Can Cooperative Service Solve The Grey Literature Challenge?, Sherry Buchanan, Cyril Oberlander, Rose M. Jackson

Library Faculty and Staff Publications and Presentations

With the surge of student and faculty reliance on the Internet and search engines like Google as sources for bibliographies, researchers expect reference desk staff to quickly locate obscure materials. In this article, we explore the interplay between reference and interlibrary loan services in light of post-modern research styles, and how reference and interlibrary loan (distinct service points) can seamlessly address grey literature research needs.

Honest Beliefs, Credible Lies, And Culpable Awareness: Rhetoric, Inequality, And Mens Rea In Sexual Assault, Lucinda Vandervort Oct 2004

Honest Beliefs, Credible Lies, And Culpable Awareness: Rhetoric, Inequality, And Mens Rea In Sexual Assault, Lucinda Vandervort

Osgoode Hall Law Journal

The exculpatory rhetorical power of the term "honest belief" continues to invite reliance on the bare credibility of belief in consent to determine culpability in sexual assault. In law, however, only a comprehensive analysis of mens rea, including an examination of the material facts and circumstances of which the accused was aware, demonstrates whether a "belief' in consent was or was not reckless or wilfully blind. An accused's "honest belief" routinely begs this question, leading to a truncated analysis of criminal responsibility and error. The problem illustrates how easily old rhetoric perpetuates assumptions that no longer have a place in …

Building Relationships Between Business Schools And Students: An Empirical Investigation Into Student Retention, Phani Tej Adidam, R. Prasad Bingi, Birud Sindhav Oct 2004

Building Relationships Between Business Schools And Students: An Empirical Investigation Into Student Retention, Phani Tej Adidam, R. Prasad Bingi, Birud Sindhav

Marketing and Management Faculty Publications

This study uses the relationship marketing theory of commitment and trust as a framework to investigate the issue of student retention in business schools. Structural equation modeling was used to examine relationships specified by Morgan and Hunt's (1994) theory of relationship marketing. Students' commitment to the business schools were determined by perceived benefits of attending the school, perceived similarity of values between the school and the students, and trust between the professors and the students. Commitment increased intentions to remain at the business school.

Adherence Of Prime-Time Television Advertising Disclosures To The “Clear And Conspicuous" Standard: 1990 Vs. 2002, Mariea Grubbs Hoy, J. Craig Andrews Oct 2004

Adherence Of Prime-Time Television Advertising Disclosures To The “Clear And Conspicuous" Standard: 1990 Vs. 2002, Mariea Grubbs Hoy, J. Craig Andrews

Marketing Faculty Research and Publications

In 1990, one-fourth of all national television commercials contained disclosures, yet none of the disclosures adhered to all of the Federal Trade Commission's "clear and conspicuous" standard (CCS). As a result of marketplace changes and a 2001 Federal Trade Commission and National Advertising Division joint workshop, the authors anticipate an increase in the number of disclosures and greater adherence to the CCS. The authors find a significant increase in disclosure incidence; however, adherence declines or remains unchanged for most individual guidelines. Finally, the authors provide public policy implications and offer suggestions to increase adherence to the CCS.

An Examination Of Patents, Licensing, Research Tools, And The Tragedy Of The Anticommons In Biotechnology Innovation, Michael S. Mireles Oct 2004

An Examination Of Patents, Licensing, Research Tools, And The Tragedy Of The Anticommons In Biotechnology Innovation, Michael S. Mireles

University of Michigan Journal of Law Reform

The continued development of and affordable access to potentially life saving pharmaceuticals, gene therapies and diagnostics is unquestionably a socially important issue. However, crafting government policy to encourage the development of and allowing affordable access to those services and products is difficult. On one hand, the development of those services and products requires a large investment of funds because of the complexity, collaborative nature, and uncertainty of the development of those products and services. Accordingly, investors require the safety of strong and stable patent rights to ensure a return on their investment in the development of a commercial end-product or …

Public Nuisance Claims Against Gun Sellers: New Insights And Challenges, Jean Macchiaroli Eggen, John G. Culhane Oct 2004

Public Nuisance Claims Against Gun Sellers: New Insights And Challenges, Jean Macchiaroli Eggen, John G. Culhane

University of Michigan Journal of Law Reform

Gun violence continues unabated. Regulation of these deadly instruments is woefully inadequate, and legislatures are compounding the problem by barring or restricting access to the courts for the death and injuries that guns cause. In short, Congress and state legislators have repeatedly acquiesced to the demands of the gun lobby.

During the past several years, cities have struck back by filing public nuisance claims against those gun sellers whose practices pose a risk to the public's health and safety. After a slow start, public nuisance claims have recently gained traction in state appellate courts, which are increasingly coming to realize …

Bilingualism And Equality: Title Vii Claims For Language Discrimination In The Workplace, James Leonard Oct 2004

Bilingualism And Equality: Title Vii Claims For Language Discrimination In The Workplace, James Leonard

University of Michigan Journal of Law Reform

Linguistic diversity is a fact of contemporary American life. Nearly one in five Americans speak a language other than English in the home, and influxes of immigrants have been a constant feature of American history. The multiplicity of languages in American society has touched nearly all aspects of American culture, and specifically has added new and important challenges to the American workplace. Chief among these new concerns are the growing number of legal claims centered around language discrimination in the workplace. The common vehicle for these claims has been Title VII, and there is considerable support in the academic literature …

Cost-Benefit Analysis And The Environment, Cass R. Sunstein Oct 2004

Cost-Benefit Analysis And The Environment, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

This review-essay explores the uses and limits of cost-benefit analysis in the context of environmental protection, focusing on three recent books: Priceless, by Frank Ackerman and Lisa Heinzerling; Cellular Phones, Public Fears, and A Culture of Precaution, by Adam Burgess; and Catastrophe: Risk and Response, by Richard A. Posner. The review-essay emphasizes three principal limitations on the use of cost-benefit analysis. First, it is important to distinguish between the easy cases for cost-benefit analysis, in which the beneficiaries of regulation pay all or almost all of its cost, from the harder cases, in which the beneficiaries pay little for the …

The Inevitability Of Aggregate Settlement: An Institutional Account Of American Tort Law, Samuel Issacharoff, John F. Witt Oct 2004

The Inevitability Of Aggregate Settlement: An Institutional Account Of American Tort Law, Samuel Issacharoff, John F. Witt

Vanderbilt Law Review

For the past decade or so, important aspects of American tort law have sought to reaffirm tort's ostensible commitment to individualized justice. In the courts, "the elephantine mass of asbestos cases"' has produced a reaffirmation of what Justice Souter in Ortiz v. Fibreboard Corporation called the "day-in-court ideal": "our deep- rooted historic tradition that everyone should have his own day in court." The academy, in turn, appears to be in the midst of a sustained revival of the closely related idea that tort law consists in the reciprocal relationship between plaintiff and defendant, in which the bipolarity of the dispute …
