The ancient concept of humanitarian intervention has become the subject of renewed debate and discussion at the inter-governmental level, within the non-governmental sector, and in the academy. This concept can be defined as the intervention into the territorial state by another state or a collective of states, with or without authorization from the United Nations Security Council, for the promotion or protection of basic human rights where the territorial state is perpetuating abuses or is unable or unwilling to provide the necessary protection to its inhabitants. Rethinking The Role Of The Dormant Commerce Clause In State Tax Jurisdiction, Bradley W. Joondeph

Perhaps the biggest controversy in state and local taxation today concerns the constitutional authority of the states to impose taxes on goods purchased over the Internet. Some argue that the current, bright-line rule of "physical presence" is the appropriate standard for determining a state's jurisdiction under the dormant Commerce Clause. Others contend that jurisdiction should instead be resolved on the more pragmatic basis of a firm's "economic presence" in the taxing state. Regardless, commentators seem to agree that the dormant Commerce Clause imposes jurisdictional limits on state taxation; the dispute concerns the content of those standards. Validating The Substance Abuse Subtle Screening Inventory For Identifying Substance Abuse Among Adolescents In A Residential Treatment Center, Ann Carol Singler

Purpose. This study examines the construct validity of the Substance Abuse Subtle Screening Inventory for Adolescents (SASSI-A) as a substance-abuse screening instrument for dual-diagnosed adolescents in a residential treatment center.

Method. Using archival records of 336 subjects from a long-term residential treatment center, this study applied a two-group comparison method to examine the construct validity of the SASSI-A for screening substance abuse among adolescents in a residential treatment center. Residents were initially clinically assessed by a state certified counselor as either substance abuser/chemically dependent or non-substance abuser/chemically dependent. Problem. An examination of Internet-based distance education (IBDE) is important in order to maintain the delivery of quality higher education and to encourage the systemic adoption of policies and practices that promote excellence in IBDE. The quality of online distance education will increasingly become the standard by which students choose a program as their educational options have multiplied with the dramatic growth in distance education.

Consumer Knowledge About Managed Care: A Comparison Of Lay-Consumers To Registered-Nurse Consumers, Elizabeth A. Byma

Orem’s self-care and self-care deficit theories provided the framework for this pilot study that compared lay and registered nurse consumers’ problems with and knowledge about their managed care plans. A distributed questionnaire assessed commonly experienced problems, reasons for problems, and preferred methods of obtaining information about their plan.The only significant difference between the two groups was that lay consumers were more likely to go to the ER without prior authorization (corrected Chi-sq. = 3.7, p = .03). The most firequently chosen reason ofboth groups for difficulty obtaining health care services was they did not know the rules of their managed …

The Challenge Of Cooperative Regulatory Relations After Enlargement, Francesca E. Bignami

This paper conceptualises European governance as a continuous series of collective action games among national regulators. European administration is theorized as a set of mutually beneficial relations among independent regulators, rather than as a hierarchy of supranational institutions, courts, and national administrators. The collective action approach highlights the importance of certain factors in fostering regulatory cooperation and enabling the common market to become an administrative reality: repeated interactions, monitoring and sanctioning by the Commission and the courts, reciprocity norms, and trust. It also suggests that one of the most significant challenges of enlargement will be to establish cooperative regulatory exchanges …

What Developments In Western Europe Tell Us About American Critiques Of Corporate Criminal Liability, Sara Sun Beale, Adam Safwat

Although corporate criminal liability has been recognized in the United States for nearly a century, contemporary academic commentators have questioned its legitimacy and argued that it is inferior to its alternatives: civil liability for the corporation and/or criminal liability for individual corporate agents. Other academic critics have attacked the present definitions of corporate criminal liability. In other words, although corporate criminal liability has also had its academic champions, it has been under attack in the United States. The situation in Europe poses a sharp contrast.

Sovereign Debt Reform And The Best Interest Of Creditors, William W. Bratton, G. Mitu Gulati

In April 2002 the International Monetary Fund introduced a sovereign bankruptcy proposal only to be rebuffed by the United States Treasury. Where the IMF wanted a mandatory bankruptcy regime, the Treasury wanted to solve distress problems with contractual devices. Sovereign bondholders and sovereign issuers themselves flatly rejected both proposals, even though they were nominally the beneficiaries of both proponents. This Article addresses and explains this bondholder reaction. In so doing, it takes a highly skeptical view of the IMF's proposal even as it shows that the incentive structure surrounding sovereign lending renders untenable the Treasury's contractarian proposal. The purpose of the project was to research the many aspects of personal training and gain knowledge and understanding of these aspects to help benefit perspective personal trainers, faculty, and personal career interest. The research design was interview based with an audio recording of each subject's responses. Ten adults participated in the research study. Results were collected into tabular format and correlations were made. Overall career success was attained to the amount of experience and education that each participant attained. Two hundred and sixteen pigs were weaned at 14 or 21 d of age to determine the effect of weaning age and commingling after the nursery phase on growth and behavior of pigs in a wean-to-finish facility. Pigs were divided into older and younger age groups and allotted 12 pigs/pen with nine replications of each group. At the end of the nursery phase (d 34 after weaning), one-half of the pigs in each group were removed and commingled for the grower/finisher phase and the other half remained in their original pens. Invasive plants decrease aboveground biodiversity and suitable wildlife habitat. Wetlands are especially valuable ecosystems because they provide habitat, floodwater control, and function as filters for urban runoff. Wetland soils also act as sinks for nutrients. This characteristic reduces levels of excess nutrients often found in adjacent aquatic systems. The importance of soil functions in wetlands necessitates further investigation of the effects of invasive species on belowground nutrient pools. Approximately 75% of a small neighborhood wetland located in Fayetteville, Ark., has been invaded by Lonicera japonica.
