This bibliography covers law review articles and supplemental A.L.R. entries published after 1997. We also include a handful of especially interesting pieces published in or before 1997, which we believe are just too good to pass up. A.L.R. entries, whose titles are usually self-explanatory, are cited, but not annotated. Similarly, articles that concern only a single case or a single state are cited, but not annotated.

Impact Of Extra-Curricular Activities On Adolescents' Connectedness And Cigarette Smoking: Annual Report, Donna Cross, Greg Hamilton, Rob Mcgee, Margaret Hall
Research outputs pre 2011
Cigarette smoking is the primary cause of preventable death in Australia, killing approximately 19,000 people every year.8 Up to 90% of smokers begin smoking by 18 years of age.9,10 In spite of the obvious public health burden, current approaches have led to very modest decreases in adolescent smoking in the past 10 years. 11 The Smoking Cessation for Youth Project (SCYP)4 was a cluster randomised control trial that resulted in lower cigarette smoking among Year 10 students who received a harm minimisation intervention over two years. This project also led to the identification of connectedness as a …

Family Violence Protective Orders In Texas And Appelate Review: Are They Meant For Each Other., Manuel C. Maltos
Family Violence Protective Orders In Texas And Appelate Review: Are They Meant For Each Other., Manuel C. Maltos
St. Mary's Law Journal
Historically, protective orders have been viewed as an effective civil legal recourse for those affected by family violence. Title Four of the Texas Family Code governs these protective orders and sets forth the requirements for obtaining such an order. With consistent improvements to Title Four, the legislature has responded to society's decreasing tolerance of family violence. As a result, now the Family Code mandates the issuance of a protective order as provided by Title Four, regardless of whether a divorce is pending. Further legislative efforts also lengthened the maximum duration of a protective order from one year to two years. …

Legal Malpractice In Texas: Examining Selected Cases And Forecasting Future Trrends Third Annual Symposium On Legal Malpractice & Professional Responsibility: Symposium Presentations., Wallace B. Jefferson
St. Mary's Law Journal
Little hard data exists concerning legal malpractice in Texas. What’s more, few legal law malpractice rulings are published. To date, there are only fifty written opinions on legal malpractice from Texas intermediate appellate courts. The activity that most often gave rise to a claim of legal malpractice involved the preparation, filing, and transmittal of documents, accounting for about a quarter of all claims. In San Antonio, Chief Justice Alma Lopez of the Fourth District Court of Appeals discussed common issues she sees in her courtroom. The issues ranged from failures to follow simple court rules to more substantial failures of …

Obvious To Whom? Evaluating Inventions From The Perspective Of Phosita, Rebecca S. Eisenberg
Obvious To Whom? Evaluating Inventions From The Perspective Of Phosita, Rebecca S. Eisenberg
Articles
In this Article, I consider the possibility of giving the USPTO input from currently active technological practitioners in evaluating the obviousness of claimed inventions. Such input could potentially serve three useful functions. First, it could improve the accuracy of USPTO decisionmaking by providing access to the perspective of actual practitioners as to the obviousness of inventions from the perspective of the hypothetical PHOSITA. Second, it could help the USPTO document the evidentiary basis for rejections that rest in part upon tacit knowledge within technological communities. Third, it could provide a quality control mechanism that would improve the credibility of USPTO …

Bioevaluation Of Insecticidal And Repellen Plants From Central Region Of Kenya And Chemical Identification Of Bioactive Derivatives, Silas Khamala Simiyu
All Master’s Theses
Despite considerable control efforts, malaria still remains the most prevalent and devastating disease in the tropics. With more than 40% of the world population at risk, malaria undermines the welfare of several South American, Asian and African states, endangering the survival of children (killing one child every 30 seconds) and straining scarce resources. It is estimated that US $ 2 billion is spent on malaria control and treatment programmes in Africa annually. The problem is becoming increasingly difficult to manage because of the continuous intensification and spread of resistance to anti-malarial drugs by the parasites. This poses a serious threat …

Expression Of The Glossina Proteolytic Lectin (Gpl) Gene In Tsetse Flies And Other Haematophagous Arthropods, Marion Burugu Warigia
All Master’s Theses
African animal trypanosomosis, transmitted by the tsetse fly (Glossina spp.) remains a major constraint to food security in areas of Africa that hold the continent's greatest potential for expanded agriculture production. The flies also transmit the parasite responsible for human sleeping sickness. Other haematophagous arthropods like stable flies also transmit trypanosomes mechanically. Mechanical transmission only accounts for a small percentage (-16 % ) of the trypanosomes transmission since the haematophagous arthropods do not provide an environment for tr)-panosome development within their tissues unlike in tsetse flies. The life cycle of the parasitic African trypanosome in its invertebrate vector begins when …

Today, approximately 40% o f the world's population, mostly those living in the poorest countries, are at risk of malaria, which causes more than 300 million acute illnesses and at least one million deaths annually. Ninety per cent o f deaths due to malaria occur m subSaharan Africa, mostly among young children. The importance o f malaria cannot be over emphasized. A project, (Agro-ecosystem Management for Community-Based Integrated Malaria Control in East African Irrigation Schemes) is currendy underway in Mwca Division, Kirinyaga District, Kenya, under the auspices o f the International Development Research Centre (IDRC) Canada and the International Centre …
Biochemical Examination And Identification Of Botanicals Active Against Adult Anopheles Gambiae From The Coastal Region Of Kenya, Josiah Ochieng Odalo
Biochemical Examination And Identification Of Botanicals Active Against Adult Anopheles Gambiae From The Coastal Region Of Kenya, Josiah Ochieng Odalo
All Master’s Theses
Malaria still remains one of the most important tropical parasitic and vector-borne diseases in terms of geographical distribution, incidence, the extent of the morbidity and mortality. It is endemic in about 100 countries inhabited by >40010 of the world's population with at least 500 million clinical cases reported each year. More than 90% of these cases occur in Africa, where it is one of the most important causes of morbidity and mortality among infants, young children, pregnant women, non-immune travelers, refugees, displaced persons and labourers entering endemic zones. Management of malaria has become more difficult due to the development of …
The Process For Becoming A Law School Professor In The United States, Daniel H. Foote
The Process For Becoming A Law School Professor In The United States, Daniel H. Foote
Articles
As the process of legal education reform in Japan, centered on the establishment of a new tier of professional graduate schools in law, moves forward, one issue that has arisen is how law professors will be trained in coming years. In that connection, I am frequently asked what the typical route is for training law school professors in the US. Based in part on an examination of the backgrounds prior to entering law teaching for over 500 law professors at eight US law schools and on personal experiences (including serving for three years on the appointments committee at the University …
Collateralizing Internet Privacy, Xuan-Thao Nguyen
Collateralizing Internet Privacy, Xuan-Thao Nguyen
Articles
Collateralizing privacy is a pervasive conduct committed by many on-line companies. Yet most don't even realize that they are engaging in collateralizing privacy. Worse yet, governmental agencies and consumer groups are not even aware of the violation of on-line consumer privacy by the collateralization of privacy. Professor Nguyen argues that collateralizing privacy occurs under the existing privacy regime and the architecture of article 9 of the Uniform Commercial Code. Professor Nguyen critiques the violation of privacy through collateralization dilemmas and proposes a solution involving modifications of the contents of the financing statement and security agreement in secured transactions where consumer …
Cash For Kidneys? Utilizing Incentives To End America's Organ Shortage, Steve P. Calandrillo
Cash For Kidneys? Utilizing Incentives To End America's Organ Shortage, Steve P. Calandrillo
Articles
This article addresses the growing organ shortage in America, analyzes current donation and procurement law, and explores both monetary and nonmonetary incentives aimed at eliminating the worsening crisis.
Part I details the law governing human organ donation. Under both the Uniform Anatomical Gift Act (“UAGA”) and the National Organ Transplant Act (“NOTA”), no donor of a human organ may receive “valuable consideration” for providing it. Congress’ intention was simply that the organ recipient be given the “gift” of life—not one which she had to purchase on the market. In reality, the consequences of the Act bear little resemblance to its …
Vanishing Vaccinations: Why Are So Many Americans Opting Out Of Vaccinating Their Children?, Steve P. Calandrillo
Vanishing Vaccinations: Why Are So Many Americans Opting Out Of Vaccinating Their Children?, Steve P. Calandrillo
Articles
Part I of this Article details the historical development and medical achievements made possible by vaccines. From Edward Jenner to Jonas Salk to Albert Sabin, immense strides have been made in eradicating or substantially eliminating some of the worst diseases in human history. Smallpox, polio, measles, mumps, rubella, diphtheria, pertussis, tetanus, influenza, hepatitis A and B, and even the chicken pox are all now largely preventable.
Literally hundreds of millions of deaths have been avoided and many more lives markedly improved, to say nothing of the financial ramifications for the American healthcare system. All fifty states have therefore enacted compulsory …
