We Change The World By Doing Nothing, Suzanne Soohoo Jan 2004

We Change The World By Doing Nothing, Suzanne Soohoo

Education Faculty Articles and Research

"The focus of this essay is on what I refer to as 'bystander apathy.' Bystanderism is the response of people who observe something that demands intervention on their part, but they choose not to get involved. I write this piece to shed light on this issue for others as well as for my own self-reflection - to understand more deeply why some people act against abuses of power and others don't; why sometimes I act and sometimes I don't. What are the forces, both internal and external, that work to keep us all from speaking against and standing up to …

Shophouse: A Mixed Use Building Type, Tung Vy Tran Jan 2004

Shophouse: A Mixed Use Building Type, Tung Vy Tran

Master's Projects

For the last half of the century, it has been obvious that the most popular building type built in America is the single-family house. Effectively ingrained in many as the preferred habitat style, this building type is the main appeal in the idealized American dream of a suburban house with white picket fence. Architects, urban planners, designers. writers and even some citizens understand this dream is also the epitome of sprawl. Driven by capitalistic policies and the apathetic media that often encourage wasteful consumptions and wanton disregard for the environment, sprawl is undoubtedly a complex problem to solve. In city …

Iconoclasm And Iconophilia In Othello, Catherine E. Winiarski Jan 2004

Iconoclasm And Iconophilia In Othello, Catherine E. Winiarski

Quidditas

In his book War Against the Idols, Carlos Eire argues that iconoclastic resistance to the Medieval Catholic Church began with the gentle scolding of Erasmus and ended as the "shibboleth" of radical Calvinism. The use of images in religious instruction and practice was one of the major points of dispute between Protestant reformers and Catholic counter-reformers. Iconoclasm was certainly not confined to radical Calvinism; Anglican reformers, especially those who had spent time in continental Europe as exiles (like John Jewel, Bishop of Salisbury), quickly raised the issue in their country, which had its own unique history of religious reform. …

The Effect Of Testing Location And Task Complexity On Usability Testing Performance And User-Reported Stress Levels, Chris Andrzejczak Jan 2004

The Effect Of Testing Location And Task Complexity On Usability Testing Performance And User-Reported Stress Levels, Chris Andrzejczak

Master's Theses - Daytona Beach

Usability testing is becoming a more important part of the software design process. New methods allow remote usability testing to occur. Remote testing can be less costly and allow more data to be collected in less time in many cases, provided the user can still provide meaningful data. However, little is known about differences in the user experience between the two testing methods. In an effort to find differences in user experience between remote and traditional website usability testing, this study randomly assigned participants into two groups, one completing a usability test in a traditional lab setting, while the other …

The Biopsychosocial Model Of Medicine: Implications For The Future Of Healthcare, Abby M. Luensmann Jan 2004

The Biopsychosocial Model Of Medicine: Implications For The Future Of Healthcare, Abby M. Luensmann

Presidential Scholars Theses (1990 – 2006)

The science of medicine is changing at an incredible rate. New treatments, technologies, and biologically-based discoveries seem to occur almost daily. In fact, the health care business has evolved into the largest service industry in the United States, grossing more than $1 trillion annually (Taylor, 2003). Despite the obvious attention paid to health-related issues in this country, is our health care system actually providing American citizens with the most efficient and effective care treatments possible? Do current medical practices have the best interests of the American public in mind, or are outdated philosophies being used to treat illnesses and diseases …

Understanding Foreign Language Education At Bfsu, Zhou Yan Jan 2004

Understanding Foreign Language Education At Bfsu, Zhou Yan

Manusya, Journal of Humanities

The paper shows that the students at Beijing Foreign studies University (BFSU) are from various parts of the country with uneven exposure to and different training in English. They have to go through a period of adjustment: learning new materials, new ways of language learning as well as of unlearning certain learning habits gotten from their high schools. It is pointed out that language learning does not only mean mastering linguistic rules or structures but also understanding culture of the target language. In order to do this many things are required: motivation, willingness to do rote learning and monotonous drills …

A Case For Proof Making For Prospective Middle School Teachers, J. W. Whitenack, L. A. Lovin, L. Cavey

Journal of Mathematics and Science: Collaborative Explorations

In this article, we discuss how we, as mathematics teacher educators, might help our prospective middle school teachers develop a disposition toward mathematics that involves making sound arguments and, more generally, making proofs about mathematical ideas. First, we illustrate what we mean by making sound mathematical proofs. We then use this definition to characterize what ninety-two prospective middle school teachers consider to be proof making, based on a survey that we administered in their first mathematics course. Following our findings, we discuss how we, as teacher educators, might realign our instruction to provide opportunities for prospective teachers to develop new …

The Voice Of The Unheard: An Evaluation Of And Proposed Solution To The Special Educational Needs Of Hearing Children Of Deaf Parents, Julie Ruschin Jan 2004

The Voice Of The Unheard: An Evaluation Of And Proposed Solution To The Special Educational Needs Of Hearing Children Of Deaf Parents, Julie Ruschin

UC Law SF Journal on Gender and Justice

Spoken language acquisition depends on aural exposure to the language. A child must hear a language spoken. But more than this, the child must have the language directed at her in conversational context. Because spoken language acquisition requires something that may be beyond the capabilities of the State, and because language acquisition is an educational issue, the responsibility for providing a program to ensure that hearing children of deaf parents master spoken English rests on the State. The State should create programs to ensure that these children are properly exposed to spoken English during the brief period in life in …

Stoning Single Nigerian Mothers For Adultery: Applying Feminist Theory To An Analysis Of Gender Discrimination In International Law, Sarah Crutcher Jan 2004

Stoning Single Nigerian Mothers For Adultery: Applying Feminist Theory To An Analysis Of Gender Discrimination In International Law, Sarah Crutcher

UC Law SF Journal on Gender and Justice

In 2003, an Islamic Sharia court in northern Nigeria sentenced Amina Lawal to death by stoning for having sex outside of marriage. After the man Lawal named as the father of her baby was acquitted for lack of evidence, the international community pressured Nigeria to oppose the ruling by adhering to its own constitutional provisions, and international law prohibiting torture and gender discrimination. This article explores the fundamental conflicts between international human rights law and Islamic law as implemented by Sharia courts. The author cites the UN Charter, the Universal Declaration of Human Rights, jus cogens and customary international law, …

Consent Engendered: A Feminist Critique Of Consensual Fourth Amendment Searches, Dana Raigrodski Jan 2004

Consent Engendered: A Feminist Critique Of Consensual Fourth Amendment Searches, Dana Raigrodski

UC Law SF Journal on Gender and Justice

This essay examines the inherent power imbalances that characterize police-individual encounters and questions the notion of consensual searches. Albeit feminist challenges to the notion of consent in other areas of the law, there has not been a feminist scrutiny of consent and agency as employed within search and seizure law. Therefore, this essay builds on feminist critique of rape laws and domestic violence to challenge the Court's dichotomized view of coercion and consent in its search and seizure cases and to offer a feminist concept of agency under conditions of subordination.

Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz Jan 2004

Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz

UC Law SF Journal on Gender and Justice

"Lighting the Lantern: Visions of a Virtual All-Women's Law School" is a fictional narrative of a hypothetical all women's law school. It is written in non-traditional form in the hope that it will prompt the reader to view the law, academic institutions and societal constructs in ways more consistent with an evolving society that should embrace all differences, whether those differences are gender or racially based.

The mission of the All Women's Law School is threefold: "First, to teach specific lawyering skills and disseminate knowledge in a context designed to help students function effectively in the existing culture while working …

Sexually Violent Predator Laws: Psychiatry In Service To A Morally Dubious Enterprise, Eric S. Janus Jan 2004

Sexually Violent Predator Laws: Psychiatry In Service To A Morally Dubious Enterprise, Eric S. Janus

Faculty Scholarship

This article discusses the role of psychiatrists in determining the treatment of sexually violent predators (SVP). Instead of being released at the end of their prison sentences, sex offenders in the USA who are judged mentally disordered and dangerous are being confined in secure "treatment facilities" for indeterminate terms. This novel and aggressive legislative tactic—embodied in US sexually violent predator laws—commandeers the traditional power of state mental health systems and puts it in service to a core function of the criminal justice system: the control of sexual violence. This transposition of "civil commitment" has forced psychiatry to legitimate and arbitrate …

Counting The Dragon's Teeth And Claws: The Definition Of Hard Paternalism, Thaddeus Mason Pope Jan 2004

Counting The Dragon's Teeth And Claws: The Definition Of Hard Paternalism, Thaddeus Mason Pope

Faculty Scholarship

n his classic 1897 essay, The Path of the Law, Oliver Wendell Holmes Jr. warned against blind imitation of the past and called for "enlightened skepticism" toward the law. He described the first step of this critical examination as getting "the dragon out of his cave and on to the plain and in the daylight" so that "you can count his teeth and claws and see just what is his strength." Over the past thirty years, disagreements over the appropriate definition of "paternalism" have often masked further disputes over the circumstances under which the restriction of substantially autonomous self-regarding conduct …

Gollum, Meet Smeagol: A Schizophrenic Rumination On Mediator Values Beyond Self Determination And Neutrality, James Coben Jan 2004

Gollum, Meet Smeagol: A Schizophrenic Rumination On Mediator Values Beyond Self Determination And Neutrality, James Coben

Faculty Scholarship

The author asserts that the exclusive reliance on the "Two Towers" of self-determination and neutrality as the foundation for mediation practice has inevitably left us with a process routinely characterized by mediator manipulation and deception. The "tricks" are tolerated by sophisticated repeat players, and absent transparency in practice, disturbingly not known to others. The evolution of mediation, from empowerment/community roots to corporate/court sustenance, is no surprise given the nation's journey through the Reagan revolution, the ideology of free markets, and the Supreme Court's unbridled support for freedom to contract in disputing. In short, mediation is at a crossroads needing to …
