Protection Of Human Rights Under Kosovo's Criminal Code And Criminal Procedure Code, Rexhep Murati

Chicago-Kent Law Review

The Criminal Code and Criminal Procedural Code of Kosovo, together with other laws from the fields of criminal and procedural law, provide protection of human rights to all of Kosovo's citizens based on the most advanced international standards of human rights. The Criminal Code of Kosovo increases the number of human rights and freedoms that are protected by law. The most important human rights and freedoms that benefit from this protection are the right to life and security of the person; fundamental rights and freedoms; and the rights to honor, reputation, personal dignity, marriage, family, and health. Economic Integration As A Means For Promoting Regional Political Stability: Lessons From The European Union And Mercosur, Thomas Andrew O'Keefe

Chicago-Kent Law Review

The Article explores ways to ensure the future economic viability and the territorial integrity of Kosovo, whether as an independent state or as an entity with autonomous powers under the sovereignty of Serbia. The Article discusses the experiences of the European Union and MERCOSUR economic integration projects that have led to permanent peaceful relations among the participating countries, and contributed to overcoming historically bitter rivalries and conflicts. In examining the EU experience, the Article explores how supranational institutions coupled with the concept of subsidiarity have heightened regional autonomy within existing national states and made demands for secession both redundant and …

A Strategy For Renewing Franchise Negotiations In Kosovo, Matthew V. Topic Dec 2004

A Strategy For Renewing Franchise Negotiations In Kosovo, Matthew V. Topic

Chicago-Kent Law Review

A group of Kosovar entrepreneurs recently attempted to purchase a franchise of a U.S. business. While the presence of such a business would benefit Kosovar economic development, the Kosovar entrepreneurs were quickly denied by the U.S. company. It is unclear, however, whether U.S. trademarks are protected against unauthorized use in Kosovo, either under U.S. or Kosovar law, and it is possible that the entrepreneurs could use the franchise mark regardless of the rejection.

This Note explores the consequences of such unauthorized use. It examines both the uncertain nature of Kosovar trademark law and the nuances of extraterritorial application of the …

Take It Or Leave It: Monsanto V. Mcfarling, Bowers V. Baystate Technologies, And The Federal Circuit's Formalistic Approach To Contracts Of Adhesion, Christopher M. Kaiser Dec 2004

Take It Or Leave It: Monsanto V. Mcfarling, Bowers V. Baystate Technologies, And The Federal Circuit's Formalistic Approach To Contracts Of Adhesion, Christopher M. Kaiser

Chicago-Kent Law Review

The Federal Circuit has been widely criticized for unrelenting formalism. Perhaps because Congress charged the court with establishing national uniformity in areas of the law where uniformity was lacking, the Federal Circuit has often expressed a significant preference for bright-line rules. According to many critics, this preference has come at the expense of fairness. In two relatively recent decisions, the Federal Circuit has expanded its formalism into the area of contracts of adhesion, a topic it had not had the opportunity to consider before. This Note examines those two decisions, the formalistic approach taken by the Federal Circuit, and the …

The Dynamic Thermal Performance Of Construction Materials For Satisfactory Thermal Comfort In The Design Of A Terrace House In The Klang Valley, Malaysia / Mohammed Ali Abdul Hussain Al Obaidi, Abdul Hussain Al Obaidi Mohammed Ali

Student Works (2000-2009)

The design of residential buildings has a significant impact on the people's daily life. The "terrace house" form constitutes the majority of the residential building stock in Malaysia. The lack of thermal comfort in terrace houses, reported so far, is mainly due to the poor thermal properties of the building materials, and design factors. This research aims at studying the dynamic factors of (i) temperature variations (hourly) and (ii) thermal comfort in spaces of the terrace housing in Malaysia. The main objective of the research is to study the effect of design and construction variations, space usage patterns and climatic …

Electrical Charge Distribution Studies In Swnt, C60@Swnt, And Dwnt Structures., Jose E. Rivera 1961- Dec 2004

Electrical Charge Distribution Studies In Swnt, C60@Swnt, And Dwnt Structures., Jose E. Rivera 1961-

Electronic Theses and Dissertations

Single Walled Carbon Nanotubes (SWNTs), Double Walled Carbon nanotubes (DWNTs) and C60@SWNT (peapods) are three of well-ordered all-carbon nanostructures. Peapods are SWNTs filled with C60 fullerene peas. At high temperatues, C60 molecules coalesce into a long internal SWNT forming a DWNT. Charge transfer properties on SWNTs (both donor and acceptor type) have been studied intensively by various groups. Few groups have conducted such studies on peapods and DWNTs. In a recent study on Br2 doping of DWNTs using Raman spectroscopy, it has been found that the net charge primarily resides on the outer tube revealing molecular Faraday cage effect even …

The Analysis Of Missing Data In Public Use Survey Databases : A Survey Of Statistical Methods., Ping Xu 1975-

Electronic Theses and Dissertations

Missing data is very common in survey research. However, currently few guidelines exist with regard to the diagnosis and remedy to missing data in survey research. The goal of this thesis was to investigate properties and effects of three selected missing data techniques (listwise deletion, hot deck imputation, and multiple imputation) via a simulation study, and apply the three methods to address the missing race problem in a real data set extracted from teh National Hospital Discharge Survey. The results of this study showed that multiple imputation and hot deck imputation procedures provided more reliable parameter estimates than did listwise …

Psychosocial Antecedents Of Sex Offender Criminality And Violence., Sonia Marie Perry Mills 1965- Dec 2004

Psychosocial Antecedents Of Sex Offender Criminality And Violence., Sonia Marie Perry Mills 1965-

Electronic Theses and Dissertations

Sexual abuse and sexual violence perpetrated against women and children in the United States are social problems that need to be addressed. The United States is one of the most sexually violent societies in the world, having one of the highest rates of any industrialized country of rape and sexual violence (Stewart, 2002). Although any type of sexual victimization is problematic, sexual violence in particular can have particularly devastating effects for the victim. We urgently need to know why some adults sexually abuse and assault (Cannon, 2001). Examination of the psychosocial antecedents of sex offender criminality and violence will add …

Distributed Data Mining Using Web Services., Vivek Mongolu 1977-

Electronic Theses and Dissertations

With the increasing computational power and the decreasing cost of high bandwidth networks resulted in Distibuted Systems. Distributed Data Mining is being used to analyze and monitor data in distributed systems. In the past, distributed technologies like Java RMI, CORBA were used for data mining but the result was a more tightly coupled system. Using web services a loosely coupled, interoperable distributed computing framework can be built. The topic of this thesis is to investigate the use of web service in distributed data mining. This thesis involves the design, development and implementation of distributed data mining using web services as …

Louise C. Morel, The Louisville Women's City Club, And Municipal Housekeeping In Louisville, 1917-1935., Gail Elizabeth Chooljian Nall

Electronic Theses and Dissertations

Louise C. Morel was a leading social reformer in Louisville from 1917 through the early 1940s. Morel's work is a primary example of the continuation of Progressive Era ideals into the decades after the traditional end of the Progressive Era. Because the areas in which she worked were those that had traditionally appealed to and benefited women and children, Morel became known as a municipal housekeeper. With the help of fellow members of the Louisville Women's City Club, Morel conducted numerous surveys, organized conventions to educate the public, gave speeches, and urged city leaders to institute reforms in various areas. …

Approaching Dionysus : Challenges Of A Post-Modern Bacchae., Julie Dingman Evans

Electronic Theses and Dissertations

This thesis is a personal examination of the process of creating, developing and portraying the character of Dionysus in University of Louisville's 1996 production of Euripides' The Bacchae. It begins with an examination of my acting process prior to study at the University of Louisville and focuses on learned skills which enabled me to meet challenges that I faced coming into this role. The latter part of this thesis examines the effect of my process on the outcome of the performance of the role. The five chapters of this thesis cover my approach to acting from the start of my …

Some Social Considerations In The Female Portraits Of Palma Vecchio., Sarah Elizabeth Fruehling 1977-

Electronic Theses and Dissertations

This thesis is an investigation into the world of sixteenth-century Venice, encompassing a group of female portraits by artist Palma Vecchio. I utilized many primary and secondary sources concerning Renaissance society, including several which discussed the roles of women during the Renaissance. This thesis is divided into four chapters that discuss the purpose and evolution of the female portrait, ideal poetic beauty, and the authority the courtesan carried in both the poetry and the painting in Venice. Chapter one covers a short history of the portrait as well as an investigation of how the female portrait evolved from the profile …

Anomaly Based Intrusion Detection For Network Monitoring Using A Dynamic Honeypot., Jeff Hieb Dec 2004

Anomaly Based Intrusion Detection For Network Monitoring Using A Dynamic Honeypot., Jeff Hieb

Electronic Theses and Dissertations

This thesis proposes a network based intrusion detection approach using anomaly detection and achieving low configuration and maintenance costs. A honeypots is an emerging security tool that has several beneficial characteristics, one of which is that all traffic to it is anomalous. A dynamic honeypot reduces the configuration and maintenance costs of honeypot deployment. An anomaly based intrusion detection system with low configuration and maintenance costs can be constructed by simply observing the egress and ingress to a dynamic honeypot. This thesis explores the design and implementation of a dynamic honeypot using a variety of publicly available tools. The main …

Legislating The Family: Heterosexist Bias In Social Welfare Policy Frameworks, Amy Lind Dec 2004

Legislating The Family: Heterosexist Bias In Social Welfare Policy Frameworks, Amy Lind

The Journal of Sociology & Social Welfare

This article addresses the effects of heterosexist bias in social welfare policy frameworks on lesbian, gay, bisexual and transgender (LGBT) individuals and families in the United States. It discusses the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA), the Defense of Marriage Act (DOMA), federal definitions of family and household, and stereotypes about LGBT individuals. It argues that poor LGBT individuals and families lack full citizen rights and access to needed social services as a result of these explicit and implicit biases.

The Benefits Of Marriage Reconsidered, Barbara Wells, Maxine Baca Zinn Dec 2004

The Benefits Of Marriage Reconsidered, Barbara Wells, Maxine Baca Zinn

The Journal of Sociology & Social Welfare

This paper suggests that analyses of marriage experience take into account both structures of inequality and context. Although marriage is widely viewed as producing economic well-being and family stability, this analysis of a sample of White rural families finds the likelihood of realizing these benefits to be closely related to social class position. Marriage failed to produce these benefits for many working class and poor families. Although gains in economic self-sufficiency are viewed as an explanation for White women's perceived retreat from marriage, the limited opportunity structure for women in this rural place provides a context in which women continue …

Adoption In The U.S.: The Emergence Of A Social Movement, Frances A. Dellacava, Norma Kolko Phillips, Madeline H. Engel

The Journal of Sociology & Social Welfare

The Adoption Movement, which has been evolving in the U.S. since the late 1970s, is now fully formed. As a proactive, reformative social movement, adoption has reached the organizational, or institutional, stage. Evidence is seen in the roles assumed by government and voluntary agencies and organizations, as well as other systems in society, to support adoption, and in the extent to which adoption has been infused in the American culture, making it a part of our everyday landscape. Implications of the adoption movement for the helping professions are discussed, as is its impact on increasing cultural and racial diversity in …

Cleavage In American Attitudes Toward Social Welfare, William M. Epstein Dec 2004

Cleavage In American Attitudes Toward Social Welfare, William M. Epstein

The Journal of Sociology & Social Welfare

Opinion polls probing both the narrow and broad senses of social welfare among Americans indicate hardly any substantial differences over crucial social sentiments among a variety of groups with at least theoretically divergent interests: rich and poor, men and women, blacks and whites, a variety of ethnic groups, union and nonunion households. The items mainly concern the provision of welfare to the poor through AFDC, now TANF, and Food Stamps but also cover OASDHI. Consistently over more than sixty five years of systematic opinion polling, there is an astonishing consensus, so large in fact that it may undermine any effort …
