This memorandum discusses changes made to the Spokane River model calibration since the original calibration of the model discussed in the following reports: Annear et al. (2001), Berger at al. (2002), Slominski et al. (2002), and Berger et al. (2003). The first group of refinements was made by the Washington Department of Ecology. Additional changes were made by Portland State University (PSU) and were discussed in this report along with the results of two alternative calibrations. The last section displays the original calibration results from Berger et al. (2003) as a basis for comparison to the changes made by Ecology …

The purpose of this study was to investigate deterrence factors for online file-sharing by analyzing different conditions that affect compliance with the law through survey of the students in a large university in Southern U.S. The findings show that certainty of punishment, stigma of the label, knowledge of the laws and consensus with the rule negatively correlated with both actual and likely future file-sharing activities of the users

A single action of an individual is highly influenced not only by personal interests and desires, but also by a complex network of social influences. Because of this vast outside social pressure within society, the legal ramifications of individual action must also be studied in a multidimensional way to incorporate these social values. One effective means to do so is to begin linking the socioeconomic paradigm into traditional legal study through the use of teaching simulations. Mississippi River diversions into coastal Louisiana wetlands aim to provide nutrient inputs and slow the impacts resulting from saltwater intrusion. Baldcypress (Taxodium distichum L. Richard) exhibits significant intraspecific tolerance to salinity and is being developed for restoration projects. Two studies were conducted using five half-sibling families of baldcypress planted at two locations in southeast Louisiana to investigate the effects of nutrient additions, thinning, and phenology on the growth of the baldcypress leafroller (Archips goyerana Kruse, BCLR). Thermodynamic Characterization Of Dna Binding By Type I Dna Polymerases From Thermus Aquaticus And Escherichia Coli, Kausiki Datta

DNA binding of the DNA polymerase I from Thermus aquaticus (Taq and Klentaq fragment) and E. coli (Klenow fragment) have been studied as a function of [salt] and temperature in order to understand their DNA binding thermodynamics. Binding of the two different species of polymerases occurs with sub-micromolar affinities in very different salt concentration ranges. Thus, at similar [KCl] the binding of Klenow is ~ 3kcal/mol (150X) tighter than the binding of Taq/Klentaq. Linkage analysis of the [KCl] dependence of DNA binding at 25°C reveals a net release of 2-3 ions for Taq/Klentaq and 4-5 ions for Klenow. DNA binding …

This research was conducted to determine the non-phosphorus effects of phytase in diets for swine and poultry. An experiment was conducted to determine the effect of phytase addition on energy availability and protein and fat deposition in growing pigs. Results from this experiment indicated that phytase had small positive effects on energy availability, protein deposition, and fat deposition. In this study, 23 of 29 response variables were at least numerically increased with phytase addition. The State of Oregon Department of Environmental Quality (DEQ) is developing a TMDL for temperature in the Willamette River basin shown in Figure 1. The study area included the Willamette River and all major tributaries (except the Tualatin River where a TMDL process was already concluded). A large section of the Columbia River was also modeled to provide adequate boundary representation of tidal flows in the lower Willamette River. The business judgment rule is corporate law's central doctrine, pervasively affecting the roles of directors, officers, and controlling shareholders. Increasingly, moreover, versions of the business judgment rule are found in the law governing the other types of business organizations, ranging from such common forms as the general partnership to such unusual ones as the reciprocal insurance exchange. Yet, curiously, there is relatively little agreement as to either the theoretical underpinnings of or policy justification for the rule. The search for more efficient and economical forms of energy generation is a continual process. Natural gas production and electricity generation from geopressured-geothermal aquifers is an unconventional hydrocarbon source that has long been unproductive due to its marginal economics and lack of technological certainty. This thesis demonstrates that, based on modern technological competencies and economic constraints, geopressured-geothermal energy now maintains a viable future as an alternative domestic energy source.

The United States is currently involved in negotiation of the Hague Convention on Exclusive Choice of Court Agreements, which would regulate the enforceability of forum-selection clauses in international contracts. That project - as well as the recent focus in globalization literature on more active judicial management of forum selection - draws attention to one unusual aspect of U.S. jurisdictional law: that dismissal on the basis of forum non conveniens is available even in cases arising out of contracts including negotiated forum selection clauses. Fouling and scaling in evaporators has been an area of great interest to raw sugar mills for a number of years and many of the mechanisms causing the scale and the rates of scaling are unknown. In an attempt to quantify the scaling rates and measure the scaling, an online model has been developed to model a system of evaporators. Monitoring the heat transfer coefficient as a function of time enabled measurement of the scaling rate by monitoring the heat transfer coefficient as it decreased with time. The effects of brown stink bug, Euschistus servus (Say), and southern green stink bug, Nezara viridula (L.), feeding on pre-flowering, flowering, and senescing cotton, Gossypium hirsutum L., plants were evaluated in field studies. Vegetative stage seedlings and flower buds (squares) were not significantly injured by adults or nymphs of either species in no-choice studies. Brown stink bug adults induced boll abscission, and reduced seedcotton yield and seed germination in bolls accumulating „T 350, „T 550, and 101 to „T 600 heat units beyond anthesis, respectively. Richard Danielpour is recognized as one of the most successful and acclaimed composers today. His music is often described as neo-romantic: full of grand gestures, highly accessible, brilliantly orchestrated, and rhythmically powerful and exciting. His music is based on the traditions of European classical music; however, it also combines the American vernacular of the 20th century, including jazz, rock, and pop music. His special interests in metaphysics and non-Western culture, especially Zen Buddhism, are also reflected in his compositions. Several cell types, including cardiac myocytes and vascular endothelial cells, produce nitric oxide (NO) via both constitutive and inducible isoforms of NO synthase. NO attenuates cardiac contractility and contributes to contractile dysfunction in heart failure, although the precise molecular mechanisms for these effects are poorly defined. Adenylyl cyclase (AC) isoforms type 5 and 6, which are preferentially expressed in cardiac myocytes, may be inhibited via a direct nitrosylation by NO. Because endothelial NO synthase (eNOS and NOS3), β-adrenergic ( AR) receptors, and AC6 all can localize in lipid raft/caveolin-rich microdomains, we sought to understand the role of lipid rafts in …

Finite element solution in the updated Lagrangian frame is used to investigate the strain localization phenomenon "shear bands" in granular materials. The micro-polar theory was used as the mathematical foundation for the continuum formulations. A laboratory testing results are used for verification and comparison with the numerical simulation. Silica sand and glass beads with different shape indices, size and surface roughness were tested under biaxial and triaxial loading conditions to investigate the physics of the problem. The purpose of the study was to determine how often and to what degree “imprecise frequency descriptors” are used in prescription drug print ads. These descriptors along with the side effects they describe were compared to their corresponding prescription medicine websites and analyzed to determine whether or not the general public is being misinformed and/or misled in terms of side effect warnings by current drug advertising. Content analysis of Direct-to-Consumer (DTC) prescription drug advertisements found in five of the top seven magazines most likely to be consumed by readers over age 65 was the method of investigation for this study. …

The majority of Listeria monocytogenes that have been isolated from food product or human cases are of the serotypes ½ a, ½ b and 4b. The purposes of this study were: 1) To assess the effects of practice strategies, metronome, meter, hand, and musical function on piano performance accuracy of undergraduate music majors enrolled in piano class (N=39), and 2) To assess the effects of practice strategies on practice time relative to two unfamiliar pieces of keyboard music. Throughout an eight-week training session, treatment subjects were provided strategies for practicing unfamiliar pieces of keyboard music and were allowed time in class to apply the strategies while practicing. This thesis presents a novel method of capturing 3D foot geometry from images for custom shoe insole manufacture. Orthopedic footwear plays an important role as a treatment and prevention of foot conditions associated with diabetes. Through the use of customized shoe insoles, a podiatrist can provide a means to better distribute the pressure around the foot, and can also correct the biomechanics of the foot. The Supreme Court's decisions in United States v. Lopez and United States v. Morrison have raised serious questions about the scope of Congress's commerce clause jurisdiction in creating federal crimes. This Article analyzes those cases as well as Jones v. United States, and other Supreme Court cases interpreting federal criminal laws, in order to assess the current scope of federal commerce clause jurisdiction.
It concludes that while it is not the intent of the Supreme Court to cut serious inroads into federal jurisdiction, the impact of Lopez and Morrison is greater than the lower federal courts have recognized. In particular, …

A significant national problem is the enduring widespread crisis in providing adequate legal representation for indigent defendants in state criminal prosecutions. Insufficient funding and lack of oversight undermines the quality of public defense delivery systems while constantly risking the conviction of innocent persons. Thus, the Constitution's promise of counsel, first recognized in 1963 by the U.S. Supreme Court in Gideon v. Wainwright, remains unfulfilled. Animals are considered the personal property of their owners, and as such, when they are delivered by their owners to a veterinarian, the facts of the situation perfectly satisfy the elements of a bailment relationship. Nonetheless, when courts consider negligence by a veterinarian, animals' classification as property is disregarded and bailment principles are not applied. Instead, veterinary malpractice principles are used. If bailment principles were applied, it would be easier for owners to prove liability for injury to their animals. The federal courts of appeals have used "unpublished opinions" for thirty years as one method of coping with the "crisis of volume." Recent developments demonstrate that interest in this controversial practice remains high. Panels of the Eighth Circuits and Ninth Circuits reached opposite conclusions regarding the propriety of the practice, and in so doing described the nature of the appellate process in remarkably different ways. Several circuits have recently amended their rules, liberalizing citation of unpublished opinions. The Advisory Committee on Appellate Rules has approved a proposed new rule permitting citation of unpublished opinions. Inasmuch as the rules regarding citation …

The Use Of Rules And Standards To Define A Transsexual's Sex For The Pupose Of Marriage: An Argument For A Hybrid Approach, Briana Lynn Morgan

The treatment of transsexuals under marital law has been conflicting. Though legislatures in many jurisdictions have limited marriage to one man and one woman, "man" and "woman" have not been adequately defined. Courts have employed a variety of tests in determining which gender to assign transsexuals, ranging from a hard-line rule of what sex the transsexual was born with, to multi-factored tests based on scientific definitions of gender. Universities are beginning to brand themselves. The days when the doors to higher-ed opened and students flooded into the classrooms are no more. Colleges have to find ways to separate themselves from each other in a noisy marketplace. Also there is a decline in newsroom resources for academic coverage, which leaves university marketers searching for ways to communicate their messages.
