Children And Television : A Literature Review Of The Influence Of Television On Children From 1970-2000, Lisa Suwalski Jan 2004

Children And Television : A Literature Review Of The Influence Of Television On Children From 1970-2000, Lisa Suwalski

Honors Capstones

This review focused on television's influences on children in the period from 1970 to 2000. This review is important because of the explanations it presents for the arguments made by numerous researchers about the effects of television on society, and how the influence changed society from 1970 to 2000. A valuable aspect of this review was that if television was considered a medium that changes, and was continually refined, why did only certain issues catch the attention of researchers? Often, in each separate decade, similar types of influences of television on children arose and were repeatedly studied by the researchers. …

Male Sexual Assault: Issues Of Arousal And Consent, Siegmund Fred Fuchs Jan 2004

Male Sexual Assault: Issues Of Arousal And Consent, Siegmund Fred Fuchs

Cleveland State Law Review

This Note argues that an erection under these circumstances does not indicate consent to engage in sexual activity. Part II of this Note explores the reality of male sexual assault and offers various medical, psychological, sociological, and cultural reasons to explain why a male victim may maintain an erection while being sexually assaulted and/or raped. Part II also explores the complex relationship between physical arousal and sexual desire. Part III provides a legal background to both the law's treatment of male sexual assault generally and in specific instances where the male victim maintained an erection during his assault. This part …

An Ohio Dilemma: Race, Equal Protection, And The Unfulfilled Promise Of A State Bill Of Rights, Jonathan L. Entin Jan 2004

An Ohio Dilemma: Race, Equal Protection, And The Unfulfilled Promise Of A State Bill Of Rights, Jonathan L. Entin

Cleveland State Law Review

Race was a central issue in Ohio from the very beginning. The original state constitution of 1802 and the successor constitution of 1851 explicitly limited suffrage to whites even as both documents forbade slavery. Moreover, the legislature imposed various legal disabilities and restrictions on African Americans. For much of the Nineteenth Century, however, the Ohio Supreme Court tried to narrow the scope of those restrictions by developing a distinctive jurisprudence that was in some respects more progressive, and in general less obnoxious, than that developed in other states and by the U.S. Supreme Court. Before the end of the century, …

In Search Of The Golden Years: How Compulsory Licensing Can Lower The Price Of Prescription Drugs For Millions Of Senior Citizens In The United States, Debjani Roy

Cleveland State Law Review

This article will show that compulsory licensing is the best remedy for the escalating cost of prescription drugs in the United States. Section II will provide a historical overview of American pharmaceutical patent law and will introduce the concept of compulsory licensing as a method to decrease the high cost of prescription drugs for senior citizens in the United States. Section III will look at the newly enacted Medicare Prescription Drug and Modernization Act, and state and local government plans to import cheaper brand-name prescription drugs from Canada. Section IV will look at the United States' international support for compulsory …

Divorce Child Custody Mediation: In Order To Form A More Perfect Disunion , Ben Barlow Jan 2004

Divorce Child Custody Mediation: In Order To Form A More Perfect Disunion , Ben Barlow

Cleveland State Law Review

The adversarial process serves its purpose in our society; however, that does not mean that there are not better ways to handle specific cases. To that end, nonadversarial systems offer tremendous potential in civil litigation, in governmental relations, in neighborhood and family conflicts, and, especially, in divorce child custody cases. If mediation statutes are contemplated for the sole purpose of judicial economy, discretionary statutes are sufficient. For the true value of mediation to be experienced, however, a mandatory scheme containing safeguards for cases involving domestic violence should be implemented.Understandably, many mediators are leery of the effect that mandatory schemes have …

This One's For The Children: The Time Has Come To Hold Guardians Ad Litem Responsible For Negligent Injury And Death To Their Charges, Inga Laurent Jan 2004

This One's For The Children: The Time Has Come To Hold Guardians Ad Litem Responsible For Negligent Injury And Death To Their Charges, Inga Laurent

Cleveland State Law Review

Absolute immunity has historic justifications but it also represents one of the major failures of the modem child welfare system. Attorneys who act as guardians are granted absolute immunity, which serves as a shield that excuses them from being accountable for the consequences of their actions. Without presentation of a defense, all the parties involved are left to speculate as to whether the guardian adequately performed the necessary duties to protect the child. Immunity also perpetuates maintenance of the status quo rather than moving toward improved systems of care and accountability. Section II of this note provides an overview of …

Virtuous Judges And Electoral Politics: A Contradiction?, Marie Failinger Jan 2004

Virtuous Judges And Electoral Politics: A Contradiction?, Marie Failinger

Faculty Scholarship

Judge Thomas J. Spargo serves as a fascinating poster-child in the debate on what’s wrong (or right) with judicial elections. Judge Spargo, campaigning for re-election as Justice of the Berne Town Court in upstate New York, was accused of “failing to observe the high standards of conduct” expected as a judge because he handed out doughnuts to voters. Judge Spargo’s case and others illustrate that popular debates about the merits of judicial elections versus judicial selection commissions have probably been mis-focused on two “second-order questions rather than concentrating on “first-order” concerns in judicial selection. This article discusses these questions and …

International Tourism, Demand, And Gdp Implications: A Background And Empirical Analysis, Michael Brakke Jan 2004

International Tourism, Demand, And Gdp Implications: A Background And Empirical Analysis, Michael Brakke

Undergraduate Economic Review

International tourism, a primary source of growth for many countries, is inadequately represented in the economic literature. This paper attempts to expand upon past research, thereby supplementing some deficiencies and posing new questions. A pooled model for international tourism demand is constructed for 85 countries using fixed-effects specification. In addition to conventional variables, a variable representing political conditions acts as a proxy for the many exogenous impacts that affect tourism. The nature of tourism volatility due to the exogenous shocks is discussed, and a statistical link between concentrations in tourism as an export good and GDP volatility is explored.

The Case For Cautious Optimism: California Environmental Propositions In The Late Twentieth Century, Marie Bolton, Nancy Unger Jan 2004

The Case For Cautious Optimism: California Environmental Propositions In The Late Twentieth Century, Marie Bolton, Nancy Unger

History

The efficacy of direct democracy throughout California's history continues to be a subject of intense debate, a state-wide phenomenon with an international audience. California boasts the world's fifth largest economy, and plays a leadership role in national, and sometimes even international, politics. British scholar Wyn Grant, studying the politics of air quality management in California, succinctly sums up the burning issue for environmentalists worldwide who are striving to understand the efficacy of California's activists' efforts: in "Direct Democracy in California: Example or Warning?" Grant concludes that although direct democracy has its merits, its history in California ultimately provides more of …

Calcium Activation Of Erk Mediated By Calmodulin Kinase I, John M. Schmitt, Gary A. Wayman, Naohito Nozaki, Thomas R. Soderling Jan 2004

Calcium Activation Of Erk Mediated By Calmodulin Kinase I, John M. Schmitt, Gary A. Wayman, Naohito Nozaki, Thomas R. Soderling

Faculty Publications - Department of Biological & Molecular Science

Elevated intracellular Ca2+ triggers numerous signaling pathways including protein kinases such as the calmodulin-dependent kinases (CaMKs) and the extracellular signal-regulated kinases (ERKs). In the present study we examined Ca2- dependent “cross-talk” between these two protein kinase families. Using a combination of pharmacological inhibitors and dominant- negative kinases (dnKinase), we identified a requirement for CaMKK acting through CaMKI in the stimulation of ERKs upon depolarization of the neuroblastoma cell line, NG108. Depolarization stimulated prolonged ERK and JNK activation that was blocked by the CaMKK inhibitor, STO-609; this inhibition of ERK activation by STO-609 was rescued by expression of a STO-609-insensitive mutant …

Community Impacts Of Coastal Tourism In The Dominican Republic, Yolanda M. Leon Jan 2004

Community Impacts Of Coastal Tourism In The Dominican Republic, Yolanda M. Leon

Open Access Dissertations

The present work presents the results of survey research conducted in 23 coastal communities of the Dominican Republic to evaluate the impacts of tourism and also the evaluation of a particular co-management system of a tourism-related activity (whale watching in Samaná Bay). Major findings include that tourism is having a positive impact on rural livelihoods as measured by increased household income, and higher levels of job satisfaction (and in the case of female-headed households, also improved material well-being). We also evidenced strong local support for the tourism industry caused by wide agreement on perceived tourism benefits; however, residents are also …

A Tale Of Two Jurisdictions And An Orphan Case: Antitrust, Intellectual Property, And Refusals To Deal, Eleanor M. Fox Jan 2004

A Tale Of Two Jurisdictions And An Orphan Case: Antitrust, Intellectual Property, And Refusals To Deal, Eleanor M. Fox

Fordham International Law Journal

This Essay examines both the U.S. law and the EU law through the window of a recent U.S. case: New York Mercantile Exchange v. Intercontinental Exchange (“NYMEX”). The NYMEX facts are similar in concept to the facts in IMS but present a stronger case for liability. The Essay argues that the opinion in NYMEX, along with a growing set of U.S. cases, interprets Trinko to impose rigid requirements on a Section 2 plaintiff, not all of which are inherent in Trinko. It argues that the formalistic post-Trinko analysis, which would require dismissal of cases that do not fit within one …
