Annual Report 2003-2004, Imsa Fund

IMSA Fund Reports

Acting on beliefs...stepping up for IMSA. That is what you have done, and we truly appreciate your support.

Gifts and grants from the private sector advance and support IMSA program needs that cannot be funded in other ways, seed innovation and enable IMSA to pilot promising new initiatives. They also support the operations of the IMSA Fund, activities of the IMSA Alumni Association and the IMSA Parents Association Council, not to mention unexpected opportunities and emergency needs that arise. Unrestricted gifts are especially important because they provide the most flexibility for allocation where the need is greatest.

William Thomas Thornton’S Career At East India House: 1836–1880, Mark Donoghue Jan 2004

William Thomas Thornton’S Career At East India House: 1836–1880, Mark Donoghue

Business Papers and Journal Articles

Some recent work on William Thornton (1813–1880), culminating in Philip Mirowski and Steven Tradewell’s recently published Economic Writings of William Thornton (1999), seeks to cement his place in the history of nineteenth-century economics (see Donoghue 2002). But despite the notoriety Thornton achieved through his role in the wage-fund debates of the 1860s and 1870s, few commentators have explored other aspects of his work, particularly his prescient remarks on the nature of economic, political, and social reform in India.1 This absence is somewhat surprising because, for much of his professional career, Thornton served the East India Company at its …

Developing And Implementing Statewide Prevention/Early Intervention, Victor Nossar, Pam Linke Jan 2004

Developing And Implementing Statewide Prevention/Early Intervention, Victor Nossar, Pam Linke

Medical Conference Papers

Over the last decade it has been clearer that improvements in population health require different strategies, beyond the application of larger scale clinical interventions. Experience teaches that more focus needs to be given to the determinants of health and of health problems and to strategies that build systems to make a measurable difference in the outcomes for children. South Australia is in a relatively unique position, in Australia, of having a State wide child and family health service. This offers both opportunity and challenge to the development of a population based early intervention across metropolitan, regional and remote areas.

Relationship Between Early Feeding And Communication Development In Infants: Birth To 12 Months, S J. Massey, Kathryn Hird, K Simmer Jan 2004

Relationship Between Early Feeding And Communication Development In Infants: Birth To 12 Months, S J. Massey, Kathryn Hird, K Simmer

Medical Conference Papers

Introduction: Anecdotal reports suggest that infants experiencing early feeding difficulties may have delays in communication development.

Methods: The first stage of the study involved the development of a theoretically based assessment protocol to test the hypothesis of linked or independent processes required for feeding and speech. The assessment protocol will be piloted on 10 full term and 10 preterm infants at birth, 4, 8 and 12 months post term age. Measures of inter-judge and intra-judge reliability will also be taken of the observation protocol. Observation of the infant's language, speech, environment and maternal relationship will also be conducted to determine …

Saying These Things, Ronald Moran Jan 2004

Saying These Things, Ronald Moran

Fiction & Poetry

"Ron Moran's poetry immediately leaps from the page to the feet and ankles of the reader's experience. You're on the sidewalk with his characters, you're a flash dancer in his every scenario. He stole one of your monologues right out of your own phone conversation—how does he do that? Across the board, and no matter the particular style of the Moran day, his poems are the view across the street, the dinner beside you at the restaurant, and they are, if you were a poet, too, the outrageously creative language experience you wish you'd have in you."--Jennifer Bosveld, Pudding House …

The Reactivity Of Dissolved Organic Matter For Disinfection By-Product Formation, Mehmet Kitis, Tanju Karanfil, James E. Kilduff Jan 2004

The Reactivity Of Dissolved Organic Matter For Disinfection By-Product Formation, Mehmet Kitis, Tanju Karanfil, James E. Kilduff

Publications

Dissolved organic matter (DOM) in 6 water samples collected from 4 surface waters were fractionated using some or all of 5 physicochemical separation processes (activated carbon and XAD-8 batch adsorption, alum coagulation, ultrafiltration (UF), and XAD-8 column fractionation). Activated carbon, XAD-8 batch adsorption and alum coagulation processes fractionated DOM by preferentially removing high-SUVA components from solution. The XAD-8 column method fractionated DOM into hydrophobic and hydrophilic components while UF separated DOM into different size fractions. Over 40 DOM fractions, characterized using carbon-normalized (specific) ultraviolet absorbance (SUVA), were obtained for each water. Trihalomethane (THM) and haloacetic acid (HAA_9) formation after chlorination …

Hungry, Hungry Hippa: When Privacy Regulations Go Too Far, Meredith Kapushion Jan 2004

Hungry, Hungry Hippa: When Privacy Regulations Go Too Far, Meredith Kapushion

Fordham Urban Law Journal

This Comment explores the constructs and consequences of the Health Insurance Portability and Accountability Act of 1966 (“HIPAA”). HIPPA imposes considerable regulatory burdens on health care organizations in the hope that strict administration and control of information will prevent both real and perceived injuries from unauthorized and unwanted scrutiny of personal health data. In outlining the nature of HIPPA, the author presents what in her view are the Act’s shortcomings – HIPPA’s high costs, questionable benefits, and numerous economic, legal, and administrative consequences. As a result, the author presents alternatives to HIPPA that are less intrusive but still address the …

Housing Gideon: The Right To Counsel In Eviction Cases , Rachel Kleinman Jan 2004

Housing Gideon: The Right To Counsel In Eviction Cases , Rachel Kleinman

Fordham Urban Law Journal

While the legal system recognizes an indigent’s constitutional right to counsel in a criminal trial the same is not true with respect to civil cases. This Comment examines this legal reality by focusing specifically on an indigent’s inability to gain access to counsel within the confines of eviction proceedings. The author lays out the arguments for both those who favor recognizing an indigent’s right to counsel in eviction proceedings and those opposed to recognizing that right. Ultimately, absent an indigent’s access to counsel in these civil cases, their ability to have any sort of meaningful access to justice is seriously …

Fordham Urban Law Journal

The Article notes the resistance that Brown faced, especially from political forces who began to subvert the desegregation process, and examines the Supreme Court's subsequent decisions which aimed to secure Brown's objectives. The Article also examines the desegregation attempts in the North and discusses the difficulties plaintiffs faced in proving racial discrimination in school districts. The Article concludes by stating that the commitment to desegregation is waring and that segregation …

How Much Protection Do Injunctions Against Enforcement Of Allegedly Unconstitutional Statutes Provide?, Vikram David Amar Jan 2004

How Much Protection Do Injunctions Against Enforcement Of Allegedly Unconstitutional Statutes Provide?, Vikram David Amar

Fordham Urban Law Journal

This essay addresses the unresolved effects of preliminary injunctions issued by federal district courts in response to legislation that is possibly unconstitutional. More problematically, set against the backdrop of the "Partial Birth Abortion Ban Act of 2003," the essay asks whether an individual who violates the contested statute after receiving a preliminary injunction from a federal district court may be prosecuted if the statute is later upheld as constitutional. The essay analyzes competing arguments by Justice Stevens and Justice Marshall in Edgar v. MITE Corp., which involved a federal preliminary injunction against enforcement of a state statute. Siding with Justice …

The Abortion Debate Thirty Years Later: From Choice To Coercion, Maureen Kramlich Jan 2004

The Abortion Debate Thirty Years Later: From Choice To Coercion, Maureen Kramlich

Fordham Urban Law Journal

This article critiques the notion of abortion as a "positive liberty." The author argues that the court's holding in Roe v. Wade created a negative right to abortion, meaning that an individual seeking an abortion is merely protected from government interference. Over time, "pro-abortion" advocates have sought a positive right to access an abortion, including government funding. The author finds this position problematic and outside the scope of Roe, particularly as it erodes religious healthcare providers' right to refuse to perform the procedure.

Lethal Experimentation On Human Beings: Roe's Effect On Bioethics, William L. Saunders, Jr. Jan 2004

Lethal Experimentation On Human Beings: Roe's Effect On Bioethics, William L. Saunders, Jr.

Fordham Urban Law Journal

Beginning with the assumption that human life begins at conception, this article explores the problematic terrain accompanying embryonic stem cell research and human cloning. "Lethal Experimentation on Human Beings," as enumerated in the article's title, refers to experimentation on and the removal of stem cells from human embryos, both of which "kill" a human being. The article warns that the holding in Roe v. Wade, which recognizes only a qualified government interest in unborn life, has obscured a pressing need for proponents of embryonic stem cell research to prove why society's interest in this research outweighs the rights of the …

Conference Report: New York City's Criminal Courts Are We Achieving Justice?, Martha Rayner Jan 2004

Conference Report: New York City's Criminal Courts Are We Achieving Justice?, Martha Rayner

Fordham Urban Law Journal

On October 18, 2003, more than one hundred professionals from the five boroughs of New York City came together to identify, evaluate, and begin to solve some of the complex problems embedded in the culture, operations, and practice in New York City's Criminal Courts. The conference planners focused on five problems that have undermined the pursuit of justice in New York City’s Criminal Court system for decades. The first group, Arraignment Norms, Practices and Culture, targeted professionalism and justice at the first and often last court appearance for people arrested and charged with misdemeanor crimes in New York City. The …
