Recent Supreme Court cases regarding Congress's abrogation authority have seriously impaired Congress's ability to demonstrate a valid exercise of its Section 5 power under the Fourteenth Amendment to subject nonconsenting states to suit for money damages in federal court. During its 2003 term, the Supreme Court has again granted certiorari to a case involving the proper scope of Congress's section 5 power, Lane v. Tennessee. Lane involves a suit for money damages under Title II of the ADA based on the alleged failure of the State of Tennessee to make its courthouses accessible. Many commentators suggest that the Supreme Court …

Recently, the federal circuit courts of appeal have divided in addressing to what extent either Title VI of the Civil Rights Act of 1964 or Title IX of the Education Amendments of 1972 protects those who complain about racial or gender discrimination from retaliation by their employers or schools. Neither Title VI nor Title IX explicitly prohibits retaliation by recipients. However, various federal agencies have issued specific Title VI or IX regulations that explicitly prohibit retaliation by recipients. Title IX "was modeled after Title VI . . ., which is parallel to Title IX except that it prohibits race discrimination, …

Natural History And Sexual Dimorphism Of The Eastern Hellbender, Cryptobranchus A. Alleganiensis, Robert Makowsky Jan 2004

Natural History And Sexual Dimorphism Of The Eastern Hellbender, Cryptobranchus A. Alleganiensis, Robert Makowsky

Theses, Dissertations and Capstones

The Eastern Hellbender’s natural history and morphology was examined. Field studies were done to examine the efficacy of different techniques (focusing on capturing larva) and diet analysis. Lab studies were done to determine if any sexual dimorphism exists in hellbenders using simple measurements (and ratios) and if this dimorphism could be used to reliably determine gender. Field studies were inconclusive due to the inability to find a reliable sample because of record rainfall. Lab studies revealed that a dimorphism does exist for one ratio (TG/TL, P=.048) and for several measurements. These measurements alone were not applicable for determining gender. …

Difficulties In Recognizing And Treating Depression In The Elderly : Implications For Counselors, Kristin A. Schloemer Jan 2004

Difficulties In Recognizing And Treating Depression In The Elderly : Implications For Counselors, Kristin A. Schloemer

Graduate Research Papers

Diagnosing elderly depression is a difficult, overlooked process. Many elderly seek out family physicians, but few visit mental healthcare professionals (Lyness et al., 1997; Sable & Dunn, 2002). As elderly may not display traditional depressive symptoms, it is necessary to distinguish between depression, bereavement, and illness, all common in late life. Once depression has been diagnosed, treatments including: medication, psychotherapy, or perhaps the most …
