Who Is An Environmentalist? The Polysemy Of Environmentalist Terms And Correlated Environmental Actions, Danielle Tesch, Willett Kempton Jan 2004

Who Is An Environmentalist? The Polysemy Of Environmentalist Terms And Correlated Environmental Actions, Danielle Tesch, Willett Kempton

Journal of Ecological Anthropology

Conducting and interpreting an interview is more problematic when informants use a word that has multiple meanings and interpretations. In this case, the problematic word, “environmentalist,” labeled several socially-defined identities that were central to the study. The analysis is based on interviews with 156 members of 20 diverse environmental groups (and two comparison groups) in the Eastern United States, including their views on environmentalists, their history with the movement, their self-identification as an environmentalist, and their environmental actions. From these data, principles of classification and naming are used to distinguish the multiple meanings of the identity “environmentalist.” We found that …

Walter J. Ong, S.J.: A Retrospective, Paul A. Soukup

Communication

Communication Research Trends usually charts current communication research, introducing its readers to recent developments across the range of inquiry into communication. This issue, however, takes a different tack, looking back on the writings of Walter J. Ong, S.J., who died at the age of 90 in August 2003. Ong spent his scholarly career at Saint Louis University, where he served as University Professor of Humanities, the William E. Haren Professor of English, and Professor of Humanities in Psychiatry at the Saint Louis University School of Medicine. In a career that spanned 60 years, Ong published 16 books, 245 articles, and …

From Death Notification Through The Funeral: Bereaved Parents’ Experiences And Their Advice To Professionals, Linda Janzen, Susan Cadell, Anne Westhues Jan 2004

From Death Notification Through The Funeral: Bereaved Parents’ Experiences And Their Advice To Professionals, Linda Janzen, Susan Cadell, Anne Westhues

Lyle S. Hallman Social Work Faculty Publications

Parents who experience the sudden death of a child will interact with many professionals in the period immediately following the death notification through to the funeral. The way these professionals respond to the parents during this critical period may be perceived as helpful, and thus support them in beginning the process of managing the trauma and starting a healthy grieving process. It may also be perceived as unhelpful, though, and contribute to more prolonged and complicated grieving. This article identifies the interventions that a sample of 20 parents who had experienced the sudden death of a child found helpful with …

Skepticism And Freedom: The Intellectual Foundations Of Our Constitutional Order, Richard A. Epstein Jan 2004

Skepticism And Freedom: The Intellectual Foundations Of Our Constitutional Order, Richard A. Epstein

Faculty Articles

It is my great pleasure to have been invited by the Templeton Foundation to give this lecture dedicated to the articulation of the sound principles of constitutional law. Understanding the role of constitutional theory has become one of the most contentious problems of our times, as partisans on both sides of the political aisle seek to gain the rhetorical advantage in short-term political disputes by hurling epithets-which often relate to the question of judicial restraint- against the judicial nominees and judicial philosophy of the other side. I have no personal or political stake in the outcome of these disputes. But …

Innovation In Boilerplate Contracts: An Empirical Examination Of Sovereign Bonds, Stephen J. Choi, G. Mitu Gulati Jan 2004

Innovation In Boilerplate Contracts: An Empirical Examination Of Sovereign Bonds, Stephen J. Choi, G. Mitu Gulati

Faculty Articles

Network externalities may lead contracting parties to stay wiht a "standardized" term despite preferences for another term. Using a dataset of sovereign bond offerings from 1995 to early 2004, we test the importance of standardization for the modification provisions relating to payment terms. We provide evidence that (1) standardization may lead parties to adopt provisions not necessarily out of preference and (2) standards, nonetheless, may change. The process of change, however, is not necessarily quick or straightforward. In the sovereign bond context, change came by way of an "interpretive shock." Contracts with modification provisions requiring the unanimous consent of bondholders …

In Defense Of The "Old" Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein Jan 2004

In Defense Of The "Old" Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein

Faculty Articles

The traditional forms of public health law were directed largely toward communicable diseases and other externalities, such as pollution, with negative health impacts. The more modern view treats any health issue as one of public health so long as it affects large numbers of individuals, and this definition includes such matters as obesity and diabetes. This paper examines the historical and constitutional evolution of the public health principle as it moved from the narrower to the broader conception. It then argues that the narrower principle better defines the appropriate scope of coercive government intervention than the broader definition, which could …

The Semiotic Analysis Of Trademark Law, Barton C. Beebe Jan 2004

The Semiotic Analysis Of Trademark Law, Barton C. Beebe

Faculty Articles

Current thinking about trademark law is dominated by economic analysis, which views the law as a system of rules designed to promote informational efficiencies. Yet the economic analysis has failed to explain, because it is unequipped to do so, a number of concepts of fundamental importance in the law, most notably the concepts of trademark "distinctiveness" and trademark "dilution." This article proposes that a more robust understanding of trademark law may be achieved by viewing the law through the lens of semiotics, a systems-theoretical field of knowledge, of which structural linguistics forms a part, dedicated to the study of signs …

Fee -Based Online Services : Exploring Consumers’ Willingness To Pay, L. Richard Ye, Yue Zhang, Dat-Dao Nguyen, James Chiu Jan 2004

Fee -Based Online Services : Exploring Consumers’ Willingness To Pay, L. Richard Ye, Yue Zhang, Dat-Dao Nguyen, James Chiu

Journal of International Technology and Information Management

Many online service businesses are beginning to charge fees for services that they used to provide for free. It is unclear whether consumers are ready to embrace this practice. This study explores consumer attitudes toward fee-based online services. The results of the study indicate that consumers’ willingness to pay for online services is likely to be influenced by their perceived value of convenience these services provide, and by the extent to which they utilize these services. While consumers appear more willing to pay for services that are qualitatively better than free services, there is also indication that the belief remains …

All For One And One For All: Designing Web-Based Courses For Students Based Upon Individual Learning Styles, Michael K. Barbour, Morris Cooze Jan 2004

All For One And One For All: Designing Web-Based Courses For Students Based Upon Individual Learning Styles, Michael K. Barbour, Morris Cooze

Education Faculty Publications

As e-learning begins to proliferate into secondary schools and is opened up to learners of all abilities, it is important that the effects different learning styles have upon how online instruction is provided are taken into consideration. In this study, students from a secondary-level business education class completed a learning styles inventory to determine their strengths in the traditional learning styles and in Gardner’s intelligences. A variety of web-based instructional methods were utilized throughout the school year and the students’ overall performance in the course was monitored.

Sustainable Development Scenarios For The Richard B. Russell Parkway, Jesse Fountain, Judith R. Wasserman, Jamie Baker Roskie

Land Use Clinic

For many years local elected officials, the state legislative delegation, and community leaders worked diligently to get Richard Russell Parkway extended to Interstate 75 and provide the Warner Robins area with a second interchange to serve the City and Robins AFB. The project became a reality in the spring of 2002 when the Georgia Department of Transportation awarded a construction contract for the Parkway's extension. During the spring of 2003, with construction work progressing toward an October 31, 2004, completion date, the Mayor and City Council decided to explore alternative development concepts for the Parkway.

The goal of this document …

Inclusive Equality And New Forms Of Social Governance, Colleen Sheppard Jan 2004

Inclusive Equality And New Forms Of Social Governance, Colleen Sheppard

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Uncertainty persists regarding the meaning and application of the constitutional right of substantive equality, due in part to the focus on assessing the very nebulous and open-ended concept of human dignity. After reviewing two recent equality rights cases that illustrate the continued unpredictability of outcomes, the author examines constitutional equality from a more macro-historical perspective. In particular, she highlights how conceptions of constitutional equality are integrally connected to changing understandings of the role of the state. Tracing the shift from formal to substantive equality, she suggests that the current formulation of substantive equality resonates best with the ideological and governance …
