Natural Gas Delivery, Storage & Lng Pipeline Inspection Technologies Demonstration Report Jan 2004

Natural Gas Delivery, Storage & Lng Pipeline Inspection Technologies Demonstration Report

United States Department of Transportation: Publications

Assessing the integrity of natural gas transmission and distribution pipelines costs industry millions each year. With passage of the Pipeline Safety Improvement Act (PSIA) in 2002, industry will be required to invest significantly more capital to inspect and maintain their systems. The PSIA requires enhanced maintenance programs and continuing integrity inspection of all pipelines located within “high consequence areas” where a pipeline failure could threaten public safety, property and the environment. According to the Interstate Natural Gas Association of America (INGAA) the cost to industry to implement the PSIA in the first ten years will exceed $2 billion.

Navigating The Hidden Obstacles To Ex-Offender Reentry, Anthony C. Thompson Jan 2004

Navigating The Hidden Obstacles To Ex-Offender Reentry, Anthony C. Thompson

Faculty Articles

As federal and state correctional institutions steadily release record numbers of ex-offenders each year, the communities into which prisoners are released are unprepared to sustain the economic and social burden of the massive reentry movement. As a result, reentering ex-offenders lack the support needed to reintegrate themselves into society and to lead productive, law-abiding lives. This Article first explores political trends that account for the increase in incarceration rates over the last two decades and the resulting social, legal, and economic challenges of reentry both ex-offenders and their communities face. Only recently has the government begun to respond to these …

United States V. Kincade: Constitutionality Of Mandatory Dna Testing, Joy Huang Jan 2004

United States V. Kincade: Constitutionality Of Mandatory Dna Testing, Joy Huang

UC Law Constitutional Quarterly

In 2000, Congress passed the DNA Analysis Backlog Elimination Act ("DNA Act"), mandating DNA samples from certain types of felons to be included in the FBI's Combined DNA Index System ("CODIS"). Since its inception, the DNA Act has faced many constitutional challenges, most recently in the 9th Circuit with the case United States v. Kincade, which involved two successive Ninth Circuit cases. The first case was decided on October 2, 2003, wherein a three-judge panel controversially deemed the DNA Act unconstitutional. The decision was subsequently vacated and reheard by the Ninth Circuit sitting en banc, in which the Circuit Court …

A Tale Of Three Northern Manhattan Communities: Case Studies Of Political Empowerment In The Planning And Developing Process, Richard C. Bass, Cuz Potter

Fordham Urban Law Journal

This article reviews three development proposals in Northern Manhattan communities, how community boards responded to those proposals, and how the responses affected the outcome of each development. The article begins with a broad overview of the history of community boards' role in urban planning in New York City. It finds that boards have become increasingly influential in new development plans, empowering the communities they represent. The Article goes on to analyze three recent proposals in turn (an expansion of Columbia University in Morningside Heights, a residential development in Central Harlem, and a comprehensive rezoning of East Harlem) according to "zoning," …

Blighting The Way: Urban Renewal, Economic Development, And The Elusive Definition Of Blight, Colin Gordon Jan 2004

Blighting The Way: Urban Renewal, Economic Development, And The Elusive Definition Of Blight, Colin Gordon

Fordham Urban Law Journal

This article examines the way municipalities have used increasingly broad interpretations of "blight" to compete for state tax increment financing (TIFs) for economic development purposes. It traces the definition of blight in the context of state and federal urban redevelopment programs from the nineteenth century through the Progressive Era to the advent of TIF laws in the 1980s and 90s. It goes on to discuss the how the concept of "blight" has shifted from a condition of substandard housing to a condition of "sub-optimal" local economic development, in part due to intense competition among municipalities for TIFs. The article concludes …

Winter Count: Taking Stock Of Abortion Rights After Casey And Carhart, Caitlin E. Borgmann Jan 2004

Winter Count: Taking Stock Of Abortion Rights After Casey And Carhart, Caitlin E. Borgmann

Fordham Urban Law Journal

This article outlines the current landscape of the constitutional right to abortion established in Roe v. Wade. Analyzing the court's holdings in Planned Parenthood v. Casey and Stenberg v. Carhart, the author details the ways in which recognition of a government interest in potential life at any stage in a pregnancy, as well as the lofty "undue burden" standard in analyzing policies that hinder access to abortion, have eroded this right. Finally, the author stresses the Supreme Court cases' disparate impact on the abortion rights of low-income and rural dwelling women.

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reenty Into Criminal Defense Lawyering, Michael Pinard Jan 2004

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reenty Into Criminal Defense Lawyering, Michael Pinard

Fordham Urban Law Journal

Over the past two decades, public defender offices across the country have broadened the range of defense services provided to indigent clients. These expanded services, some of which involve representing clients on related non-criminal matters such as housing and public benefits, are included in what is now commonly referred to as "holistic representation."' This form of representation strives to encompass the various underlying issues that often lead to clients’ experiences with the criminal justice system, with the aim of addressing those circumstances and preventing future criminal involvement. Holistic representation signals a paradigmatic shift in defense philosophy and ideology and has …

The Project Safe Neighborhoods Household Survey (Psnhs): Part I: Psn — Alaska Program Evaluation Baseline Data, Brad A. Myrstol Jan 2004

The Project Safe Neighborhoods Household Survey (Psnhs): Part I: Psn — Alaska Program Evaluation Baseline Data, Brad A. Myrstol

Reports

This document reports on a March 2004 public survey of Anchorage residents about the Alaska Project Safe Neighborhoods (PSN) intitative and public safety concerns at the neighborhood level. A year and a half into Alaska's PSN initiative, Anchorage residents were more aware of the specific penalties under federal law for illegal possession of a firearm than the programmatic effects of local, state, and federal law enforcement officials to reduce the level of gun crime in the city. Relatively few respondents recognized either of the PSN slogans of the Hard Time for Gun Crime message disseminated by PSN. Anchorage residents do …

Defendant’S Brief — Federal Trade Commission Jan 2004

Defendant’S Brief — Federal Trade Commission

Richmond Journal of Law & Technology

Plaintiff/petitioner telemarketers brought these actions challenging the FTC’s and FCC’s joint implementation of a nationwide do-not-call registry. The FTC created the registry as part of its Telemarketing Sales Rule. The Rule prohibits tele- marketers and sellers from calling phone numbers that consumers have listed on the registry. Subsequently, the FCC amended its rules implementing the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, to prohibit persons from mak- ing telephone solicitations to residential telephone subscribers who have registered their telephone numbers on the registry. Since June 27, 2003, when the registry opened, consumers have registered more than 50 million …

Neighborhood, Crime, And Incarceration In New York City, Jeffery Fagan, Valerie West, Jan Holland Jan 2004

Neighborhood, Crime, And Incarceration In New York City, Jeffery Fagan, Valerie West, Jan Holland

Faculty Scholarship

Several new studies suggest that social and spatial incarceration of young males has become part of the developmental ecology of adolescence in the nation's poorest neighborhoods. This concentration began in the 1970s, and has grown steadily through the last quarter century. The story of young men such as Cesar in Random Family illustrates the pervasive effects of both direct and vicarious prison experiences for young men and women in poor neighborhoods. Studies of street life such as Random Family, Code of the Streets, and American Project show how these experiences are now internalized in the social and psychological fabric of neighborhood …

The Right Fight, Daniel C. Richman Jan 2004

The Right Fight, Daniel C. Richman

Faculty Scholarship

Since September 11, two large questions have dominated the discussions of how to prevent terrorist attacks on American soil. First, how do we ensure that the government has the authority it needs to gather, share, and use information about potential terrorist activities? Second, how do we ensure that this authority is not abused? The first question evokes images of"connecting dots" and "eliminating stovepipes." The second raises issues about democratic accountability and the proper balance between individual liberties and national security.
