Minutes From Pragma, Juan M. Martinez Jan 2004

Minutes From Pragma, Juan M. Martinez

Electronic Theses and Dissertations

Minutes from Pragma is a collection of twelve pieces--a memoir, five short stories, and six short-shorts--exploring ways in which estranged characters may find refuge from chaos and entropy. These stories attempt to deal with bleakness and despair through playfulness and humor. In Enterprise Carolina: A Capsule Review, time has stopped, but somehow everyday life goes on as usual. In Errands, children work in razorblade factories. In Roadblock, the narrator lives with a relative who repeatedly sets his possessions on fire. The collection concentrates on hardship and alienation, but suggests ways in which characters may confront and endure hard times. Characters' …

Women's Experiences With Distance Education, Jane Elizabeth Moody Jan 2004

Women's Experiences With Distance Education, Jane Elizabeth Moody

Electronic Theses and Dissertations

This thesis examines issues that affect women in online learning, and discusses four women's particular experiences in the University of Central Florida's distance learning program. Online education involves aspects of support and communication that may affect women's learning experiences either positively or negatively. Distance learning may also allow women to pursue their education while still taking care of their families and outside work. In order to get a better idea of how distance learning impacts women, I discuss several studies that examine how distance learning affects women in particular. I identify three areas from this literature that seem to be …

Wrongly Bodied Two, Clarissa Sligh, Women's Studio Workshop, Special Collections, Fleet Library

Artists' Books

112 pages : illustrations, portraits. "Wrongly bodied two" relates the stories of Jake, a contemporary white male imprisoned in a woman's body as he transitions from female to male and Ellen Craft, a 19th century black woman who escapes slavery by passing as a white man. While photographing Jake's transition, Sligh becomes conscious of society's psychological response to the transgressive act of changing one's identity. Recalling Ellen Craft's journey to freedom, Sligh re-examines her own fears of crossing the forbidden boundaries of gender, race and class."--artist's webpage. Transforming Learning Into A Constructive Cognitive And Metacognitive, Haydee Cuevas Jan 2004

Transforming Learning Into A Constructive Cognitive And Metacognitive, Haydee Cuevas

Electronic Theses and Dissertations

This study explored the effectiveness of embedding a guided, learner-generated instructional strategy (query method), designed to support learners' cognitive and metacognitive processes, within the context of a computer-based complex task training environment (i.e., principles of flight in the aviation domain). The queries were presented as "stop and think" exercises in an open-ended question format that asked learners to generate either simple (low-level elaboration) or complex (high-level elaboration) sentences from a list of key training concepts. Results consistently highlighted the benefit of presenting participants with low-level elaboration queries, as compared to the no-query or high-level elaboration queries. In terms of post-training …

Applying The Transtheoretical Model Of Change To Consumer Debt Behavior, Jing Jian Xiao, Barbara M. Newman, Janice M. Prochaska, Berta Leon, Robert L. Bassett, Janet L. Johnson Jan 2004

Applying The Transtheoretical Model Of Change To Consumer Debt Behavior, Jing Jian Xiao, Barbara M. Newman, Janice M. Prochaska, Berta Leon, Robert L. Bassett, Janet L. Johnson

Human Development and Family Science Faculty Publications

The Transtheoretical Model of Change (TMM) provided the framework for developing a measure to assess readiness to get out of credit card debt with consumers who are having credit card debt troubles. Key constructs of TTM include stages of change, decisional balance, self-efficacy, and processes of change. The items for the measure were developed by qualitative interviews with experts in credit counseling and consumers with debt troubles. A survey was then completed with a reliability and validity of the measure. The results have potential for use by counseling practitioners, educators and researchers.

Professor Yale Kamisar: "Awesome", Harry T. Edwards Jan 2004

Professor Yale Kamisar: "Awesome", Harry T. Edwards

Michigan Law Review

Yale Kamisar arrived in Ann Arbor in the fall of 1965, just after I graduated from the University of Michigan Law School, so I never had him as a teacher. We were colleagues, however, for almost ten years during the 1970s when we were both members of the Michigan faculty. And we have remained good friends ever since. When the editors of the Michigan Law Review asked me if I would submit a "tribute" to Professor Kamisar commemorating his retirement from the faculty, I was happy to accept the invitation. Yale is one of my heroes in the academy - …

The Illusion Of Law: The Legitimating Schemas Of Modern Policy And Corporate Law, Ronald Chen, Jon Hanson Jan 2004

The Illusion Of Law: The Legitimating Schemas Of Modern Policy And Corporate Law, Ronald Chen, Jon Hanson

Michigan Law Review

This Article is about some of the schemas and scripts that form and define our lives. It is about the knowledge structures that shape how we view the world and how we understand the limitless information with which we are always confronted. This Article is also about the "evolution of ideas" underlying corporate law and all of modern policymaking. It is about the ways in which schemas and scripts have influenced how policy theorists, policymakers, lawyers, and many others (particularly in the West) understand and approach policymaking generally and corporate law specifically. It is about both the invisibility and blinding …

All Facts Are Not Created Equal, Bryan Adamson Jan 2004

All Facts Are Not Created Equal, Bryan Adamson

Faculty Articles

This article attempts to: 1) illustrate the inherent ambiguities of Rule 52(a), exacerbated by a court-created fact typology; 2) explain one of those types-the constitutional fact doctrine-and demonstrate how the Supreme Court has applied that doctrine inconsistently; and 3) explore whether the Sixth Circuit, by invoking the constitutional fact doctrine in Grutter, was attempting to extend the doctrine into the jurisprudence of Fourteenth Amendment intentional discrimination claims, or wrongfully appropriating the trial court's fact finding role.

Beyond Lane: Who Is Protected By The Americans With Disabilities Act, Who Should Be?, Russell Powell Jan 2004

Beyond Lane: Who Is Protected By The Americans With Disabilities Act, Who Should Be?, Russell Powell

Faculty Articles

This article reviews the state of disability law under the Americans with Disabilities Act ("ADA"), with particular attention paid to Lane and other recent Supreme Court cases. In Lane, the Court affirmed that Congress validly exercised its power when it made states subject to suits under the ADA, at least with regard to limitations on access to courts. While the decision addresses Title II of the ADA (restrictions on state discrimination), it does have broader implications for the Act as a whole. Lane reflects a significant shift in the ethical paradigm used by the court to decide ADA cases and …
