A New Product For The Corporation Law Market: Audit Committee Certifications, Lawrence A. Cunningham Mar 2004

A New Product For The Corporation Law Market: Audit Committee Certifications, Lawrence A. Cunningham

ExpressO

In the swirling corporate governance reforms led by SOX, the SEC, SROs and PCAOB, Delaware and other states are playing minor roles at best. State absence creates a missing arc in the evolving US corporate governance circle. The circle is drawn as follows: state corporation law charges boards of directors with managing corporations and authorizes board committees; SOX charges audit committees with tasks, including supervising external auditors; SROs require audit committee characteristics like independence and compel disclosure; PCAOB requires external auditors to evaluate audit committee effectiveness. This last step could close the circle except that auditors performing this evaluation generate …

A compendium of the work of Vladimir L. The Bible And Pedagogy, Andrea Luxton Mar 2004

The Bible And Pedagogy, Andrea Luxton

Faculty Publications

This paper seeks to identify and explore some of the pedagogical principles practiced in the Bible. To limit the extent of the discussion, the four “ideals” of pedagogy identified by the National Research Council will be used as a framework for the study. Two levels of teaching will be explored: the principles and practice we see within the inspired text as God interacts with humanity; and the principles and practice found in the way that the Bible as an inspired text itself becomes a teacher to its readers. Finally in each of the four areas this paper will consider what …

Banking The Poor, Michael S. Barr Mar 2004

Banking The Poor, Michael S. Barr

Law & Economics Working Papers Archive: 2003-2009

Low-income households often lack access to banking accounts and face high costs for transacting basic financial services through check cashers and other alternative financial service providers. These families find it more difficult to save and plan financially for the future. Living paycheck to paycheck leaves them vulnerable to medical or job emergencies that may endanger their financial stability, and lack of longer-term savings undermines their ability to improve skills, purchase a home, or send their children to college. Additionally, high cost financial services and inadequate access to bank accounts may undermine widely-shared societal goals of reducing poverty, moving families from …

Toward A New Theory Of Notice And Deterrence, Dru Stevenson Mar 2004

Toward A New Theory Of Notice And Deterrence, Dru Stevenson

ExpressO

This article sets forth a new model of “notice” and deterrence that helps explain some long-standing contradictions in the literature on deterrence. Nearly all the work in the area of criminal law and deterrence has included an assumption that would-be offenders know the laws and the threatened sanctions, and therefore adjust their behavior in light of these disincentives. The fact that most people seem to be ignorant of the exact boundaries of the rules, and ignorant of the sanctions, presents an enormous conceptual problem for the classic model of deterrence. This new model presents an alternative mechanism for deterrence based …

An Experimental Investigation Of Productivity Stratification And Knowledge Transfer In An Electronically Mediated Environment, Jachin Sakamoto Mar 2004

An Experimental Investigation Of Productivity Stratification And Knowledge Transfer In An Electronically Mediated Environment, Jachin Sakamoto

Theses and Dissertations

The idea of anywhere and anytime learning is enticing from a military standpoint, given the high deployment rates in the current operational environment. Electronic-based learning is seen as an answer to this requirement. Currently there are many variations in electronic-based instructional media, and little has been done to determine which format or combination of formats is most conducive to facilitating knowledge transfer and learning. The research project explores, through the use of an experiment, three primary constructs of media richness, content flexibility, and forced engagement, in their relation to effectiveness or productivity in facilitating learning in the experimental participants. The …

The Nexus Explored: A Generalised Model Of Learning Styles, Damian Gordon, Gordon Bull Mar 2004

The Nexus Explored: A Generalised Model Of Learning Styles, Damian Gordon, Gordon Bull

Conference papers

The controversy over learning style (the unique way of thinking and reasoning that characterizes an individual learner) as to whether or not it is a stable cognitive factor is one which has raged on for a number of years, and has been reinvigorated recently with the advent of easy-to-use courseware development tools and the consequent development of virtual learning environments. This paper surveys a number of different learning styles models and it concludes there is a large degree of commonality between the different theories, which allows us to distill key or core learning style characteristics which point the way to …

Using Our Brains: What Cognitive Science Teaches About Teaching Law Students To Be Ethical, Professionally Responsible Lawyers, Alan M. Lerner Mar 2004

Using Our Brains: What Cognitive Science Teaches About Teaching Law Students To Be Ethical, Professionally Responsible Lawyers, Alan M. Lerner

ExpressO

Throughout our lives, below the level of our consciousness, each of us develops powerful values, intuitions, expectations, and needs that powerfully affect both our perceptions and our judgments. Placed in situations in which we feel threatened, or which implicate our values, our brains, relying on those implicitly learned, emotionally weighted, memories, can "downshift," to primitive, self-protective problem solving techniques - fight or flight. Because these processes operate below the radar of our consciousness, we react without reflection or the opportunity for interdiction. Thus, it may be that automatic, “emotional” reaction, rather than thoughtful, reasoned analysis leads to our responses to …

The Literacy Practices Of Working Class White Women, Jody Ann Fernandez Mar 2004

The Literacy Practices Of Working Class White Women, Jody Ann Fernandez

USF Tampa Graduate Theses and Dissertations

It is an accepted construct that literacy proficiency is vital to economic success in America. As well, research has shown that home literacy use, especially parental practices, is instrumental in the children's acquisition of literacy skills, and later, proficiency with school literacy tasks. While literacy research abounds regarding family literacy practice, especially that of low-income mothers and children, rarely is the concept of class specifically addressed as separate from race.

The purpose of this study was to investigate and describe the reported home literacy practices of nine white working class women residing in a neighborhood in the Southeastern United States. …

Beyond Rights: Legal Process And Ethnic Conflicts, Elena A. Baylis Mar 2004

Beyond Rights: Legal Process And Ethnic Conflicts, Elena A. Baylis

ExpressO

Unresolved ethnic conflicts threaten the stability and the very existence of multi-ethnic states. The realities of ethnic conflict are daunting: ethnic disputes tend to be both persistent and complex, and efforts to use democracy or ethnic-blind policies to deal with those conflicts tend to fail. While multi-ethnic states have struggled to devise political solutions for ethnic conflict, they have largely ignored the role that legal processes might play in resolving ethnic discord. But at certain crucial moments in the development of ethnic conflicts, legal processes such as mediation, adjudication, and constitutional interpretation might effectively address these disputes.

This article explores …

Discipline: An Academic Dean's Perspective On Dealing With Plagiarism, Kevin J. Worthen Mar 2004

Discipline: An Academic Dean's Perspective On Dealing With Plagiarism, Kevin J. Worthen

Brigham Young University Education and Law Journal

Three months after I was convinced by our very persuasive Dean that, contrary to my first thought, being an Associate Academic Dean was not such a dumb idea, I was confronted with a situation that reinforced my initial impression. On my desk sat a paper submitted by a student in a law school course. More than one-half of the paper was copied word for word without any attribution being given. Dozens of other lines contained material that should have been included in quotation marks, but was not. Some of the material quoted without attribution came from sources cited in other …
