On Locating Disaster, Brad Kallenberg Jan 2004

On Locating Disaster, Brad Kallenberg

Theology and Religious Studies Faculty Publications

Imagine a man, unknown to you, standing in your backyard calmly clasping and unclasping his hands three times each hour. If we ask "What is he doing?" we would not likely be satisfied with these words: "He's clasping his hands three times per hour." There is something unnerving about the whole scene, not only because we cannot comprehend the point of clasping one's hands three times per hour; we want to know, "What's he doing in my back yard?"

There is a similarly unnerving quality about the description of the Columbia disaster as posed by the case study. By it …

Law And Bioterrorism By Victoria Sutton (Book Review), Jeffrey F. Addicott Jan 2004

Law And Bioterrorism By Victoria Sutton (Book Review), Jeffrey F. Addicott

Faculty Articles

The best primer for constructing a legal framework surrounding bioterrorism is a wonderfully researched and incisive book by Professor Victoria Sutton. Sutton brings a vast background of experience and expertise to her book, titled Law and Bioterrorism, which is in fact the first legal textbook in the field of law and bioterrorism.

The book begins with a brief examination of the history of law and bioterrorism, from ancient biological warfare to modern times. Drawing upon the lessons of this history, Sutton discusses historical events such as the use of anthrax in World War I, and further examines the rapidly growing …

Program Transformations For Information Personalization, Saverio Perugini Jan 2004

Program Transformations For Information Personalization, Saverio Perugini

Computer Science Faculty Publications

Personalization constitutes the mechanisms and technologies necessary to customize information access to the end-user. It can be defined as the automatic adjustment of information content, structure, and presentation. The central thesis of this dissertation is that modeling interaction explicitly in a representation, and studying how partial information can be harnessed in it by program transformations to direct the flow of the interaction, can provide insight into, reveal opportunities for, and define a model for personalized interaction. To evaluate this thesis, a formal modeling methodology is developed for personalizing interactions with information systems, especially hierarchical hypermedia, based on program transformations. The …

Selling Mayberry: Communities And Individuals In Law And Economics, Peter Siegelman, Gideon Parchomovsky

Faculty Articles and Papers

In an unusual turn of events, American Electric Power Company recently acquired the entire small town of Cheshire, Ohio. The buyout was intended to put an end to a serious pollution problem caused by the company's giant power plant, which was located at the edge of town. Although the plant was worth substantially more than the town, no simple Coasean bargain guided the buyout. This Article combines ethnographic research into the Cheshire buyout with theoretical insights from law and economics to present an empirical and theoretic challenge to the standard account of nuisance disputes. It explores the transaction in detail …

Indian Policy And The Imagined Indian Woman, Bethany Berger Jan 2004

Indian Policy And The Imagined Indian Woman, Bethany Berger

Faculty Articles and Papers

In this contribution to the symposium on Santa Clara Pueblo v. Martinez held by the Tribal Law Center at the University of Kansas, I reflect (with pictures!) on the role of women in federal American Indian policy and tie this history to current debates about the Martinez decision. I argue that the perception by non-Indians that they were riding to the rescue of oppressed and exploited Indian women was always a powerful justification for Indian policy, but that the Indian women whose plight called out for European and American protection were not real women, but were instead imagined by the …

The International Criminal Court's Quest To Protect Rape Victims Of Armed Conflict: Anonymity As The Solution, Sylvia Pieslak Jan 2004

The International Criminal Court's Quest To Protect Rape Victims Of Armed Conflict: Anonymity As The Solution, Sylvia Pieslak

Santa Clara Journal of International Law

In response to the use of rape as a wartime strategy, modern international criminal courts and tribunals have developed laws and customs to prosecute perpetrators while protecting victims and witnesses. This note addresses protection for rape victims by critically analyzing the statutes and rules of procedure and evidence for the International Criminal Court and the two war crimes tribunals, the ICTY and the ICTR. By comparing and contrasting the ICC provisions with the ICTY and ICTR, the author shows not only how the ICC created a more comprehensive victim protection program than the others, but also gives insights into the …

Mainstreaming Complementary And Alternative Medicine In The Face Of Uncertainty, Barbara L. Atwell

Elisabeth Haub School of Law Faculty Publications

Part I of this article provides an overview of the medical necessity test, and examines the decision-making process pursuant to the test, including who makes coverage determinations and what criteria are used in making them. Part I also sets forth examples of conventional treatments that insurers routinely cover despite their questionable efficacy from a medical necessity perspective. Part II explores CAM disciplines and describes how they differ from conventional medicine. Part III discusses the legal challenges CAM faces and explores the limited extent to which CAM is covered by health insurance and the failure of state laws to provide mandates …

(Under)Mining The Seabed? Between The International Seabed Authority Mining Code And Sustainable Bioprospecting Of Hydrothermal Vent Ecosystems In The Seabed Area: Taking Precaution Seriously, Ikechi Mgbeoji Jan 2004

(Under)Mining The Seabed? Between The International Seabed Authority Mining Code And Sustainable Bioprospecting Of Hydrothermal Vent Ecosystems In The Seabed Area: Taking Precaution Seriously, Ikechi Mgbeoji

Articles & Book Chapters

Rapid developments in marine biotechnology and the prospect of sea-bed mining have exposed the inadequacy of legal frameworks to regulation the exploration exploitation, and sharing of the benefits that arise from such marine endeavors. The fact of the matter is that despite the giant strides made in and the huge financial stakes involved in bioprospecting of hydro-thermal vent ecosystems, legal issues raised by profitable biotechnology development through marine scientific research (MSR) are still at an infant and underdeveloped stage. This article evaluates the extent to which the present legal order for the mining of seabed polymetallic nodules with its tangential …

Fruits, Nuts, Cigarettes, And The Right To Remain Silent, Christine Esperanza Jan 2004

Fruits, Nuts, Cigarettes, And The Right To Remain Silent, Christine Esperanza

UC Law Constitutional Quarterly

The First Amendment not only protects against limitations on one's speech but against governmentally compelled speech as well. Although the Supreme Court afforded increasing protection to commercial speech, a majority later held that an analysis of compelled advertising in this context did not raise First Amendment issues. In United States v. United Foods. No. 00276 (June 25, 2001), the United States Supreme Court revisited this issue, holding that "the mandated support is contrary to the First Amendment principles set forth in cases involving expression by groups which include persons who object to speech, but who, nevertheless, must remain members of …
