Self-Organizing Legal Systems: Precedent And Variation In Bankruptcy, Bernard Trujillo Jan 2004

Self-Organizing Legal Systems: Precedent And Variation In Bankruptcy, Bernard Trujillo

Law Faculty Publications

Models of legal ordering are frequently hierarchical. These models do not explain two prominent realities: (1) variation in the content of a legal system, and (2) patterns of non-hierarchical ordering that we observe. As a supplement to hierarchical explanations of legal order, this Article, drawing from physical and social science research on complex systems, offers a self-organizing model. The self-organizing model focuses on variation in the content of legal systems and attempts to explain the relationship between that variation and patterns of ordering. The self-organizing model demonstrates that variation and ordering are not opposite categories, but rather constitute one continuous …

Agroforestry, Elephants, And Tigers: Balancing Conservation Theory And Practice In Human-Dominated Landscapes Of Southeast Asia, Philip J. Nyhus, R L. Tilson Jan 2004

Agroforestry, Elephants, And Tigers: Balancing Conservation Theory And Practice In Human-Dominated Landscapes Of Southeast Asia, Philip J. Nyhus, R L. Tilson

Faculty Scholarship

Large mammal populations theoretically are best conserved in landscapes where large protected areas are surrounded by buffer zones, connected by corridors, and integrated into a greater ecosystem. Multi-use buffer zones, including those containing complex agroforestry systems, are promoted as one strategy to provide both economic benefits to people and conservation benefits to wildlife. We use the island of Sumatra, Indonesia to explore the benefits and limitations of this strategy. We conclude that conservation benefits are accrued by expanding the habitat available for large mammals but more attention needs to be focused on how to reduce and respond to human–wildlife conflict …

Characterizing Human-Tiger Conflict In Sumatra, Indonesia: Implications For Conservation, Philip J. Nyhus, Ronald Tilson

Faculty Scholarship

Human-tiger conflict occurs in Indonesia but there is little recent information about the scope of the problem, and adequate policies are not in place to address the conflict. Published and unpublished reports of conflict between Sumatran tigers Panthera tigris sumatrae, people and their livestock were collected and analysed to characterize the extent, distribution and impact of human-tiger actively conflict on the island of Sumatra, Indonesia. Reportedly, between 1978 and 1997, tigers killed 146 people and injured 30, and killed at least 870 livestock. Conflict was less common in protected areas and more common in inter- mediate disturbance areas such as …

Satellite Monitoring Of Vegetation Dynamics: Sensitivity Enhancement By The Wide Dynamic Range Vegetation Index, Andrés Viña, Geoffrey Henebry, Anatoly A. Gitelson Jan 2004

Satellite Monitoring Of Vegetation Dynamics: Sensitivity Enhancement By The Wide Dynamic Range Vegetation Index, Andrés Viña, Geoffrey Henebry, Anatoly A. Gitelson

School of Natural Resources: Faculty Publications

Synoptic monitoring of vegetation dynamics relies on satellite observations of the distinctive spectral contrast between red and near infrared reflectance that photosynthetically active green vegetation exhibits. It has long been recognized that the Normalized Difference Vegetation Index (NDVI) suffers a rapid decrease of sensitivity at moderate-to-high densities of photosynthetic green biomass. This decrease can conceal detection of vegetation change in croplands, woodlands, and productive grasslands. We applied a recent, straightforward modification of the NDVI, the Wide Dynamic Range Vegetation Index (WDRVI), to a standard AVHRR dataset to assess its sensitivity to variability within ecoregions and across years, relative to NDVI. In …

Application Of Snowfall And Wind Statistics To Snow Transport Modeling For Snowdrift Control In Minnesota, Martha Shulski, Mark W. Seeley Jan 2004

Application Of Snowfall And Wind Statistics To Snow Transport Modeling For Snowdrift Control In Minnesota, Martha Shulski, Mark W. Seeley

School of Natural Resources: Faculty Publications

Models were utilized to determine the snow accumulation season (SAS) and to quantify windblown snow for the purpose of snowdrift control for locations in Minnesota. The models require mean monthly temperature, snowfall, density of snow, and wind frequency distribution statistics. Temperature and precipitation data were obtained from local cooperative observing sites, and wind data came from Automated Surface Observing System (ASOS)/Automated Weather Observing System (AWOS) sites in the region. The temperature-based algorithm used to define the SAS reveals a geographic variability in the starting and ending dates of the season, which is determined by latitude and elevation. Mean seasonal snowfall …

Faculty & Staff Scholarship

Shigellosis is an important cause of morbidity and mortality throughout the world. Approximately, 1.1 million deaths occur a year due to this disease, making it the fourth leading cause of mortality worldwide. This paper explores local interest in and potential use of a vaccine for shigellosis in Thailand where Shigella poses an important public-health concern. Data for this study were collected during June- November 2002 from 522 subjects surveyed using a sociobehavioural questionnaire in Kaeng Koi district in central Thailand. The community demand and likely use of a vaccine were examined in relation to the Health Belief Model, which provides …

A Preservation Paradox: Political Prestidigitation And An Enduring Resource Of Wildness, Sandi Zellmer Jan 2004

A Preservation Paradox: Political Prestidigitation And An Enduring Resource Of Wildness, Sandi Zellmer

Nebraska College of Law: Faculty Publications

The nation's preeminent preservation statute, the Wilderness Act of 1964, is now 40 years old. By authorizing a network of congressionally designated wilderness areas on public lands, the Act has proved invaluable for protecting special areas from the most intensive forms of intrusion by humankind But the Act is facing a midlife crisis, and legitimate questions have been raised about its continuing viability as a conservation tool. This Article concludes that the preservation of wild lands remains an essential component of federal public lands management, but that the Wilderness Act, standing alone, has not fulfilled its promise of securing an …

Advanced Digital Terrain Analysis Using Roughness-Dissectivity Parameters In Gis, I-Kuai Hung Jan 2004

Advanced Digital Terrain Analysis Using Roughness-Dissectivity Parameters In Gis, I-Kuai Hung

Faculty Presentations

The local variation of terrain properties causes profound changes in the biosphere, microclimate, hydrologic cycle, and in the distribution of human activities on this planet. With the dawn of computerized technology, the terrain is represented in a digital form and new methods are needed to effectively describe, evaluate and quantify terrain properties. The purpose of this project is to develop new methods and procedures for terrain analyses within a GIS environment. The focus is to develop tools for capturing the local terrain variability. The selected parameters such as the hypsometric integral (modified Martonne’s index), roughness index, and basic statistical measures …

Monitoring The Meridional Overturning Circulation In The North Atlantic: A Model-Based Array Design Study, Johanna Baehr, Jöel Hirschi, Jens-Olaf Beismann, Jochem Marotzke Jan 2004

Monitoring The Meridional Overturning Circulation In The North Atlantic: A Model-Based Array Design Study, Johanna Baehr, Jöel Hirschi, Jens-Olaf Beismann, Jochem Marotzke

Journal of Marine Research

A monitoring system for the meridional overturning circulation (MOC) is deployed into an "eddy-permitting" numerical model (FLAME) at three different latitudes in the North Atlantic Ocean. The MOC is estimated by adding contributions related to Ekman transports to those associated with the zonally integrated vertical velocity shear. Ekman transports are inferred from surface wind stress, whereas the velocity shear is derived from continuous density "observations," principally near the eastern and western boundaries, employing thermal wind balance. The objective is to test the method and array setups for possible real observation in the ocean at the chosen latitudes and to guide …

Passive Tracer Reconstruction As A Least-Squares Problem With A Semi-Lagrangian Constraint: An Application To Fish Eggs And Larvae, G. G. Panteleev, B. De Young, C. S. Reiss, C. T. Taggart Jan 2004

Passive Tracer Reconstruction As A Least-Squares Problem With A Semi-Lagrangian Constraint: An Application To Fish Eggs And Larvae, G. G. Panteleev, B. De Young, C. S. Reiss, C. T. Taggart

Journal of Marine Research

A variational, data assimilation, algorithm was developed for reconstruction of a two-dimensional, nonstationary, passive tracer field in the ocean with open boundaries and a known velocity field. The observations, spatial smoothing terms and passive tracer conservation equation were included as weak constraints. The algorithm was tested with simulated, nonstationary, pseudo-oceanographic data integrated for a 7-day period. Simulations were run to determine the robustness of the algorithm and the effect of theoretical, simulated 'sampling events,' mimicking the standard oceanographic survey. We explored the sensitivity of the reconstructed tracer fields to the distribution of the pseudo-oceanographic sampling strategy, essentially an antenna problem, …

Bringing Books To A "Book-Hungry Land": Print Culture On The Dakota Prairie, Lisa Lindell Jan 2004

Bringing Books To A "Book-Hungry Land": Print Culture On The Dakota Prairie, Lisa Lindell

Hilton M. Briggs Library Faculty Publications

The dearth of reading material was a recurring lament in the writings and memoirs of Dakota settlers in the late nineteenth and early twentieth centuries. “I was born with a desire to read, . . . and I have never gotten over it,” declared Henry Theodore Washburn, recalling his Minnesota boyhood and homesteading years in Dakota Territory, “but there was no way in those days to gratify that desire to any great extent.”1 This lack was indeed of consequence. In the pre-electronic era, print was a primary means of obtaining information, insight, and pleasure. High rates of literacy, sharp increases …

Influence Of The Pacific Decadal Oscillation On Hydrochemistry Of The Rio Grande, Usa, And Mexico, Fasong Yuan, Seiichi Miyamoto

Biological, Geological, and Environmental Faculty Publications

The hydrochemistry has been examined using the major element composition of river water at 12 gauging stations along the Rio Grande. As the Rio Grande Basin consists of two watersheds that have different hydrologic and climatic regimes, two chloride concentration records from the El Paso and Falcon Dam gauging stations have been extracted to reflect long-term variability in river chemistry of the upper and lower basins over the last 50–70 years. Both records contain decadal variability in chloride concentration but are different in nature. The chloride concentration record from the upper basin displays a distinct pattern of decadal variability similar …
