Nietzsche had very little to say about law and what he did say is fragmentary and sporadic. Nietzsche's philosophy, however, offers a basis for theorizing about law. I use Nietzsche's important works to interpret two major movements in legal thought. The first part of the paper examines how Nietzsche's philosophy augments our understanding of deontological theories about the law. Nietzsche produced a substantial ethical theory. The second part of the paper examines how Nietzsche's philosophy helps us to understand law and economics. For more than two decades, some of the most respected scholars in the field of dispute resolution have questioned the apparently intrinsic bias of litigation against cooperative, problem-solving outcomes for clients. Disputes between physicians and patients over medical care have tended toward resolution in both the courts and ethics committees, with each of these bodies ultimately deciding that the informed, competent patient must be the final decision maker. Parents, too, have the authority to make medical decisions for their children, but these decisions can be challenged if physicians do not believe they are medically reasonable. One bioethical issue, however, is as intractable today as it was 30 years ago, when it began to be publicly discussed: the extent of parental authority to refuse life-sustaining medical treatment for an extremely premature infant. …

Negotiating Gender And (Free And Equal) Citizenship: The Place Of Associations, Linda C. Mcclain

This article focuses on the place of associations within John Rawls's political liberalism and in feminist liberalism. It revisits crucial components of political liberalism in light of feminist criticisms, such as those of Susan Moller Okin and Martha Nussbaum, that political liberalism's protection of associational life hinders women's free and equal citizenship. Offering a different reading of Rawls, it finds greater potential to draw on political liberalism to support such citizenship. It then brings liberal feminist ideas about the place of associations into dialogue with recent feminist work on gender, rights, and culture calling for models of rights within culture …

This article explores the various presumptions and arguments of Canadian courts in largely denying queer children a legal presence. An analysis of the intersection of homosexuality and children is explored with a view to arguing that legally, queer children deserve a voice. The author begins by outlining the development of the legal conceptualization of the "child". This conceptualization led to the notion of the child as innocent, and thus in need of protection. In comparison, homosexuals came to be characterized as "aberrant" and "predatory". Protecting children from homosexuals then became a simple step of logic, which ultimately led to the …

Structural Levels Of Mental Illness Stigma And Discrimination, Patrick W. Corrigan, Fred E. Markowitz, Amy Watson

Most of the models that currently describe processes related to mental illness stigma are based on individual-level psychological paradigms. In this article, using a sociological paradigm, we apply the concepts of structural discrimination to broaden our understanding of stigmatizing processes directed at people with mental illness. Structural, or institutional, discrimination includes the policies of private and governmental institutions that intentionally restrict the opportunities of people with mental illness. It also includes major institutions' policies that are not intended to discriminate but whose consequences nevertheless hinder the options of people with mental illness. Studies show that employee emotional displays impact customer behaviors and attitudes (Grandey, Fisk, Mattila, & Sideman, 2002; Pugh, 2001; Tsai, 2001). However, the factors influencing employees' emotional displays have not received much attention. More specifically, research suggests a need to more fully understand the motivational processes underlying employees' emotional displays, particularly in customer service where positive emotional displays are related to customer behaviors and sales performance (Brown & Sulzer-Azaroff, 1994; Diefendorff & Gosserand, in press; Grandey, Fisk, Matilla, & Sideman, 2002; Pugh, 2001; Tsai, 2001). Assessing The Identity Of Black Indians In Louisiana: A Quantitative And Qualitative Analysis, Francis J. Powell

This study shows the existence of Black Indians in Louisiana and investigates whether differences exist between Black Indians who are members of officially recognized tribes and those who do not have any type of recognition. The study examined if a relationship exist between tribal recognition and ethnic identity, subjective well-being, and social support. A cross-sectional survey design was used. Semi-structured interviews were conducted to obtain qualitative data. The sample consisted of 60 participants. 30 were from recognized tribal groups and 30 were from non-recognized tribal communities. This thesis explores therapeutic garden design and its role in landscape architecture. It also conducts a post occupancy evaluation (POE) for an existing therapeutic landscape. The St. Michael Health Care Center campus, Texarkana, Texas, is a Sisters of Charity institution and was designed and built in 1994 as a healing environment for patients, staff, and visitors. In this thesis, A POE was conducted to determine (1) user-perceptions and utilization of the campus, (2) whether the campus reduces stress and fosters restoration, and (3) any barriers or constraints to use of the campus. The usual assessment instruments for the diagnosis of dementia are often difficult to use among individuals with mental retardation. This study investigates whether a modified method based on Visser et al. (1997) can identify a dementing process. Ninety individuals diagnosed with severe and profound mental retardation were studied. One half of the participants were diagnosed with Down's syndrome. The participants were equally assigned to one of three groups based on perceived risk of dementia. A differential prevalence design was used. Both cross sectional and longitudinal analyses were utilized in this study. Results indicate that the Visser et al. (1997) method …

The purpose of this study was to identify elements present in effective literacy instruction, i.e., those elements that fostered reading, speaking, listening, thinking, writing, and metacognitive skills. By examining variables that promoted literacy acquisition and achievement, a detailed account resulted which described classroom practice as related to teacher beliefs, strategies, materials, and classroom climate. The primary method of qualitative analysis used for this study was the Developmental Research Sequence (DRS) Method (Spradley, 1980). Two classrooms with exemplary teachers were studied extensively. This article argues that better understanding of metaphor's cognitive role can help lawyers shape judicial decision-making. As a way of exploring metaphor's contribution to shaping the law, the article focuses on how a particular lawsuit was influenced by metaphor, in particular, by the primary metaphor that a corporation is a person within the more complex metaphorical system suggested by the marketplace of ideas model for First Amendment protection. The purpose of this study was to determine the written language skills of middle and high school students who were attending alternative programs in Southern California. The participants of this study were 114 students who were identified and served under Delinquency Prevention Program (DPP) and 83 students who were identified and served under Court Ordered Probation (COP). The Test of Written Language -3 (TOWL-3) (Hammill & Larsen, 1996) was administered to the participants in order to obtain written language measures. Individuals with intellectual disabilities have been linked to higher incidences of a variety of mental illnesses when compared to the general population (Rutter, Tizard, Yule, Graham, & Whitmore, 1976; and Borthwick-Duffy, 1994). Because of the symptoms associated with mental retardation; such as limited social skills, delayed or minimal communication skills, and maladaptive behaviors, mental illness can be difficult to assess when combined with an intellectual disability (Sovner, 1986). The America intelligence community in 1950, unprepared to perform its missions, failed to provide adequate indications and warning to U.S. national leaders and to the Commander, Far East Command (FEC), about the North Korean invasion of South Korea and Red Chinese intervention in the Korean War. Post-World War II policies that reduced the size of the military, cut systems and training, and reorganized intelligence services are responsible for that failure. Training deficiencies meant that intelligence soldiers deployed to Korea without required skills. Previous research has documented an association between adolescents’ exposure to community violence and a range of mental health problems. However, some violence-exposed youth maintain high levels of adaptive behavior and exhibit good psychological functioning. Thus, it appears that protective and/or risk factors are involved in the community violence-psychological outcome relation, which mitigate the conditions under which community violence exposure leads to adverse adolescent outcome. Behaviors that are appropriate, inappropriate, or a combination of both can be linked together in a behavior chain. When the contingencies for one response change (e.g., reinforcement is withheld for the last response in the chain; the last response is reinforced even if it occurs without the other responses in the chain) or the environmental conditions change (e.g., access to the reinforcer is available independent of responding), the other responses in the chain may be affected.
