Payday Lending And Personal Bankruptcy, Robert Mayer Jan 2004

Payday Lending And Personal Bankruptcy, Robert Mayer

Political Science: Faculty Publications and Other Works

Do payday loan customers form a growing share of bankruptcy petitioners, as many media reports claim? This paper attempts to answer that question and others by analyzing a sample of 3600 bankruptcy petitions filed in selected U.S. counties. From the petitions we can determine the share of debtors that files with payday loans; whether that proportion has been increasing in recent years; how these petitioners compare to other debtors; and whether payday loans are a significant factor in the financial crisis these debtors experience.

Normative Principles For Evaluating Free And Proprietary Software, Jonathan Zittrain Jan 2004

Normative Principles For Evaluating Free And Proprietary Software, Jonathan Zittrain

University of Chicago Law Review

The production of most mass-market software can be grouped roughly according to free and proprietary development models. These models differ greatly from one another, and their associated licenses tend to insist that new software inherit the characteristics of older software from which it may be derived. Thus the success of one model or another can become self-perpetuating, as older free software is incorporated into later free software and proprietary software is embedded within successive proprietary versions. The competition between the two models is fierce, and the battle between them is no longer simply confined to the market. Claims of improper …

Grain Size Distributions And Photoelectric Heating In Ionized Media, P. A. M. Vanhoof, J. C. Weingartner, P. G. Martin, K. Volk, Gary J. Ferland

Physics and Astronomy Faculty Publications

Ever since the pioneering study of Spitzer, it has been widely recognized that grains play an important role in the heating and cooling of photoionized environments. This includes the diffuse interstellar medium and H II regions, planetary nebulae and photodissociation regions. A detailed code is necessary to model grains in a photoionized medium since the interactions of grains with their environment include a host of microphysical processes. In this paper we will use the spectral synthesis code CLOUDY for this purpose. A comprehensive upgrade of the grain model has been recently incorporated into CLOUDY. One of these upgrades is the …

Aligning Or Maligning - Getting Inside A New Idea, Getting Behind No Child Left Behind And Getting Outside Of It All, Stephen A. Rosenbaum Jan 2004

Aligning Or Maligning - Getting Inside A New Idea, Getting Behind No Child Left Behind And Getting Outside Of It All, Stephen A. Rosenbaum

UC Law SF Journal on Gender and Justice

The pending reauthorization of the Individuals with Disabilities Education Act (IDEA) alters the landscape of special education for parents and advocates of children with special needs. The proposed modifications are based on an effort to reduce the bureaucracy associated with the current procedural safeguards and to incorporate the concept of accountability embodied in the No Child Left Behind Act. Many advocates are waiting with apprehension for the final version of the bill due to the philosophical changes that it will bring to special education federal law. This article gives an overview of the pending legislation and urges advocates to adapt …

UC Law SF Journal on Gender and Justice

Human Trafficking Private Right of Action: Civil Rights for Trafficked Persons in the United States addresses a 2003 addition to the Trafficking Victims Protection Act allowing for a private right of action for persons trafficked to the United States. The article discusses civil litigation as a strategy for trafficked persons to obtain a remedy that specifically addresses the injury that they sustained: enslavement. The discussion situates this remedy within the broader purposes of anti-trafficking legislation.

HIV and AIDS

This study is a collaborative research project of the University of Natal-Durban, the Horizons program, and Tulane University. One objective of the study was to contribute to understanding the effectiveness of life skills education in changing behavior in South Africa. The findings indicate substantial short-to-medium-term effects of exposure to life skills education on certain areas of sexual and reproductive health-related knowledge, confidence to use condoms, and condom use behavior. Further research is needed to assess whether the observed effects are transitory or long-term in nature, whether the observed behavioral changes have an impact on HIV infection rates among youth, and …

What's In A Name? Racial And Ethnic Classifications And The Meaning Of Hispanic/Latino In The United States, Keith M. Kilty, Maria Videl De Haymes

Ethnic Studies Review

The first national census was conducted in 1790, and has been repeated at ten year intervals ever since. While census taking has been consistent, the way individuals have been counted and categorized on the basis of race and ethnicity has varied over time. This paper examines how the official census definition of Latinos has changed over the twenty-two census periods. The modifications of the official definition of this group are discussed in relation to changes in national borders, variations in methodology used for census data gathering, and shifting political contexts.

Assessment Is Not A Four-Letter Word, Fred Smoller Jan 2004

Assessment Is Not A Four-Letter Word, Fred Smoller

Political Science Faculty Articles and Research

The past two decades has seen a rising tide of criticism of American universities. This criticism is expressed in national reports, voter initiatives, legislative reports, and by employers and accrediting agencies who have concluded that there is “a crisis of educational quality in our nation's colleges and universities” (Gardiner 1998, 71–88) and that “a disturbing and dangerous mismatch exists between what American society needs from higher education and what it is receiving” (Wingspread Group on Higher Education 1993). From such criticisms, the assessment movement was born (see, for example, Diamond 1998; Palomba and Banta 1999; Allen 2004).

Maxine Hong Kingston, Charles L. Crow Jan 2004

Maxine Hong Kingston, Charles L. Crow

Western Writers Series Digital Editions

“The history of the intermingling of human cultures is a history of trade—in objects like the narwhal’s tusk, in ideas, and in great narratives.”

—Barry Lopez, Arctic Dreams

The Woman Warrior (1976), Maxine Hong Kingston’s first book, made her famous. Her arrival coincided with, and helped to fuel, an awareness of literature by women and ethnic minorities, and a change in the literature studied in high-school and college classrooms. Today Kingston is one of the most frequently taught of living American authors. Her works are studied in courses in English, women’s studies, Asian studies, ethnic studies, postmodern literature, postcolonial literature, …

Sharing And Stealing, Jessica Litman Jan 2004

Sharing And Stealing, Jessica Litman

UC Law SF Communications and Entertainment Journal

The purpose of copyright is to encourage the creation and mass dissemination of a wide variety of works. Until recently, most means of mass dissemination required a significant capital investment. The lion's share of the economic proceeds of copyrights were therefore channeled to publishers and distributors, and the law was designed to facilitate that. Digital distribution invites us to reconsider all of the assumptions underlying that model. We are still in the early history of the networked digital environment, but already we've seen experiments with both direct and consumer-to-consumer distribution of works of authorship. One remarkable example of the difference …

Picking Up The Pieces Of Grokster: A New Approach To File Sharing, Tom Graves Jan 2004

Picking Up The Pieces Of Grokster: A New Approach To File Sharing, Tom Graves

UC Law SF Communications and Entertainment Journal

The introduction of peer-to-peer file-sharing has created a plethora of new legal issues regarding the creation and distribution of music recordings. The music, however, is only half of the story. The case of MGM Studios v. Grokster addresses the tension between promoting progress in music and protecting the development of new technologies. Although it may be time to revisit the judicial standard for vicarious and contributory copyright infringement in the file-sharing context, a new legislative framework must ultimately be found. The creators of music should be compensated for their work, but not at the unnecessary expense of new and useful …

Can The Right Of Publicity Afford Free Speech - A New Right Of Publicity Test For First Amendment Cases, Jason K. Levine Jan 2004

Can The Right Of Publicity Afford Free Speech - A New Right Of Publicity Test For First Amendment Cases, Jason K. Levine

UC Law SF Communications and Entertainment Journal

The right of publicity finds itself increasingly threatened by the First Amendment. Recent decisions at both the state and federal levels have served to highlight the confusion and lack of uniformity. For example, the Ninth Circuit recently held that an artist could not sell T-shirts with a charcoal drawing of the Three Stooges without permission, yet shortly thereafter the Sixth Circuit rejected Tiger Woods' attempt to prevent an artist from selling a painting of him winning a golf tournament, on essentially the same grounds. The author argues that the right of publicity and the First Amendment can co-exist, but that …

Improving The Reproductive Health Of Youth In Mexico, Ricardo Vernon, Maricela Dura Jan 2004

Improving The Reproductive Health Of Youth In Mexico, Ricardo Vernon, Maricela Dura

Reproductive Health

This project assessed the impact of the Mexican Foundation for Family Planning’s Young People Program (YPP) on: a) the attitudes of community stakeholders toward informing youth about reproductive health issues and making reproductive health services available for sexually-active youth; b) the sexual and reproductive health knowledge, attitudes, and behaviors of adolescents; and c) the way that providers offer reproductive health services to adolescents. In addition, the project determined whether adding a school-based sex education component increased the impact of community interventions on the knowledge, attitudes, and behaviors of adolescents. Survey results showed that the reproductive health knowledge and attitudes of …

Reproductive Health

In October 1999, the Frontiers in Reproductive Health (FRONTIERS) program began a three-year collaboration with the World Health Organization, the Senegal Ministries of Health, Education, and Youth, the Center for Research and Training in Health and Population, and the Population Training Group to test interventions to improve the reproductive health of youth aged 10–19. The community-based intervention included sensitization on adolescent reproductive health for community and religious leaders, reaching parents through women’s groups, and education sessions led by peer educators using a life-skills curriculum. As part of the clinic-based intervention, providers and peer educators were trained to offer youth-friendly services. …

Retention And Viability Characteristics Of Mammalian Cells In An Acoustically Driven Polymer Mesh, Zhaowei Wang, Paul Grabenstetter, Donald L. Feke, Joanne M. Belovich Jan 2004

Retention And Viability Characteristics Of Mammalian Cells In An Acoustically Driven Polymer Mesh, Zhaowei Wang, Paul Grabenstetter, Donald L. Feke, Joanne M. Belovich

Chemical & Biomedical Engineering Faculty Publications

A processing approach for the collection and retention of mammalian cells within a high porosity polyester mesh having millimeter-sized pores has been studied. Cell retention occurs via energizing the mesh with a low intensity, resonant acoustic field. The resulting acoustic field induces the interaction of cells with elements of the mesh or with each other and effectively prevents the entrainment of cells in the effluent stream. Experiments involving aqueous suspensions of polystyrene particles were used to provide benchmark data on the performance of the acoustic retention cell. Experiments using mouse hybridoma cells showed that retention densities of over 1.5 × …

Is There A Place For Race As A Legal Concept, Sharona Hoffman Jan 2004

Is There A Place For Race As A Legal Concept, Sharona Hoffman

Faculty Publications

What does "race" mean? The word "race" is omnipresent in American social, political, and legal discourse. The concept of "race" is central to contemporary debate about affirmative action, racial profiling, hate crimes, health inequities, and many other issues. Nevertheless, the best research in genetics, medicine, and the social sciences reveals that the concept of "race" is elusive and has no reliable definition.

This article argues that "race" is an unnecessary and potentially pernicious concept. As evidenced by the history of slavery, segregation, the Holocaust, and other human tragedies, the idea of "race" can perpetuate prejudices and misconceptions and serve as …

This essay posits that many federal environmental laws were adopted for the wrong rea- sons. Further, it suggests that environmental protections could be improved if more policy decisions were left in the hands of state and local governments.

The Trouble With Taxes: Fairness, Tax Policy, And The Constitution, Leo P. Martinez Jan 2004

The Trouble With Taxes: Fairness, Tax Policy, And The Constitution, Leo P. Martinez

UC Law Constitutional Quarterly

Fairness stands for a complicated set of moral and practical instructions inculcated in us since childhood. Consequently, fairness presents knotty problems of application for legal and policy analysts in the formulation of tax policy. This article probes the contours of the concept of fairness in taxation. I begin and end with the observation that fairness or the perception of fairness in taxation is a deceptively unsophisticated proposition. Part I includes a brief description of the public perception of fairness in the context of taxation. Part II follows with an exploration of the concept of fairness as a fundamental tenet of …

Supreme Court Voting Behavior: 2002 Term, Richard G. Wilkins, Scott Worthington, Sara Becker, Lorianne Updike Jan 2004

Supreme Court Voting Behavior: 2002 Term, Richard G. Wilkins, Scott Worthington, Sara Becker, Lorianne Updike

UC Law Constitutional Quarterly

The results of the 2002 Study - as with the Study last Term - reveal continued polarization and voting instability on the United States Supreme Court. Only two categories of cases, Civil/State and Civil/Federal, were decided by predominantly unanimous opinions. Yet, while the Justices voted in fairly consistent "conservative" and "liberal" blocs, neither wing of the Court seems able to consistently garnish the "fifth vote" crucial to a definitive liberal or conservative trend. As a result, the Rehnquist Court may have lost its conservative momentum. The data suggest several possible explanations for this development. Justice O'Connor is again the Court's …
