Three Essays On The Relationship Between Labor Disputes And Employee Performance: Dissertation Summary, Alexandre Mas
Three Essays On The Relationship Between Labor Disputes And Employee Performance: Dissertation Summary, Alexandre Mas

Industrial relations events such as strikes, slowdowns, or work stoppages can have important economic consequences for firms. These episodes may impact firm-level measures of productivity and output, especially if workers refrain from producing. In cases where output is contractible, adverse conditions of employment may induce workers to lower effort in other dimensions of production, for example, through diminishing the quality of the product. However, a relationship between worker treatment and the quality of production has proved difficult to establish. Since quality is often unobserved or hard to measure, little is known about the impact of adverse labor relations on workers' …

Ending Social Work's Grudge Match: Problems Versus Strengths, J. Curtis Mcmillen, Lisa A. Morris Phd, Michael Sherraden

Some in social work have called for a paradigm shift away from a focus on problems to a focus on strengths, empowerment, and capacity building. This call sets up an unnatural dichotomy, asking social workers to identify with one side or another. In this article, we review social work history to argue that the best social work practice has always maintained a dual focus on both problems and capacity building. Throughout our history, those who championed a problem-oriented practice also emphasized strengths and growing client capacity, and today's strength-based, capacity-oriented practitioners typically advocate for the solving of consumer's presenting problems.

Life Without Gpr7, The Neuropeptide W1 Receptor: Regulation Of Energy Homeostasis By Gpr7 And Its Endogenous Neuropeptide Ligands, Makoto Ishii
Student Theses and Dissertations
Classic lesion experiments from the 1940s have established the hypothalamus as playing an essential role in controlling energy homeostasis. Gold-thioglucose (GTG) induces lesions in the ventromedial nucleus of the hypothalamus (VMH) resulting in hyperphagia and obesity. To identify genes involved in the hypothalamic regulation of energy homeostasis, we employed a screen to search for genes that were dysregulated in GTG induced obese mice. In this screen, GPR7, the endogenous G protein-coupled receptor (GPCR) for the recently identified ligands neuropeptide B (NPB) and neuropeptide W (NPW), was found to be specifically down-regulated after GTG treatment. The physiological role of GPR7 was …
Too Little, Too Late: Ineffective Assistance Of Counsel, The Duty To Investigate, And Pretrial Discovery In Criminal Cases, Jenny Roberts
Too Little, Too Late: Ineffective Assistance Of Counsel, The Duty To Investigate, And Pretrial Discovery In Criminal Cases, Jenny Roberts
Fordham Urban Law Journal
Unlike rules governing discovery in civil cases, which require that the two sides exchange most information about their respective cases, criminal discovery result in a much more limited flow of information. Many commentators, for many years, have called for the liberalization of criminal discovery statutes and rules. Indeed, some states have heeded the call. But about a dozen states follow the highly restrictive federal rule, which is premised in part on the idea that a defendant should not be entitled to witness names or statements for pretrial investigation, but rather only for cross-examination purposes should the case ever get to …

Judge Thomas J. Spargo serves as a fascinating poster-child in the debate on what’s wrong (or right) with judicial elections. Judge Spargo, campaigning for re-election as Justice of the Berne Town Court in upstate New York, was accused of “failing to observe the high standards of conduct” expected as a judge because he handed out doughnuts to voters. Judge Spargo’s case and others illustrate that popular debates about the merits of judicial elections versus judicial selection commissions have probably been mis-focused on two “second-order questions rather than concentrating on “first-order” concerns in judicial selection. This article discusses these questions and …

Learning From Practice: What Adr Needs From A Theory Of Justice, Kate Kruse

Adding to the impressive body of work that has made her a leading voice in the fields of both alternative dispute resolution and professional responsibility, Carrie Menkel-Meadow's Saltman Lecture connects the theoretical exploration currently occurring on two parallel tracks: (1) theories of justice that investigate the ideal of a deliberative democracy; and (2) theories of alternative dispute resolution arising from its reflective practice. As she notes, theorists on both tracks are grappling with similar questions about the processes or conditions that will best bring together parties with widely divergent viewpoints to consensus-building dialogue around contested issues.
While Menkel-Meadow focuses on …

The “Who,“ “What,” “Where” And “How” Of The “Down Low”: A Personally‐Inspired Book Review Of Keith Boykin’S Beyond The Down Low: Sex, Lies And Denial In Black America, William H. Alexander
Trotter Review
In this review of Keith Boykin’s book on the Down Low, William H. Alexander draws generously from his own personal experience. According to Alexander, Boykin’s book is a wake up call and challenge to the Black community to stop wasting their time blaming and developing strategies that reject, exclude and oppress, but instead focus on their spirituality and humanity so that lives can be saved.
Homosexual And Racial Identity Conflicts And Depression Among African‐American Gay Males, William H. Alexander
Homosexual And Racial Identity Conflicts And Depression Among African‐American Gay Males, William H. Alexander
Trotter Review
What does it mean to be male, Black and homosexual in the United States? In this study of 191 such men, William H. Alexander examines whether racial identity conflict and homosexual identity conflict contribute to depression in Black gay men. Alexander reports that being Black, a Black male, and a homosexual puts one in a vulnerable position that requires that he cope with a variety of stereotypes from every society with which he interacts. This pressure contributes to depression in this population.

Families And The Moral Economy Of Incarceration, Donald Braman
Families And The Moral Economy Of Incarceration, Donald Braman
GW Law Faculty Publications & Other Works
This chapter examines the moral economy of incarceration from the perspective of one family. Derrick and Londa's story, neither one of flagrant injustice nor triumph against the odds, shows a family facing addiction, the criminal justice system's response to it, and the mixture of hardship and relief that incarceration brings to many families of drug offenders. Stories like theirs are almost entirely absent from current debates over incarceration rates and accountability. Indeed, the historical lack of the familial and community perspective of those most affected by incarceration can help to explain the willingness of states to accept mass-incarceration as a …

Beyond Retribution And Impunity: Responding To War Crimes Of Sexual Violence, Naomi R. Cahn
GW Law Faculty Publications & Other Works
Beyond Retribution and Impunity: Responding to War Crimes of Sexual Violence articulates principles for an approach to gender-based violence during conflict and post-conflict that operates within three different meanings of justice: criminal/civil justice, restorative justice, and what I define as social services justice. The article argues that responses to sexual violence must integrate legal and nonlegal, national, international, and local approaches, and must respond to both short and longer-term needs. It focuses on victims of sexual violence in the Democratic Republic of the Congo during what has been called the First World War in Africa, which occurred from 1996-2003.

Understanding the biological roots of intimate behavior is a complex undertaking that involves the integration of evolutionary biology, evolutionary psychology, neuroscience, anthropology and sociology. Evolutionary biology describes theories that explain the persistence of certain types of behavior in terms of presumed evolutionary pressures or advantages, focusing on the human mind. Evolutionary biologists assume that behavior that maximizes the presence of associated genes in the next generation is the behavior most likely to persist. In this paper, we take the growing insights that arise from the study of the biology of attachment to frame the emerging policy choices underlying the governance …

Clark’S Nutcrackers (Nucifraga Columbiana) And The Effects Of Goal-Landmark Distance On Overshadowing, Aleida J. Goodyear, Alan Kamil
Papers in Behavior in Biological Sciences
Three groups of Clark’s nutcrackers (Nucifraga columbiana) were trained to find a goal location defined by an array of 4 landmarks that varied in goal–landmark distance. The arrays for each group differed in the distance of the closest landmark and contained goal–landmark distances that were common across groups, allowing for the examination of the effects of both relative and absolute goal–landmark distance on encoding of a landmark array. All 3 groups readily learned the task and were subsequently tested in probe tests with only single landmarks from the array available. Search error in tests with single landmarks was …
The Geometry Of Foraging Patterns: Components Of Thoroughness In Random Searching, Alan B. Bond
The Geometry Of Foraging Patterns: Components Of Thoroughness In Random Searching, Alan B. Bond
Papers in Behavior in Biological Sciences
A Monte Carlo simulation of the movements of a randomly-searching predator was used to develop a novel geometrical measure, the "thoroughness" of the search, and to investigate the effects of meander, turn asymmetry, and path length. Thoroughness varied directly with the meander and the square of the asymmetry measure and remained relatively invariant with path length. The regularity of its relationship to the generating parameters of the search and the ease with which it may be estimated from field data recommend thoroughness for use in characterizing empirical search patterns and in testing for the occurrence of systematic searching.
The Case Against Copyright: A Comparative Institutional Analysis Of Intellectual Property Regimes, F. Scott Kieff
The Case Against Copyright: A Comparative Institutional Analysis Of Intellectual Property Regimes, F. Scott Kieff
GW Law Faculty Publications & Other Works
Contemporary debates over intellectual property ("IP") generally evidence positions that appear to line up at opposite ends of the same axis, with one side arguing for more rights for IP owners under each major regime - patent, trademark, and copyright - and the other side arguing for fewer. Approaching from what some may see as a "more" IP view, this paper offers the counterintuitive suggestion to consider abolishing one of these IP regimes - copyright, at least with respect to the entertainment industry, which represents one of that regime's most commercially significant users. This realization is in fact consistent with …
Civic Renewal And The Regulation Of Non-Profits, Miriam Galston
Civic Renewal And The Regulation Of Non-Profits, Miriam Galston
GW Law Faculty Publications & Other Works
Civic Renewal and the Regulation of Non-profits analyzes four understandings of civic renewal, elaborated in the wake of Robert Putnam's book Bowling Alone, in light of the federal regulatory scheme imposed upon voluntary associations that qualify as "exempt organizations" under the Internal Revenue Code. These perspectives emphasize the primacy of one or more of the following as indispensable elements of civic health: (1) cooperation and effective collective action, (2) self-governance (3) equality and representative institutions, and (4) the moral character of the community or the public spiritedness of citizens. The study analyzes how the different assumptions and purposes of these …

GW Law Faculty Publications & Other Works
This is the complete text of Daniel J. Solove's book, THE DIGITAL PERSON: TECHNOLOGY AND PRIVACY IN THE INFORMATION AGE (Full Text) (NYU Press 2004) explores the social, political, and legal implications of the collection and use of personal information in computer databases. In the Information Age, our lives are documented in digital dossiers maintained by hundreds (perhaps thousands) of businesses and government agencies. These dossiers are composed of bits of our personal information, which when assembled together begin to paint a portrait of our personalities. The dossiers are increasingly used to make decisions about our lives - whether we …
A Delicate Task: Balancing The Rights Of Children And Mothers In Parental Termination Proceedings, Catherine J. Ross
A Delicate Task: Balancing The Rights Of Children And Mothers In Parental Termination Proceedings, Catherine J. Ross
GW Law Faculty Publications & Other Works
This article considers the independent liberty interests of children in foster care and their mothers in parental termination proceedings. Federal reforms enacted in 1997 impose a mandatory deadline for the state to terminate parental rights. That policy erroneously presumes that the passage of time suffices to establish parental fault and satisfies a parent's due process rights to her child. The policy also fails to protect the minority of children in foster care who assert an interest in preserving a safe relationship with mothers who are unlikely to regain custody within the state's time frame - including many substance abusers, incarcerated …
