Mpdls Is Not A Disease: A Proposition For A Model Punitive Damage Limiting Statute In Light Of The Constitutional Guideposts From Bmw And State Farm, Christopher Price

St. Thomas Law Review

What would a football game be without the first down marker? Perhaps it would result in confusion, frustration and ultimately an arbitrary decision by a referee to determine what is and what is not a first down. In the same vein as a football game played without first down markers, a court attempting to impose punitive damages without clear and distinguished markers will likely render inconsistent and perhaps even unfair decisions. The United States Supreme Court in State Farm v. Campbell' ignored an opportunity to establish a bright-line test for lower courts to confidently impose punitive damages without running afoul …

The State Farm Punitive Damage Multiplier In The Courts: Early Returns, Charles S. Doskow Jan 2004

The State Farm Punitive Damage Multiplier In The Courts: Early Returns, Charles S. Doskow

St. Thomas Law Review

On May 22, 1981, on a two-lane highway in rural Utah, Curtis Campbell attempted to pass six tractor-trailers.' He was not successful. When the wreckage cleared, the driver of an oncoming car was dead, the driver of one of the cars in line ahead of him was paralyzed, and the United States Supreme Court's punitive damages jurisprudence suddenly exploded. In one fell swoop, the United States Supreme Court, with the aid of the bad faith of State Farm Mutual Automobile Insurance Company ("State Farm"), led by the editorial page of the Wall Street Journal, accomplished what the business community of …

The Terminator Patent And Its Discontents: Rethinking The Normative Deficit In Utility Test Of Modern Patent Law, Ikechi Mgbeoji Jan 2004

The Terminator Patent And Its Discontents: Rethinking The Normative Deficit In Utility Test Of Modern Patent Law, Ikechi Mgbeoji

St. Thomas Law Review

For clarity of analysis, this article is divided into three parts. In the first part, I introduce the technologies of GURTs (Genetic Use Restriction Technologies) and their main characteristics. In the second part, I examine the origins and policy foundations of the patent system, particularly how the courts in various jurisdictions have defined the concept of utility. The second part also explores the evolution of the requirement of utility and its contemporary emergence as a secular, technical test with emphasis on mechanical operability of inventions. The third part of this article explores the nature of GURT patents vis-a-vis their compatibility …

Fire In Southern Appalachians: Fuels, Stand Structure And Oaks, David L. Loftis, Mary A. Arthur, Rex Mann, Jeffrey Lewis Jan 2004

Fire In Southern Appalachians: Fuels, Stand Structure And Oaks, David L. Loftis, Mary A. Arthur, Rex Mann, Jeffrey Lewis

Joint Fire Science Program Research Project Reports

Managers responsible for maintaining the diversity and productivity of Southern Appalachian forests are increasingly turning to prescribed fire as an important management tool in oak dominated forests. The decision to use fire with increasing frequency and spatial extent is based, in part, on an emerging sense of the prehistoric significance of fire in this landscape and its potential to control the proliferation of fire-sensitive competitors in contemporary forests. While it is well documented that fire has been an important ecological force in Southern Appalachian forests for a very long time, there has been little research to demonstrate that prescribed fire …

Bovine Tuberculosis In Swedish Farmed Deer: Detection And Control Of The Disease, Helene Wahlström Jan 2004

Bovine Tuberculosis In Swedish Farmed Deer: Detection And Control Of The Disease, Helene Wahlström

Michigan Bovine Tuberculosis Bibliography and Database

Bovine tuberculosis (BTB) was introduced into Swedish farmed deer herds in 1987. Epidemiological investigations showed that 10 deer herds had become infected (July 1994) and a common source of infection, a consignment of 168 imported farmed fallow deer, was identified (I).

As trace-back of all imported and in-contact deer was not possible, a control program, based on tuberculin testing, was implemented in July 1994. As Sweden has been free from BTB since 1958, few practicing veterinarians had experience in tuberculin testing. In this test, result relies on the skill, experience and conscientiousness of the testing veterinarian. Deficiencies in performing the …

Rural Development Through Pork Production: The Nebraska Model

Nebraska’s producers of pork are striving to create systems of production that are environmentally, economically & socially acceptable.
This is no small challenge. While attempting to comply with environmental rules, producers are faced with the rules changing as they implement adoption. Social acceptance varies with locale but is generally less positive than in the past. And, Fewer operations have livestock and fewer people in the rural population rely on livestock for their livelihoods—which makes any livestock production operation less acceptable.
The issues facing all agricultural producers today are more complex and difficult …

New BSE Rule Will Change Re-Feeding of Poultry Litter to Ruminants

The Food and Drug Administration announced on January 26, 2004 several new public health measures, to be implemented, to strengthen significantly the multiple existing firewalls that protect Americans from exposure to the agent thought to cause bovine spongiform encephalopathy (BSE, also known as mad cow disease) and that help prevent the spread of BSE in U.S. cattle. One of those changes will impact how re-feeding of waste to animals is allowed.
To implement these new protections, FDA will publish two interim final rules that will take effect immediately upon …

Smart Materials, Precision Sensors/Actuators, Smart Structures, And Structronic Systems, H. S. Tzou, H.-J. Lee, S. M. Arnold Jan 2004

Smart Materials, Precision Sensors/Actuators, Smart Structures, And Structronic Systems, H. S. Tzou, H.-J. Lee, S. M. Arnold

United States National Aeronautics and Space Administration: Publications

Many electroactive functional materials have been used in small- and microscale transducers and precision mechatronic control systems for years. It was not until the mid-1980s that scientists started integrating electroactive materials with large-scale structures as in situ sensors and/or actuators, thus introducing the concept of smart materials, smart structures, and structronic systems. This paper provides an overview of present smart materials and their sensor/actuator/structure applications. Fundamental multifield optomagnetopiezoelectric-thermoelastic behaviors and novel transducer technologies applied to complex multifield problems involving elastic, electric, temperature, magnetic, light, and other interactions are emphasized. Material histories, characteristics, material varieties, limitations, sensor/actuator/structure applications, and so forth …

Analysis Of Factors That Influence Member Turnover In A Health Insurance Plan, Sara Bennett Jan 2004

Analysis Of Factors That Influence Member Turnover In A Health Insurance Plan, Sara Bennett

Electronic Theses and Dissertations

In this research, we implement a multiple logistic regression model in which the coefficients of indicator variables are constrained to be zero or positive. By doing this, the contribution of each variable to the failure probability can be assessed. Due to this restriction on the coefficients, a Bayesian approach to parameter estimation--which assigns mixture priors to the coefficients--is taken. The data is provided by a large health insurance company in Western Pennsylvania and includes the enrollment status and corresponding values of the 84 predictor variables for 1,280,612 individuals. The insurer feels the analysis is needed to determine why its membership …

A Historical Study Of The Emergence Of Social Movements: Case Study Of The Sierra Leone Women's Forum In The 1990s, Agnes Mariama Farma Jan 2004

A Historical Study Of The Emergence Of Social Movements: Case Study Of The Sierra Leone Women's Forum In The 1990s, Agnes Mariama Farma

Electronic Theses and Dissertations

The emergence of the Women's Forum during the 1990's in Sierra Leone is analyzed using the political process model proposed by Douglas McAdam. The strength of the indigenous organizations, the political opportunities presented by the civil strife of the period and the emergence of insurgency consciousness on the part of the women of Sierra Leone were identified as significant in contributing to the success of the movement in bringing an end to the civil war and influencing the peace process to address women's issues, indicating the usefulness of this model in analyzing the emergence of social movements in the Sierra …

Identification Of Protein Interaction Between The Drosophila Runx1 Transcription Factor Lozenge And Ets-1 Factor Pointed Using Site Directed Mutagenesis And Yeast Two-Hybrid Analysis, Shalini Singh Jan 2004

Identification Of Protein Interaction Between The Drosophila Runx1 Transcription Factor Lozenge And Ets-1 Factor Pointed Using Site Directed Mutagenesis And Yeast Two-Hybrid Analysis, Shalini Singh

Electronic Theses and Dissertations

Many classes of transcriptional regulatory proteins are known to function in both cell proliferation and differentiation. Runx1 proteins one such family of transcription factors, plays critical roles in hematopoiesis, osteogenesis and leukemogenesis and act as promoter organizers that cooperate with other transcription factors such as Ets-1 in the regulation of gene activation or repression. Genes that are regulated by the Runx1-Ets1 complex, frequently have multiple, adjacent consensus binding sites in their promoters. I have investigated a similar interaction in developing fly eye. Lozenge (DmRunx1) and Pointed P2 (DmEts-1) cooperate to upregulate expression of prospero, which has multiple Lz and Ets …

Defining The Church's Advocacy Role To The Modern Prison System, Timothy Swope Jan 2004

Defining The Church's Advocacy Role To The Modern Prison System, Timothy Swope

Electronic Theses and Dissertations

This dissertation, "Defining the Church's Advocacy Role to the Modern Prison System," is developed from the Catholic Church's social thought over the past century and the episcopal teaching of the American bishops over the past three decades. Chapter one reviews the concept of 'advocate' and the Church's advocacy role to the poor, oppressed, and marginalized. Chapter two reviews the episcopal statements concerning the advocacy role to the prisons and the question of the death penalty in general.

Before defining the specific role of the Church to the prison system, this role of advocacy must deal with the question of Church …
