appellate. …

Legal Ethics, Roy M. Sobelson Dec 2004

Legal Ethics, Roy M. Sobelson

Mercer Law Review

The biggest news in Georgia legal ethics this year actually made it into the general press when the Georgia Supreme Court approved a bar committee opinion confirming that real estate closings remained the exclusive province of licensed Georgia lawyers. With the Justice Department, the Federal Trade Commission, and consumer advocates all weighing in with contrary opinions, the court held firm against the inevitable, continuing criticism and cries of protectionism. Combined with the current debates over both multidisciplinary and multijurisdictional practices, it looks like the profession will continue to engage in heated debate in Georgia, if not worldwide, well into the …
