A Theory Of Crimes Against Humanity, David Luban Jan 2004

A Theory Of Crimes Against Humanity, David Luban

Georgetown Law Faculty Publications and Other Works

The answer I offer in this Article is that crimes against humanity assault one particular aspect of human being, namely our character as political animals. We are creatures whose nature compels us to live socially, but who cannot do so without artificial political organization that inevitably poses threats to our well-being, and, at the limit, to our very survival. Crimes against humanity represent the worst of those threats; they are the limiting case of politics gone cancerous. Precisely because we cannot live without politics, we exist under the permanent threat that politics will turn cancerous and the indispensable institutions of …

Defense-Oriented Judges, Abbe Smith Jan 2004

Defense-Oriented Judges, Abbe Smith

Georgetown Law Faculty Publications and Other Works

In this essay, I argue in favor of so-called "defense-oriented judges." Instead of the increasingly prosecution-oriented judicial aspirants who ascend to the bench, we need more judges who care about protecting the rights of the accused, who will put the government to the test, and who have some compassion for those who come before them. Instead of judges who are nothing more than rubber-stamps for prosecutors, deferring to prosecutors at every step because they believe most defendants are in fact guilty, or because they dislike defense lawyers, we need judges who are truly neutral and disinterested. Instead of judges who …

Just Do It, Girardeau A. Spann Jan 2004

Just Do It, Girardeau A. Spann

Georgetown Law Faculty Publications and Other Works

Racial injustice has always been a problem in the United States. The most salient victims of the Nation's discrimination against racial minorities have included indigenous Indians, Chinese immigrants, Japanese-American citizens, Latinos, and of course blacks. But as the current war on terrorism illustrates, under the right conditions, almost any racial group can come within the scope of America's discriminatory focus. It is common to suppose that that there is a difference between the progressive and the conservative ends of the political spectrum concerning the issue of race. However, those commonly accepted differences pale in comparison to the overriding similarity that …

Young Heber J. Grant And His Call To The Apostleship, Ronald W. Walker Jan 2004

Young Heber J. Grant And His Call To The Apostleship, Ronald W. Walker

BYU Studies

A year following his call to become president of the Tooele Stake, twenty-four-year-old Heber J. Grant stopped by the Salt Lake studio of Charles Savage, the pioneer photographer. The conversation took an unexpected turn. Elder Grant wrote in his journal that Savage told him "to put it down that within one year I would be a member of the Twelve Apostles."

Rachel R. Grant: The Continuing Legacy Of The Feminine Ideal, Ronald W. Walker Jan 2004

Rachel R. Grant: The Continuing Legacy Of The Feminine Ideal, Ronald W. Walker

BYU Studies

We can imagine ourselves visiting Aunt Rachel Grant, longtime president of the Thirteenth Ward Relief Society and one of The Church of Jesus Christ of Latter-day Saint's "leading ladies," at her home on Salt Lake City's Second East Street. In the year of our visit, 1890, her two-story, plastered adobe home partakes of the prevailing feminine ideal that stresses homemaking and handicraft. The stove is highly burnished, while the arms of each chair are covered with homemade lace crocheting. A corner "whatnot" meticulously displays pictures, small framed mottoes, wax and hair flowers, and other curios. Rachel's person also reflects her …

Heber J. Grant's European Mission, 1903-1906, Ronald W. Walker Jan 2004

Heber J. Grant's European Mission, 1903-1906, Ronald W. Walker

BYU Studies

Elder Heber J. Grant landed in Liverpool, England, in November 1903, and by the first of the year he officially assumed his new position as president of the European Mission. The mission began at Tromso, Norway; and ran to Cape Town, South Africa; with Iceland and India serving as distant east-west meridians. While the church had branches in each of these extremities, Grant's field of labor was more compact. Most of the mission's effort was reserved to the Netherlands, Germany, Scandinavia, and Switzerland, where he had a general superintendency, and especially in the British Isles, where he had duties that …

Prostitution, Hustling, And Sex Work Law And Policy, Polly Thistlethwaite Jan 2004

Prostitution, Hustling, And Sex Work Law And Policy, Polly Thistlethwaite

Publications and Research

Prostitution, hustling, and sex work are forms of labor, not erotic preferences or identities as are gay, lesbian, bisexual, and transgender, but sex workers and queers alike are stigmatized and criminalized for consensual sexual activity. The state – federal, state, and local law enforcement – routinely interferes with certain types of sexual activity. Enforcement of laws regulating sex behavior often varies given the discretion of local police. In her 1989 essay “Thinking Sex,” Gayle Rubin positions sex-for-money, prostitution, with pornography, promiscuous sex, pornography, and homosexual sex in the low status “outer limits” of the contemporary American sex hierarchy; while heterosexual, …

Trust In Client-Service Provider Relationships, Sven Markus Huth Jan 2004

Trust In Client-Service Provider Relationships, Sven Markus Huth

Plymouth Business School Theses

In the age of rapidly changing and competitive environments, companies are forced to build strong and long-lasting relationships with their customers. Over the last decades, marketing theory and practice developed a plethora of attempts to describe relevant factors, underlying correlations and complex constructs, explaining the relationship between buyer and seller. For several disciplines, which are part of, describe or influence the relationship between buyer and seller such as a) marketing, b) customer purchase behaviour and c) sales management and personal selling, it appears that trust has a strong impact and therefore is an important variable for building long-lasting relationships. Although …

Quality Assurance Testing Of The Eclox-M In Detecting Terrorism Threats In Louisiana's Public Drinking Water Systems, Jessica Coleman Jan 2004

Quality Assurance Testing Of The Eclox-M In Detecting Terrorism Threats In Louisiana's Public Drinking Water Systems, Jessica Coleman

LSU Master's Theses

A quality assurance testing of the ECLOX-M™, a rapid water quality indicator used in potential terrorist attacks, was evaluated for its adequacy in nine regional Louisiana water systems. The ECLOX-M™ system uses enhanced chemiluminescence to measure toxicity in water by integration of a mixture of luminol (C8H7O3N3), and an oxidant in the presence of a catalyst enzyme - horseradish peroxidase (HRP). Water samples were tested for chemiluminescence, chlorine content, pH, and arsenic and/or nerve agent/pesticide contamination. In addition, three toxic industrial chemical standards were evaluated (mercury, a volatile liquid mixture, and a …

Evaluation Of Growth, Production And Cold Tolerance Of Four Varieties Of Tilapia, Patricio Enrique Paz Jan 2004

Evaluation Of Growth, Production And Cold Tolerance Of Four Varieties Of Tilapia, Patricio Enrique Paz

LSU Master's Theses

As global tilapia production grows, it is important to characterize varieties available for production and generate data on environmental tolerances. This study generated data on tolerances, adaptabilities and production characteristics of four tilapia varieties. Goals of this study were to: (1) compare growth of four tilapia varieties in two types of recirculating systems, (2) evaluate juvenile growth of seven tilapia varieties in fresh and brackishwater mesocosms, and (3) estimate cold tolerance of juveniles of four tilapia varieties in fresh and brackishwater. Nile tilapia (Oreochromis niloticus), blue tilapia (Oreochromis aureus), Mississippi commercial strain tilapia (MCS), and Florida red tilapia (FRT) were …

Employee Stock Purchase Plans, Gary V. Engelhardt, Brigitte C. Madrian Jan 2004

Employee Stock Purchase Plans, Gary V. Engelhardt, Brigitte C. Madrian

Faculty Publications

Employee stock purchase plans (ESPPs) are designed to promote employee stock ownership broadly within the firm and provide another tax-deferred vehicle for individual capital accumulation in addition to traditional pensions, 401(k)s, and stock options. We outline the individual and corporate tax treatment of ESPPs and the circumstances under which ESPPs will be preferred to cash compensation from a purely tax perspective. We then examine empirically ESPP participation using administrative data from 1997-2001 for a large health services company that employs approximately 30,000 people. The picture that emerges from the analysis of these data suggests that there is substantial non-participation in …

Emeritus Faculty And Alumni As Volunteers In A University Archives: Planning For Success, Tamar Chute Jan 2004

Emeritus Faculty And Alumni As Volunteers In A University Archives: Planning For Success, Tamar Chute

Provenance, Journal of the Society of Georgia Archivists

Archivists use volunteers to arrange and describe collections, help with events and donor relations, and assist with reference activities. Volunteers may also work on projects outside the archives, such as oral histories, fundraising, or designing and creating web pages. They are usually enthusiastic and eager to help, and they can be a valuable addition to the archives staff. Volunteers may range from children to retirees, from novices to professionals with archival experience. Regardless of their age or level of knowledge, volunteers require supervision, detailed instructions, and often much patience.

Introducing Lawrence V. Texas: Some Background And A Glimpse Of The Future, Edward Stein Jan 2004

Introducing Lawrence V. Texas: Some Background And A Glimpse Of The Future, Edward Stein

Cardozo Journal of Equal Rights & Social Justice

The article explores the landmark Supreme Court case Lawrence v. Texas (2003), which overturned the Court's earlier decision in Bowers v. Hardwick and struck down a Texas sodomy law criminalizing consensual same-sex intimacy. The ruling significantly advanced LGBTQ+ rights by affirming privacy rights under the Due Process Clause and laying groundwork for future equal protection challenges to laws discriminating based on sexual orientation. The decision's implications extend beyond privacy rights, influencing debates on same-sex marriage, adoption, and other areas of sexual orientation discrimination.

Lawrence And Garner: The Love (Or At Least Sexual Attraction) That Finally Dared Speak Its Name, Paris R. Baldacci

Cardozo Journal of Equal Rights & Social Justice

The article examines the legal evolution from *Bowers v. Hardwick* to Lawrence v. Texas, highlighting how the latter marked a pivotal shift in recognizing LGBTQ+ rights by emphasizing personal autonomy and dignity. It underscores the significance of narrative strategies in shaping judicial decisions, particularly in *Lawrence*, where the plaintiffs' personal stories influenced the Court's ruling.

A Meta-Analytic Examination Of Decisional Balance Across Stage Transitions: A Cross-Sectional Analysis And Cross-Sequential Cross-Validation, Kara L. Hall

Open Access Dissertations

Interventions to decrease unhealthy behaviors and to increase healthy behaviors are crucial for health promotion and disease prevention. Computerized tailored interventions provide a promising approach for creating positive health behavior change. The Transtheoretical Model (TTM) delineates a way to conceptualize behavior change, provides the foundation for developing assessments of an individual's readiness to change, and is utilized in tailoring interventions for actualizing behavior change. To produce optimally tailored interventions: (1) theory that guides interventions needs to be comprehensively tested; and (2) empirical data that drive the tailored interventions needs to be systematically generated. This program of research tests theoretical assumptions …

L'IRSST a …
