Because I intend to be prescriptive (or, when it comes to the esteemed members of the bench who may be in the audience, “suggestive,” since it is they who wield the gavels while I -- as any lawyer appearing before members of the bench -- have only words), I must confess some biases before going further. First, I believe in “sunshine in litigation” and openness of both court records and discovery. Comparing Three Measures Of Depressive Symptoms Among American Indian Adolescents, Lisa E. Thrane, Les B. Whitbeck, Dan R. Hoyt, Mack Shelley

This study examined the measurement of depressive symptoms among American Indian adolescents as assessed by the Center for Epidemiologic Studies Depression Scale (CES-D), Youth Self Report (YSR), and the Tri-Ethnic Center’s for Prevention Research Depression Scale (TEDS). This analysis demonstrated that the TEDS had good internal consistency, demonstrated construct validity, and shared a commonality with the other two measures, but had limited predictive validity. The YSR had strong predictive validity but, like the CES-D, showed weakness in construct validity. Unexpectedly, the CES-D and YSR revealed enculturated youth were at risk of depressive symptoms. These findings do not generate unequivocal support …

Objective—To examine street victimization and posttraumatic stress symptoms among urban homeless adolescents and to test whether emotional numbing and avoidance represent distinct posttraumatic stress disorder (PTSD) symptom clusters.
Method—Structured, private interviews were conducted with homeless adolescents (N = 374) in the Seattle metropolitan area (95% response rate) from 1995 to 1998.
Results— Eighty-three percent of street youths were physically and/or sexually victimized after leaving home. Approximately 18% of these youths met research criteria for PTSD.Results from a confirmatory factor analysis suggest that disaggregating symptoms of avoidance from symptoms of emotional numbing provides a better fit of the data than the …

This complation presents an engaging, insightful, and inspiring smorgasbord of essays (and one didactic tale) selected from Harriet Martineau's Lake District writings from the mid-1800s. As a source of inspiration, the English Lake District has been profitably mined by scores of writers, including Martineau. The selections included here are more or less available (usually less) in scholarly and rare book collections, but are not generally obtainable for a pleasant armchair read at home or, as Martineau would certainly encourage, to tote along in one's knapsack on a weekend ramble among the lakes and hills of Cumbria. The deleterious effects of white-tailed deer (Odocoileus virginianus) on forest regeneration are well documented in many forested systems, but potential solutions to these problems on remote landholdings are limited in number and scope. Localized management proposes that a persistent area (<2 km2) of low density can be created by removing all individuals within matriarchal social groups of white-tailed deer. Our objective was to assess the feasibility of using localized management as a tool within forest regeneration areas. We present a comparison of seasonal home-range and core-area size and site fidelity of 148 radiomonitored female white-tailed deer in a forested landscape of the central Appalachians of West Virginia. We also characterized seasonal movements and dispersal. Adult female winter home-range size exceeded those of summer and autumn. Female deer displayed high fidelity, with home-range and core-area overlap being less in autumn than in summer or winter. Dispersal occurred in 1 of 28 (3.6%) female fawns and no deer >1 year old dispersed. Female white-tailed deer on our study site meet the a priori assumptions of localized management. We assert that experimental manipulations based on localized management concepts are prudent.

Previous research has suggested that “victim” and “offender” are not mutually exclusive categories but rather represent a homogeneous pool in which offenders are victimized and victims also offend. Little is known, however, about the specifics of the victim and offender process. The current study formally addresses the following research questions: why are some individuals at higher risk for victimization compared to others; why do some young people offend while others do not; and finally, why are criminal victims likely to retaliate? Dietary conjugated linoleic acid (CLA) reduces body fat in animals and some humans. Here we show that trans-10, cis-12 CLA, but not cis-9, trans-11 CLA, when added to cultures of stromal vascular cells containing newly differentiated human adipocytes, caused a time-dependent decrease in triglyceride content, insulin-stimulated glucose and fatty acid uptake, incorporation into lipid, and oxidation compared with controls. In parallel, gene expression of peroxisome proliferator-activated receptor-γ and many of its downstream targets were diminished by trans-10, cis-12 CLA, whereas leptin gene expression was increased. Law and ethics in population health are undergoing a renaissance. Once fashionable during the Industrial and Progressive eras, the ideals of population health began to wither with the rise of liberalism in the late twentieth century. In their place came a sharpened focus on personal and economic freedom. Political attention shifted from population health to individual health and from public health to private medicine.

This study is a continuation and the final phase of the SPR-2338 project that involves monitoring the ambient air quality levels adjacent to the Borman Expressway. The purpose of this phase was to classify the traffic conditions along the Borman Expressway in terms of ambient air quality levels. The duration of the phase was from April 1, 2002 to April 30, 2004. The study has shown that, in a close proximity to the Borman Expressway, air quality levels mirror the dynamic nature of traffic along the Borman, despite being surrounded by major industrial stationary sources. The Utility Accommodation Policy (UAP) is a collection of the regulations and practices to control the utility occupancy of all public highway rights-of-way under jurisdiction of the different States. UAPs not only help to regulate the installation of new utilities and the renovation of the currently installed by construction companies, subcontractors, and utilities companies, but also provide a framework to develop and preserve a safe roadside and to minimize possible interferences and impairment to the highway, its structures, appearance, safe operation, construction and maintenance. Children are a spur, a commitment, a way of imaging the future—but all too often these sorts of phrases just rattle around a vacuum, their utterance the beginning and end of the commitment. We emphasize “the best interests of the child,”but this gloss provides a moral imperative to all manner of uncompleted projects and unfulfilled policies. Likewise, the use of children’s images or presence in public forums of all types gives a patina of honorableness to practices and plans that never actually make good on the promissory note of childhood. Telling - or writing - a story about an event in your life is telling a social story. Autobiographical narrations are also, to be sure, personal and unique, but the social nature of narrating is often overlooked in research and education. In particular, to appreciate what young people are doing when we ask them to share their personal experiences in public institutions like school, we need a theory to guide our reading of narratives as conversations.

Part I describes the disruptive role the pari passu clause plays in sovereign debt compositions, stating the case favoring the narrow reading. Part II reconsiders the economic incentives in play at the time lenders close loans to sovereigns, stating a case for the broad reading. Part III works the competing readings through the legal framework of bond contract interpretation. The exercise shows that the matter comes down to a choice between an ex ante reading, conducted as of the time the contract is executed and delivered, and an ex post reading, conducted as of the later time of distress. In this Article, Professor Henning examines how schools and public housing authorities obtain juvenile records and explains how these institutions may use the records to exclude children and their families from the basic benefits of education and housing. Drawing on recent research in the field of developmental psychology, Professor Henning reevaluates early assumptions about adolescents' amenability to treatment and the impact of stigma on children and explores the practical implications of sharing records with schools and public housing authorities, questioning whether new confidentiality exceptions actually will yield the expected benefits of improved public safety. This Article examines the human rights of persons with mental disabilities and the application and development of these rights by the various international and regional systems that have been established to protect human rights. An international system of human rights with universal application has been developed under the auspices of the United Nations. Regional human rights systems have applied additional human rights protections to their respective geographic regions. Both the international and regional systems have addressed the human rights of persons with mental disabilities through treaties, declarations, and thematic resolutions. In Lawrence v. Texas, the Supreme Court performed a double move, creating a dramatic discursive moment: it both decriminalized consensual homosexual relations between adults, and, simultaneously, authorized a new regime of heightened regulation of homosexuality. An-Na'im as I read him is postulating a process theory when it comes to the relationship of Islamic law to international law. He is advocating a bargaining relationship in which the Islamic side and the international side meet as equals in negotiating their contributions to the universal international. This process-based equality can only be achieved if, first, the international eschews its We sternness and the Islamic retains its internal sense of diversity, indeed secularism. Service learning is a pedagogy providing a structured environment for students to link service with course learning objectives. Key to the service learning experience is critical reflection. This gives students the opportunity to examine their coursework in the context of the service they provide to their community and, in a broader sense, the impact they can have on the world. Research has shown that students participating in service learning have a higher comprehension of the course material and also develop an awareness of their local community and the issues it faces. Obstructive sleep apnea is a relatively common but under diagnosed clinical entity in children. Adenotonsillar hypertrophy is the most common cause for upper airway obstruction in pediatric patients. If the obstruction to upper airways is not relieved, then the child can develop obstructive sleep apnea and its consequences. Treatment is simply to remove the obstruction thereby restoring patency of upper airways
