The Changing World Of Employee Benefits, Maria O'Brien Hylton Jun 2004

The Changing World Of Employee Benefits, Maria O'Brien Hylton

Chicago-Kent Law Review

The employee benefits picture, at least for many plan participants and some plan sponsors, is a scary and bleak one. The number of workers with pension coverage is declining, health insurance rates are rising much faster than the rate of inflation, and the number of uninsured continues to rise as well. The decline in union density, the recent boost given by the U.S. Supreme Court to Any Willing Provider ("AWP") laws, and the deluge of recent benefits-related scandals are also all part of this landscape. This Article examines each of these issues, with a focus on reforms that would increase …

Pedestrian Safety And Transit Corridors, Paul Mitchell Hess, Anne Vernez Moudon, Julie M. Matlick Jun 2004

Pedestrian Safety And Transit Corridors, Paul Mitchell Hess, Anne Vernez Moudon, Julie M. Matlick

Journal of Public Transportation

This research examines the relationship between pedestrian accident locations on state-owned facilities (highways and urban arterials) and the presence of riders loading and alighting from bus transit. Many state facilities are important metropolitan transit corridors with large numbers of bus stops users, resulting in increased exposure of pedestrians to traffic and in increased numbers of collisions. The research also examines the association between pedestrian collisions and other travel generators (concentrations of retail activity and housing) as well as environmental conditions (wide roadways, high traffic volumes, and high speed limits). Based on a retrospective sampling approach and logistic regression models, the …

Transit Price Elasticities And Cross - Elasticities, Todd Litman Jun 2004

Transit Price Elasticities And Cross - Elasticities, Todd Litman

Journal of Public Transportation

This article summarizes price elasticities and cross-elasticities for use in public transit planning. It describes elasticities and how they are used, and examines previous research on transit elasticities. Commonly used transit elasticity values are largely based on studies of short- and medium-run impacts performed decades ago when real incomes where lower and a larger portion of the population was transit dependent. As a result, they tend to be lower than appropriate to model long-run impacts. Analysis based on these elasticity values tends to understate the potential of transit fare reductions and service improvements to reduce problems, such as traffic congestion …

The Networking Economic Effects Of Whiteness, Brant T. Lee Jun 2004

The Networking Economic Effects Of Whiteness, Brant T. Lee

American University Law Review

Network economic analysis provides an important and intuitive explanation of racial inequality. In short, Whiteness is Microsoft's Windows operating system, or the QWERTY keyboard, or the standard (non-metric) measurement system, and difficult to dislodge for many of the same reasons. Network effects explain how the establishment of a dominant market standard 1) can be contingent on historical context, 2) does not necessarily derive from superior intrinsic merit, and 3) exhibits strong self-reinforcing characteristics that can maintain the dominance of the standard in perpetuity, even in the absence of any explicit or conscious determination to maintain it. All of these factors …

On The Effects Of Device Mobility Upon Resource-Sharing In A Simulated Wireless Grid Network, Arris Ray Jun 2004

On The Effects Of Device Mobility Upon Resource-Sharing In A Simulated Wireless Grid Network, Arris Ray

Theses and Dissertations

The primary aim of modern computer networks is to permit simplified sharing of resources (e.g., files and data) or to provide access to remote resources (e.g., printers or remote file-systems). Grid networks aim to provide a more sophisticated framework for securely sharing, selecting and/or aggregating a wide-variety of remote resources, whether logical (e.g., files and data) or physical (e.g., remote sensors, processing power or disk storage space). Provided that circuit design continues to improve at the relatively steady pace that it has for the past decade, in addition to standard desktop systems, miniature and mobile devices will soon become substantially …

The Impact Of Species Concept On Biodiversity Studies, Keith A. Crandall, Paul-Michael Agapow, Olaf R. P. Bininda-Emonds, John L. Gittleman, Georgina M. Mace, Jonathon C. Marshall, Andy Purvis Jun 2004

The Impact Of Species Concept On Biodiversity Studies, Keith A. Crandall, Paul-Michael Agapow, Olaf R. P. Bininda-Emonds, John L. Gittleman, Georgina M. Mace, Jonathon C. Marshall, Andy Purvis

Faculty Publications

Species are defined using a variety of different operational techniques. While discussion of the various methodologies has previously been restricted mostly to taxonomists, the demarcation of species is also crucial for conservation biology. Unfortunately, different methods of diagnosing species can arrive at different entities. Most prominently, it is widely thought that use of a phylogenetic species concept may lead to recognition of a far greater number of much less inclusive units. As a result, studies of the same group of organisms can produce not only different species identities but also different species range and number of individuals. To assess the …

Political Justice: Sub-National Determinants Of Judicial Efficiency In Mexico, 1993-2000, Matthew Ingram Jun 2004

Political Justice: Sub-National Determinants Of Judicial Efficiency In Mexico, 1993-2000, Matthew Ingram

Research Papers

Judicial efficiency can be engineered. Although there are several significant determinants of judicial efficiency that are, relatively speaking, out of the control of policy makers and politicians, this research argues that institutional design is a critical variable over which there is substantial control. In this quantitative study of the judiciary in 11 Mexican states, institutional design is a strong predictor of judicial efficiency . Design choices promise to yield substantive improvements in the efficiency of judicial institutions. Judicial efficiency , in turn, facilitates the vindication of rights in democratic countries and promises to promote the consolidation of democracy. Furthermore, these …

The Law Merchant In The Modern Age: Institutional Design And International Usages Under The Cisg, Clayton P. Gillette Jun 2004

The Law Merchant In The Modern Age: Institutional Design And International Usages Under The Cisg, Clayton P. Gillette

Chicago Journal of International Law

All participants seem to agree that this debate cannot be resolved on an all- or-nothing basis. Plain meaning will sometimes minimize total contracting costs, as will the incorporation strategy some of the time. It is less clear whether the cases in which one strategy dominates are so pervasive as to warrant its applicability to all cases, lest the costs of discovering exceptions prove too great. What is missing from the debate, however, is a taxonomy of the conditions under which trade usages would be sufficiently precise, observable, and verifiable as to warrant their incorporation. In this Article, I begin that …

The Mural-Covered Wall: On Separation And The Future Of Jews And Palestinians In Israel/Palestine And The Diaspora, Marc H. Ellis Jun 2004

The Mural-Covered Wall: On Separation And The Future Of Jews And Palestinians In Israel/Palestine And The Diaspora, Marc H. Ellis

Chicago Journal of International Law

My argument here is not that Israel, in exerting its power to define itself over against others, is exceptional. Rather, the opposite is the case. Realpolitik is the way of all nation-states and power in general. Nor is Israel exceptional in claiming its innocence in exercising power to expand and flourish. Again the opposite is the case. Nation-states always claim innocence and a kind of benevolent redemptive sensibility. Yet if Israel is not different in the foundations of its national life, then the charge that Israel is a Western colonial and imperialist outpost takes on a strength that is only …

Personal Experience And Professional Development Through Critical And Creative Thinking, Benjamin A. Okafor

Critical and Creative Thinking Capstones Collection

This synthesis describes my journey as a student in the Critical and Creative Thinking (CCT) Program and shows the impact the program has had on my life. I was able to fashion a future career for myself with the help of the courses I took along that journey. Finding the CCT Program in 1993 showed me a way to get beyond my bad undergraduate educational experience. My experience in the first two courses, Critical Thinking and Creative Thinking, was exhilarating. I was able to apply that experience and knowledge in dealing with the serious misfortunes of my family in Nigeria …

Diploid And Polyploid Cytotype Distribution In Melampodium Cinereum And M. Leucanthum (Asteraceae, Heliantheae), Tod F. Stuessy, Hanna Weiss-Schneeweiss, David J. Keil Jun 2004

Diploid And Polyploid Cytotype Distribution In Melampodium Cinereum And M. Leucanthum (Asteraceae, Heliantheae), Tod F. Stuessy, Hanna Weiss-Schneeweiss, David J. Keil

Biological Sciences

Previous chromosomal studies within Melampodium (Asteraceae, Heliantheae) of Mexico and Central America have documented chromosome numbers n = 9, 10, 11, 12, 18, 20, 23, 25 ± 1, 27, 30, and 33. Some species also have been shown to exhibit infra-and interpopulational polyploidy. The presence of cytotype mixtures is especially pronounced in the white-rayed complex, which occurs in the southwestern United States and adjacent Mexico. This group includes M. cinereum (n = 10 and 20), M. leucanthum (n = 10 and 20), and M. argophyllum (n = 30). Cytotype distribution has been newly analyzed in 415 plants from 152 populations …

Sexual Orientation And The Paradox Of Heightened Scrutiny, Nan D. Hunter Jun 2004

Sexual Orientation And The Paradox Of Heightened Scrutiny, Nan D. Hunter

Michigan Law Review

In Lawrence v. Texas, the Supreme Court performed a double move, creating a dramatic discursive moment: it both decriminalized consensual homosexual relations between adults, and, simultaneously, authorized a new regime of heightened regulation of homosexuality. How that happened and what we can expect next are the subjects of this essay. The obvious point of departure for an analysis of Lawrence is its decriminalization of much sexual conduct. Justice Scalia began this project with his dire warning that "[s]tate laws against bigamy, samesex marriage, adult incest, prostitution, masturbation, adultery, fornication, bestiality, and obscenity are . . . sustainable only in …

South Park Blocks Area Development Strategy: Priorities And Actions To Strengthen Neighborhood Identity, Lisa Abuaf, Natasha Detweiler, Steve Faust, Jennifer Mannhard, Dan Zalkow

Master of Urban and Regional Planning Workshop Projects

Past and current planning efforts by the City of Portland, such as the South Park Blocks Urban Renewal Area and the West End plan, have sought to promote new mixed-use development through increasing the residential density and investment in the area. The West End plan focused primarily on the area north of SW Salmon Street and the urban renewal area currently does not have a standing advisory committee to represent the Downtown neighborhood’s interests. This project consists of a neighborhood analysis to distill the identity of the area, an identification of the opportunities and challenges to development, and a strategy …

Convergence Between Interlibrary Loan And Acquisitions: A Science And Engineering Library Experience, Louis Houle Jun 2004

Convergence Between Interlibrary Loan And Acquisitions: A Science And Engineering Library Experience, Louis Houle

Proceedings of the IATUL Conferences

Libraries are looking at new types of services to improve the dissemination of information to their users. One such new service, the integration of Interlibrary Loan with acquisitions and collection development, looks like a promising approach to meet the users’ information needs. The requests that meet selection criteria are not sent through the regular ILL borrowing channels but are instead turned into rush acquisitions. A special fund was set aside to purchase books requested by users (students, faculty and staff) through ILL processes. The ILL Librarian does both the selection of the ILL requests and the ordering of the books. …

Haruki Murakami And The Ethics Of Translation, Will Slocombe Jun 2004

Haruki Murakami And The Ethics Of Translation, Will Slocombe

CLCWeb: Comparative Literature and Culture

In his paper, "Haruki Murakami and the Ethics of Translation," Will Slocombe argues that despite the fact that Murakami has gained world-wide popularity recently, there has been little critical attention to his works outside of the comparatively narrow area of Japanese studies. Slocombe proposes that Murakami is too important an author to be limited in this way because of his definition of "translation." For Murakami, translation delineates an operative ethics between Self and Other, a dialogue that is not only between different languages and cultures, but also between the private and political spheres, and between different individuals. Slocombe discusses Murakami's …

An Industry-University Response To Global Competition, Joel A. Diemer, Richard Phillips, Mark Hillon Jun 2004

An Industry-University Response To Global Competition, Joel A. Diemer, Richard Phillips, Mark Hillon

Journal of Extension

In 1998, representatives of New Mexico's chile pepper industry approached New Mexico State University's College of Agriculture and Home Economics for help in gaining the edge on new global competition. The result was the New Mexico Chile Task Force, which brought together industry, university, and government partners to apply the most up-to-date knowledge and technology to industry problems. Key to the task force's success is the search conference format used in the initial strategic planning phase. This method, pioneered by Emery and Trist in the 1960s, brought together parties with divergent opinions and empowered them to develop strategies to manage …

Genome Scans Of Dna Variability In Humans Reveal Evidence For Selective Sweeps Outside Of Africa, Jay F. Storz, Bret A. Payseur, Michael W. Nachman

Jay F. Storz Publications

The last 50,000–150,000 years of human history have been characterized by rapid demographic expansions and the colonization of novel environments outside of sub-Saharan Africa. Mass migrations outside the ancestral species range likely entailed many new selection pressures, suggesting that genetic adaptation to local environmental conditions may have been more prevalent in colonizing populations outside of sub-Saharan Africa. Here we report a test of this hypothesis using genome-wide patterns of DNA polymorphism. We conducted a multilocus scan of microsatellite variability to identify regions of the human genome that may have been subject to continent-specific hitchhiking events. Using published polymorphism data for …
