Two Powers’ And Early Jewish And Christian Monotheism, James F. Mcgrath, Jerry Truex Jan 2004

Two Powers’ And Early Jewish And Christian Monotheism, James F. Mcgrath, Jerry Truex

Scholarship and Professional Work - LAS

Our understanding of early Judaism and its relationship to Christianity has been significantly advanced by Alan Segal’s formative work on the two powers heresy. This work demonstrated that belief in two heavenly powers was considered an intolerable heresy by the rabbis and that Christians were among those indicted. Furthermore, Segal argued that the two powers debate could be traced back to the first century, as evidenced by certain christological passages of the NT4 and by Philo's writings.

Patients’ Perceptions Of Memory Functioning Before And After Surgical Intervention To Treat Medically Refractory Epilepsy., Tara T. Lineweaver, R. I. Naugle, A. M. Cafaro, W. Bingaman, H. O. Lüders

Scholarship and Professional Work - LAS

Purpose:One risk associated with epilepsy surgery is memory loss, but perhaps more important is how patients perceive changes in their memories. This longitudinal study evaluated changes in memory self-reports and investigated how self-reports relate to changes on objective memory measures in temporal or extratemporal epilepsy patients who underwent surgery.

Methods: Objective memory (Wechsler Memory Scale–Revised) and subjective memory self-reports (Memory Assessment Clinics Self-Rating Scale) were individually assessed for 136 patients ∼6 months before and 6 months after surgery. A measure of depressive affect (Beck Depression Inventory–2nd Edition) was used to control variance attributable to emotional distress.

Results: Despite a …

Appellate Courts, Historical Facts, And The Civil-Criminal Distinction, Chad M. Oldfather Jan 2004

Appellate Courts, Historical Facts, And The Civil-Criminal Distinction, Chad M. Oldfather

Faculty Publications

The standard justification for the general prohibition against the evaluation of facts by appellate courts centers on those courts' perceived incompetence, relative to trial-level fact finders, to engage in the task. This Article examines that justification and finds it wanting. While trial courts and juries are indeed better-positioned to assess much of what takes place at trial, this advantage is not universal. An appellate court's access to and reliance on a transcript of the proceedings below confers on it certain advantages not only because it aids in information retention, but also because its textual basis allows the court to perform …

Multiculturalism And The Future Of Tribal Sovereignty, Scott C. Idleman Jan 2004

Multiculturalism And The Future Of Tribal Sovereignty, Scott C. Idleman

Faculty Publications

American Indian tribes would appear to be natural constituents and beneficiaries of the multiculturalism movement. Their members are generally conceptualized as racial or ethnic minorities; they have endured social and legal oppression and continue to encounter structural and even intentional discrimination; and, not least importantly, they possess genuinely different cultures and consequently add diverse perspectives to society. Despite this apparent fit, this Article questions the extent to which tribes and tribal members actually should align themselves with multicultural proponents and initiatives. The basis for this inquiry is that, unlike other societal subgroups, each recognized tribe is a distinct geopolitical entity …

Sibling Relationships In Remarried Families, Monique C. Diderich Balsam Jan 2004

Sibling Relationships In Remarried Families, Monique C. Diderich Balsam

UNLV Retrospective Theses & Dissertations

This research project examines how different types of sibling relationships, that is, full siblings, half siblings and stepsiblings, develop within remarried families. The study focuses on three types of sibling solidarity: functional (i.e., instrumental help and assistance); associational (i.e., frequency of contact); and affectual (i.e., emotional closeness). The study further analyzes the effects of sibship size, proximity, birth order, marital status and age and gender on the three forms of solidarity, and relies on five middle range theories (attachment theory, family systems theory, rational choice, social comparison, and evolutionary theory). The study is based on participant observation in a Blended …

A Study Of Fidelity Level And Task/Non-Task Based Testing Scenarios On The Effectiveness Of Usability Testing, Joshua R. Dolecal Jan 2004

A Study Of Fidelity Level And Task/Non-Task Based Testing Scenarios On The Effectiveness Of Usability Testing, Joshua R. Dolecal

Master's Theses - Daytona Beach

Advances in usability are directing developers towards creating a better and all around friendlier environment for users. Unlike when buying a physical product where you purchase it first and then experience its usability, web site usability is immediately present. So, if a site doesn't meet our needs, we as users, are quick to look elsewhere. Some research has suggested that fidelity makes no significant impact on users' ability to locate errors or problems in a web site. This paper is intends to investigate the interaction between fidelity and task vs. non-task user testing with regards to the types of problems …

Cultural Nicknames: An Important Feature Of Galdós’ Art, Vernon A. Chamberlin Jan 2004

Cultural Nicknames: An Important Feature Of Galdós’ Art, Vernon A. Chamberlin

Decimonónica

Throughout his lifetime Galdós had a special fondness for and a creative interest in the use of nicknames. Gregorio Marañón, for example, says that until the end of his life, Don Benito delighted in using “apodos y motes [. . .] con que designaba constantemente a las personas de su trato, llenos [estos apodos] siempre de un hiperbólico gracejo” (71). We also know that Galdós and Concha-Ruth Morell, during the period of their intimacy, continually used a rich variety of nicknames not only to refer to each other, but also to other persons (Smith 91-120). Thus it is no surprise …

“My Reputación Precedes Me”: La Malinche And Palimpsests Of Sacrifice, Scapegoating, And Mestizaje In Xicoténcatl And Los Mártires Del Anáhuac, Lisa Nevárez

Decimonónica

The treachery of a woman, the violence of conquest, and the birth of the mestizo—these form the beginnings of Mexico’s history. Octavio Paz vocalizes the grito unique to Mexico, ¡Viva México, hijos de la Chingada!, and in so doing takes his place among the individuals salivating to blame La Malinche, also known as Marina or Malintzín, for her betrayal of her people by giving birth to Hernán Cortés’ child, the “first” mestizo and the ancestor of the modern Mexican.1 Examining the novels Xicoténcatl (1826), published anonymously, and Los mártires del Anáhuac (1870), by Eligio Ancona, facilitates a glimpse …

Gothic Larra, Rebecca Haidt Jan 2004

Gothic Larra, Rebecca Haidt

Decimonónica

Mariano José de Larra’s scathing review of Dumas’s Antony often is cited as evidence of his disapproval of the aesthetic excesses characteristic of Romantic productions.1 Comparatively few critics have remarked on Larra’s special disregard for the conventions of Romantic works we tend to classify as “Gothic”—texts and performances that expressly seek responses such as fear or horror.2 For example, he disdained Ducange’s El verdugo de Amsterdam particularly because (as he wrote in a review) that play makes audiences “llorar como haría llorar a cualquiera una paliza” (395), without appeal to an audience’s deeper moral and intellectual capacities. Though …

The University of Missouri (“MU”) sits in the picturesque college town of Columbia on the largest and oldest campus of the Missouri University system. MU is a land grant institution created with funds and land appropriated by the Morrill Acts of 1862 and 1890. The University “honors [that public trust] and accepts the associated accountability” by acquiring, creating, transmitting, and preserving knowledge. “MU's primary mission in research and doctoral education . . . provides the basis for service to the people of [Missouri] via outreach programs.” Domestic violence impacts MU's land grant influenced service mission. Its organizational departments, educational units, …

Sexual Ethics Training In Seminary: Preparing Students To Manage Feelings Of Sexual Attraction, Katheryn Rhoads Meek, Mark R. Mcminn, Todd Burnett, Chris Mazzarella, Vitaliy L. Voytenko

Faculty Publications - Doctor of Psychology (PsyD) Program

Sexual boundary violations by clergy have received heightened media attention in recent years with far reaching implications for the long-term well-being of the Church as an institution. While much has been written about the causes and implications of sexual misconduct by clergy, very little research has addressed preventative efforts. Prevention begins in graduate school or seminary. How do seminary alumni perceive the quality of their training in the areas of understanding and maintaining sexual health as well as in managing feelings of sexual attraction in professional contexts? In this survey, 585 alumni from 5 evangelical seminaries answered questions related to …

Research Training In Explicitly Christian Doctoral Programs, Peter C. Hill, Mark R. Mcminn

Faculty Publications - Doctor of Psychology (PsyD) Program

The importance of research training at explicitly Christian doctoral programs is suggested on the basis of four reasons: the need to hold science and practice together, the need for skills to evaluate interventions, the need to serve a society with a growing interest in religion and spirituality, and the need to assess the effectiveness of explicitly Christian doctoral programs. A discussion of these issues serves as an introduction to the rest of this special issue that focuses on research training at seven explicitly Christian programs.

When Congress Gives You Lemons: Alternatives To Legal Services Corporation Funding In The Quest To Provide Access To Justice, David Pai Jan 2004

When Congress Gives You Lemons: Alternatives To Legal Services Corporation Funding In The Quest To Provide Access To Justice, David Pai

UC Law Journal of Race and Economic Justice

Since 1996, Congress has imposed substantial restrictions on lawyers funded by the Legal Services Corporation (LSC). These restrictions include banning LSC-funded attorneys from filing class action lawsuits, prohibiting them from claiming any statutory right to attorneys' fees, and barring them from bringing any challenges to an agency's rule-making authority. Congress has also slashed the LSC budget by a third. However, alternative funding strategies do exist for states and public interest firms seeking to fill gaps gouged by the LSC restrictions. By focusing on these piecemeal changes in fundraising, legal aid attorneys inevitably empower themselves to move away from the inefficiencies …

Ethical Religion And The Struggle For Human Rights: The Case Of Martin Luther King, Jr., David A. J. Richards Jan 2004

Ethical Religion And The Struggle For Human Rights: The Case Of Martin Luther King, Jr., David A. J. Richards

Faculty Articles

My investigation here arises within a certain context, namely, my past work on political contractualism as the most plausible theory of American constitutional law and more recent interpretive work on the role that theory plays in explaining and understanding the impact on American constitutional law of various struggles for human rights (including not only the struggles of religious minorities, but movements for racial justice, as well as feminism and, most recently, the gay/lesbian movement). The appeal of contractualism, as a theory of American constitutional law, is the central place it accords basic human rights like conscience and speech and the …

Race To The Top Of The Corporate Ladder: What Minorities Do When They Get There, Devon W. Carbado, Mitu Gulati

Faculty Articles

Racing to the top of the corporate hierarchy is difficult, no matter how qualified or capable the candidate. Producing more widgets than one's competitors is not enough. Negotiating the political landscape of the institution is also required. More specifically, individual corporate officers have to be appeased, powerful interest groups have to be co-opted and made allies, and competitors have to be undermined or eliminated. The more bureaucratic the organization and the more opaque the promotion process, the more important this institutional game to climbing the corporate ladder. This Article identifies the kind of racial minorities or racial types who are …

Three Essays On The Relationship Between Labor Disputes And Employee Performance: Dissertation Summary, Alexandre Mas Jan 2004

Three Essays On The Relationship Between Labor Disputes And Employee Performance: Dissertation Summary, Alexandre Mas

Dissertation Awards

Industrial relations events such as strikes, slowdowns, or work stoppages can have important economic consequences for firms. These episodes may impact firm-level measures of productivity and output, especially if workers refrain from producing. In cases where output is contractible, adverse conditions of employment may induce workers to lower effort in other dimensions of production, for example, through diminishing the quality of the product. However, a relationship between worker treatment and the quality of production has proved difficult to establish. Since quality is often unobserved or hard to measure, little is known about the impact of adverse labor relations on workers' …
