What do the following cases have in common? In Boy Scouts of America v. Dale,2 the Court upheld the right of a private organization to ignore a generally applicable state statute prohibiting discrimination on the basis of sexual orientation. In Hurley v. Irish-American Gay, Lesbian and Bisexual Group of Boston,3 the Court upheld the right of parade organizers to exclude gay-rights banners. In Zelman v. Simmons-Harri4s , the Court permitted government funding of religious schools through vouchers issued to low-income parents. And in Rosenberger v. 京味小說的嬗變 : 解讀《駱駝祥子》、《煙壺》、《鬈毛》、《頑主》, Ai Jun, Shafi Li

“京味小說”是中國現當代文壇一個令人矚目的文學流派﹐從創始人老舍到“新京味”王朔﹐五、六十年間呈現出鮮明的嬗變軌跡。但無論該流派怎樣變化﹐京味小說中的北京都有三層象徵意義﹐即“北京象徵中國”﹐“北京象 徵鄉土”﹐以及“北京的變化顯示中國社會變動的必然性與特殊性”。讓論者尤感興趣的是“北京象徵鄉土”的這一層象徵意義﹐在本人看來這裡的“鄉 土”有兩層含意﹐其一﹐中國知識分子的精神家園﹐建基於城與人的文化同構性﹔其二﹐代表該古老都市的民間。這兩層含義使得“京味小說”中的“知識 分子話語”和“民間話語”顯示出某種內在張力﹐豐富及擴大了它的精神內涵﹐ 在不同時期的“京味小說”裡展現了不同的角力關係﹐並以越來越大的幅度向民間傾斜。
本文主要通過解讀四篇不同時期京味小說的代表作﹐理出該流派的嬗變軌跡﹐採用的是文本細讀的方法。具體地說﹐首先根據“京味小說”定義的重點﹐ 從三大方面著手分析該流派的變化﹕北京人和北京事﹐北京話﹐以及北京的風土習俗。在分析“北京人和北京事”時﹐本文追蹤分析了四篇“京味小說”中 重複出現的道具﹐同時並置考察了文本中的寓意系統、人物的命運、主題、情節結構以及其他人物的部分功能﹐希望通過這種綜合分析﹐對該流派的變化闡述深入到上述“北京象徵鄉土”的兩層含義的張力關係方面。

This ethnographic study of emerging inquiry-based science instruction in an urban, low socioeconomic elementary school science lab was designed to gain insight into the perspectives of the teacher and students. The study involved a Central Florida elementary school whose population was over 80 percent African-American. In this six month study, the researcher examined the classroom setting of a science lab teacher and her fourth and fifth grade students during a six month period of time. Data sources included interviews, field notes, reflections, and student work , which were used to identify the emerging themes and patterns in the study. The …

Placement into educable mentally handicapped (EMH) programs is necessary for some students in order to allow them the opportunity to receive an education appropriate for their special needs. Nonetheless, identification as EMH is often perceived as negative and demeaning. Decades of research have substantiated the over-representation of black students into certain categories of special education, including EMH, in comparison to white and Hispanic students. This disparity has raised questions within schools, academe and research communities, and legislative and governing bodies as to the causes, compelling factors, and related variables impacting the phenomenon. Candidates for Florida real estate sales associate licensure responded to a two-part questionnaire based on William A. Long’s Reactive Behavior Patterns Theory and Robert J. Sternberg’s Triarchic Theory of Intelligence. Examination scores were converted to a dichotomous pass/fail variable based on the Florida Real Estate Commission-mandated cut-off score of 75 correctly answered questions out of 100. The candidates’ responses to the questionnaire comprising the Long-Dziuban Inventory and the Cognitive Strengths Task List based on Sternberg’s theory, were crosstabulated with pass/fail to identify differential passing proportions, if any, based on reactive behavior pattern and/or cognitive strength. For the past thirty years Africa has produced a more noticeably inferior reserve of human capital than other developing regions. This is puzzling because at the inception of independence, the future of Africa looked promising. However, during the 1970s both the political and economic situation in Africa began to deteriorate, and since 1980, the aggregate per capita GDP in sub-Saharan Africa has declined at almost one percent per fiscal year. Thirty-two countries are poorer now than they were twenty years ago, and sub-Saharan Africa is now the lowest-income region in the world despite the fact that during the last two …

A Bar Against Competition: The Unconstitutionality Of Admission Rules For Out-Of-State Lawyers, Andrew M. Perlman

The Article contends that the American Bar Association's Model Rule on Admission by Motion and similar state provisions currently under consideration place unconstitutional limitations on the interstate practice of law and should be revised. These rules often require lawyers, and especially junior lawyers, to re-take the full bar examination as a condition for admission in another state. Although many commentators have criticized these types of requirements as having the primary purpose and effect of protecting the financial interests of the in-state bar, the re-take rule has a more serious and unrecognized flaw. In four further parts of this comment, I undertake to fulfill my "obligation" to present a more thorough analysis. In part II, I briefly introduce some of the different elements that would go into normal treaty interpretation related to the issue in question, such as which text should be part of the analysis and whether "preparatory work" or intent of the parties, including statements by some nation-state governmental officials made contemporaneously with the drafting of the treaty, should be considered. Combining Learning Approaches For Incremental On-Line Parsing, Deryle W. Lonsdale, Michael B. Manookin

This paper discusses the integration of two different machine learning approaches to modeling language, NL-Soar and analogical modeling (AM). The resulting hybrid system is capable of functionality that is not possible when using only one of the systems in isolation. After a brief introduction of each system, an explanation is given of how AM is used to provide information useful to NL-Soar for two tasks. Examples are given, and related issues are outlined.

This study investigates connections between teacher and student attitudes related to the delayed (or immediate) introduction of Japanese script in the Japanese language classroom. Two groups of students completed questionnaires concerning their attitudes toward the immediate or delayed introduction of Japanese script and the use of romaji (romanized Japanese) in the Japanese as a second language classroom. The first group was introduced to Japanese script immediately, and romaji was not used in their textbook. The second group used a romaji textbook and was introduced toJapanese script at a later time and a slower rate. Teacher attitudes were also assessed using …

A Tale Of The Children: Challenges To Learning And Teaching In Idaho, And Why Some Children Will Be Left Behind, Terry Armstrong

Teachers are under many stressors from forces seeking to improve education. In Idaho, there are numerous factors beyond educators' control that threaten to undermine success for all children. This article, prepared by eighteen distinguished Idaho public school teachers, outlines variables attendant to school failure for many Idaho children. Teachers need to act as advocates for improving the social climate that impinges on learning.

In Aboriginal Rights and Judicial Wrongs: The Colonization of the Last Frontier, I examine a recent sea-change in federal Indian law that has escaped the notice of scholars. In the light of the divestiture of tribal sovereignty characterizing recent Supreme Court decisions, my article interrogates a contemporary case that rejects the property principle underlying all of federal Indian law itself in favor of a conception of aboriginal title never before countenanced in the United States and long discredited elsewhere. My analysis argues that this new conception traduces 175 years of American precedent and violates international law. I also contend that …

Getting To The Pulp Of Haruki Murakami's Norwegian Wood: Translatability And The Role Of Popular Culture, Jacquelyn Zuromski

Haruki Murakami's Norwegian Wood (1987) veers from his favored detective-fiction genre by offering readers a 1960s coming-of-age romance, a story whose plot nonetheless spins around the protagonist seeking out his personal identity. The conflicts between Japanese tradition and modern, global perspectives are illustrated through the inclusion of popular culture elements such as music, literature and films. This thesis seeks to show how the novel's references to popular culture of the 1960s combine to help the protagonist establish an identity for himself as well as his place within the universal community. In Part I, I expand on the distinction between the Horatian and the Menippean forms of satire and then suggest that a similarly bold division can be used to map satirical legal studies. In support of that argument, I use the example of the earliest surviving satirical legal poem within the Western tradition. My analysis of this exemplary satirical legal artifact delineates four principal modes of legal satire that will organize the ensuing discussion of more contemporary examples of the genre. With coalgebras usually being defined in terms of an endofunctor T on sets, this paper shows that modal logics for T-coalgebras can be naturally described as functors L on boolean algebras. Building on this idea, we study soundness, completeness and expressiveness of coalgebraic logics from the perspective of duality theory. That is, given a logic L for coalgebras of an endofunctor T, we construct an endofunctor L such that L-algebras provide a sound and complete (algebraic) semantics of the logic. We show that if L is dual to T, then soundness and completeness of the algebraic semantics immediately yield the …

This research study explored how intercultural communication factors such as values and communication styles might affect the interaction between Tamil asylees and their U.S. social workers. For this qualitative study, I interviewed 11 Tamil asylees and conducted a focus group with 3 U.S. social workers at an agency serving the Tamil participants. Based on the findings of this research as well as the literature review, this thesis reveals culture-specific information about Tamil asylees and highlights the implications of the research to the fields of intercultural communication, refugee studies, and social work. Audit committees of corporate boards of directors are central to corporate governance for many corporations. Their effectiveness in supervising financial managers and overseeing the financial reporting process is important to promote reliable financial statements. This centrality suggests that it is likewise important for investors and others to have a basis for justifiable confidence in audit committee effectiveness. At present, there is no such mechanism. The following thesis analyses the maintenance of national education, business, and social infrastructures (such as popular media and advertisement) for the English language within German borders. This linguistic situation in Germany, combined with the pressure of English as a global language, signifies the possibility of English becoming the lingua franca (common language) for Europe (both European Union and non-European Union countries), especially in the areas of higher education, business, and media.
