Statistical Closed-Loop Process Scheduling, James D. Remus Jan 2004

Statistical Closed-Loop Process Scheduling, James D. Remus

Theses

Traditionally, scheduling algorithms have been implemented as open-loop control systems. This allows the operating system to make quick decisions on the order in which tasks should be scheduled without requiring complex calculations. It is very common for a task to be assigned a priority based on its anticipated performance, or based on general process characteristics (i.e., I/O bound versus CPU bound). The problem with this type of scheduling, and this type of control system in general, is that it is rigid and lacks the ability to adjust based on the actual performance of the system and its processes. This work …

Internet Domain Name Disputes: Working Toward A Global Solution, Sue Ann Mota Jan 2004

Internet Domain Name Disputes: Working Toward A Global Solution, Sue Ann Mota

Computer Law Review and Technology Journal

The Internet is essential to the growth of the global economy and the Domain Name System is essential to accessing sites on the Internet. Over 170 registrars are accredited to issue top-level domains, such as .com, .net, and .org. Frequently, however, disputes arise over who should own a particular domain name. The Internet Corporation for Assigned Names and Numbers (ICANN) has adopted a Uniform Domain Name Dispute Resolution Policy (UDRP) to address these disputes. ICANN has approved four dispute resolution service providers that are currently handling domain name disputes. This article will examine the success rate of complaints, the elements …

When The Americans With Disabilities Act Goes Online: Application Of The Ada To The Internet And The World Wide Web, Steven Mendelsohn, Martin Gould

Computer Law Review and Technology Journal

Over the past decade, the emergence of electronic communication, Internet technology, and the World Wide Web has dramatically altered the lifestyles of many Americans and has affected the lives of us all. As a result of these technologies, society has experienced great transformation and has had to confront new opportunities and challenges and make many adjustments to accommodate these new developments.

American law has struggled to stay current with the new technology. In attempting to stay current and adapt to the new technology, the law has followed two lines of development. First, laws are passed to deal with new issues …

The Decss Trade Secrets Case: Dvd Copy Control Association, Inc. V. Bunner, Brooks W. Taylor

Computer Law Review and Technology Journal

Bad facts make bad law. In DVD Copy Control Association, Inc. v. Bunner, the California Supreme Court addressed a sympathetic plaintiff suing a group of hackers for ignoring the terms of a click wrap license and reverse engineering trade secrets from a computer program. To ensure that justice prevailed, the court held that a preliminary injunction against re-posting computer code containing those purported trade secrets was not a prior restraint on speech, but rather was content-neutral. In the trial court, despite the fait accompli of the computer code's Internet release to the hacker community, the court implausibly found that …

Tackling The Issue Of Access: Situating Place Within Immigrant Women's Experiences Of Health And Health Care (Ontario), Jillian C. Paul

Theses and Dissertations (Comprehensive)

Access to health care services is an essential element to immigrant women receiving the care that they need. However, there are barriers that women face as immigrants in a new community. Language, cultural awareness and household responsibilities are issues that a significant number of immigrant women encounter when accessing health care services. There are significant gaps within geographic literature pertaining specifically to marginalized populations and health care experiences. More recent work is beginning to emerge that examines the social and behavioural aspects of health and health care. This study intends to contribute to this growing body of literature aimed at …

Research And Development Deliverables Under Government Contracts, Grants, Cooperative Agreements And Cradas: University Roles, Government Responsibilities And Contractor Rights, Danielle Conway-Jones

Computer Law Review and Technology Journal

More than anything, the United States Government is committed to research and development that will ensure America's position as the leader of nations. Nowhere is this truer than in the development of weapons and weapons systems, for these have, until recently, been the tools of superiority. From the tanks of World Wars I and II, to the guided weapons systems of today, to the unmanned fighting and space exploration vehicles of tomorrow, continued superiority of this nation will depend heavily upon the research and development of new technologies and innovation that must have dual uses for both the military and …

Recent Developments In Digital Copyright-The Internet Music Cases, Herbert J. Hammond, Corey Weinstein Jan 2004

Recent Developments In Digital Copyright-The Internet Music Cases, Herbert J. Hammond, Corey Weinstein

Computer Law Review and Technology Journal

Music sharing on the Internet has been a hotly debated topic in the last five years. Music sharing advocates claim that people should have the right to trade music that they have rightfully purchased. Opponents of this practice argue that swapping songs destroys the music industry and violates copyright law. While this debate has raged and the courts have taken up the issue, the file-swapping phenomenon has brought significant, unanticipated changes to the recording industry and to the ways consumers buy music.

Ethical Reflections On Cyberstalking, Frances Grodzinsky, Herman T. Tavani Jan 2004

Ethical Reflections On Cyberstalking, Frances Grodzinsky, Herman T. Tavani

School of Computer Science & Engineering Faculty Publications

This essay examines some ethical aspects of stalking behavior in cyberspace. We have argued elsewhere that recent online stalking incidents raise a wide range of ethical concerns, including issues affecting gender (Grodzinsky and Tavani, 2001), personal privacy (Tavani and Grodzinsky, 2002), and physical vs. virtual harm (Grodzinsky and Tavani, 2002). The primary axis of discussion in this essay has to do with implications that cyberstalking has for our notion of moral responsibility, both at the collective (or group) and individual levels. For example, do collectivities and organizations such as Internet service providers (ISPs) have any moral obligations to cyberstalking victims, …

The Media Dichotomy Of Sports Heroes And Sport Celebrities: The Marketing Of Professional Women's Tennis Players, Joshua Shuart

WCBT Faculty Publications

There is perhaps no better example of media created frenzy over heroism and celebrity than in the world of professional women’s tennis. Two of the most recognizable personalities, Venus Williams and Anna Kournikova, are known for very different reasons: Williams because of her on-court success and her rivalry with her sister Serena, Kournikova because of her on-court failures yet curiously strong endorsement success. Survey research was undertaken to examine perceptions of both women, to determine a) how society views them (as heroes or celebrities), and b) to determine their marketing worth, with regards to consumer intention to purchase an endorsed …

The Munich Pact Of 1938: Adr Strategies For Our Time?, Lionel D. Warshauer

Cardozo Journal of Conflict Resolution

This Note will focus on the Munich Pact in five parts. Part I will discuss and analyze the seemingly legitimate aspects of the Munich Negotiations. However, the positive aspects that can be drawn from Part I are sharply contrasted with the unprincipled elements from the Munich Negotiations in Part II. Part III will contrast Mussolini's role as a "mediator" at Munich with President Jimmy Carter's role as a mediator at Camp David. Part IV will focus on why the various forms of ADR that led to the Munich Pact-both negotiation and mediation-did not help achieve a lasting and fair settlement, …

Rites Of Passing: Foucault, Power, And Same-Sex Commitment Ceremonies, Ladelle Mcwhorter Jan 2004

Rites Of Passing: Foucault, Power, And Same-Sex Commitment Ceremonies, Ladelle Mcwhorter

Philosophy Faculty Publications

According to Catherine Bell, "The popular contention that ritual and religion decline in proportion to modernization has been something of a sociological truism since the mid-19th century". Conventional wisdom maintains that ritual practices just don't hold central importance in the lives of those raised in the industrialized world as compared with the importance such things had for our distant ancestors or for our contemporaries in non-industrial societies. Some have contended that this is because ritual tends to be strongly correlated with pre-scientific cosmological beliefs that our society has for the most part outgrown. But for whatever reason, " [c]omparatively speaking," …

Free To Fortune 500! The Debate Over Corporate Speech And The First Amendment, Rodney A. Smolla

Law Faculty Publications

While the Supreme Court shirked the merits of the corporate free speech debate in Nike v. Kasky with the cryptic dispatch that the petition for a writ of certiorari was "improvidently granted," the decision of those who organized this Symposium to proceed with scholarly commentary on the case was not improvidently made. One will find no shirkers here. ...

Cross Burning: Virginia V. Black, Rodney A. Smolla

Law Faculty Publications

My first encounter with Virginia's cross-burning law was in a meeting of the Virginia ACLU Legal Panel. I sat in a group of about a dozen other volunteer lawyers listening as potential cases were presented to the panel for review. We were told the story of a Ku Klux Klan leader who had been arrested for burning a cross during a Ku Klux Klan rally conducted on a backwoods farm in southwestern Virginia, with the permission of a landowner. A copy of the Virginia cross-burning statute was distributed for us to read:

It shall be unlawful for any person or …

Uncitral, Its Workings In International Arbitration And A New Model Conciliation Law, William K. Slate Ii, Seth H. Lieberman, Joseph R. Weiner, Marko Micanovic

Cardozo Journal of Conflict Resolution

"The [UNCITRAL] was created by the General Assembly in 1966 to enable the United Nations to play a more active role in reducing or removing legal obstacles to the flow of international trade." The U.N. recognized that various economic and legal differences existed between States. These differences were the source of many of the problems that hindered the advancement of an integrated international trade system. "The General Assembly considered it desirable that the process of harmonization and unification of the law of international trade be substantially coordinated, systemized, accelerated, and that a broader participation by States be secured."

Elemental Uptake In Relation To Root Characteristics Of Tall Fescue, Glenn E. Shewmaker, Douglas A. Johnson, Henry F. Mayland, Scott A. Martin, Susie B. Hansen Jan 2004

Elemental Uptake In Relation To Root Characteristics Of Tall Fescue, Glenn E. Shewmaker, Douglas A. Johnson, Henry F. Mayland, Scott A. Martin, Susie B. Hansen

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

HiMag, an accession of tall fescue (Festuca arundinacea Schreb.), was selected for high magnesium (Mg) concentration in leaves to reduce grass tetany risk to ruminants. However, the mechanism for enhanced Mg uptake in HiMag leaves has not been determined. The objective was to investigate if increased Mg uptake in HiMag could be explained by differences in elemental distribution among plant parts, root characteristics, or organic acid concentrations compared to its parental cultivars, ‘‘Kentucky 31’’ (KY31) and ‘‘Missouri 96’’ (MO96). The study was conducted on a surface-irrigated calcareous Portneuf silt loam (coarse-silty, mixed, mesic, Durinodic Xeric Haplocalcid). Vegetation and soil …

Does Baldrige Make A Business Case For Quality?, Mark L. Dean, Cynthia L. Tomovic Jan 2004

Does Baldrige Make A Business Case For Quality?, Mark L. Dean, Cynthia L. Tomovic

STEMPS Faculty Publications

The Malcolm Baldrige National Quality Award (MBNQA) is a widely accepted model promoting quality management as a means to business success. However, because business results are themselves part of the model, the contribution of the approach-deployment elements to results cannot be determined. The National Institute of Standards and Technology (NIST) maintains a history of Baldrige applications and the results of their evaluations. Statistical analysis of these data could yield insight into whether the approach-deployment advocated by the Baldrige model actually produces excellent results. Although NIST does not currently allow access to the data, future empirical evaluation of the data could …

Putting Genes Into Genetic Coefficients, P. Stephen Baenziger, Gregory S. Mcmaster, Wallace Wilhelm, Albert Weiss Jan 2004

Putting Genes Into Genetic Coefficients, P. Stephen Baenziger, Gregory S. Mcmaster, Wallace Wilhelm, Albert Weiss

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Plant parameters are critical inputs in crop simulation models and allow a general set of algorithms to represent features of specific cultivars. A subset of plant parameters is often referred to as "genetic coefficients". However, these genetic coefficients are developed from phenotypic observations, usually have a weak genetic basis, and are at best "genotypic" coefficients because they consider the genotype from a very integrative perspective and likely include some impact of environment on the trait or characteristic described. With increased understanding of crop genomes, we believe models can be improved by incorporating genetic coefficients that accurately describe the action of …

Deep Muscle Function In The Cervical Spine: Application To Musculoskeletal Modelling, Jonathon Green Jan 2004

Deep Muscle Function In The Cervical Spine: Application To Musculoskeletal Modelling, Jonathon Green

Theses : Honours

Neck pain in occupational tasks is a problem that involves a high cost to society therefore, understanding the mechanics of musculoskeletal loading is important in formulating preventative rehabilitation strategies. Musculoskeletal modelling of the neck provides a means by which to calculate loads on the components and muscles of the neck thus allowing quantitative data to be gained non-invasivcly for a wide range of occupational tasks. Anatomically detailed, electromyography (EMG) driven neck models require deep muscle EMG activation profiles which arc difficult to attain without invasive EMG procedures. The aim of this study was to determine whether EMG activity of semispinalis …

The Importance Of The Emotional Climate In Schools : Linking Teachers' Sense Of Belonging To School Community With Student Outcomes, Linda Rogerson Jan 2004

The Importance Of The Emotional Climate In Schools : Linking Teachers' Sense Of Belonging To School Community With Student Outcomes, Linda Rogerson

Theses : Honours

The way that children feel about school is important to their continued engagement with education. This review examines the issues that impact on the school environment and therefore influence students' school experience. A decline in educational standards in America prompted school reform research which has identified that the emotional climate in schools was impacting on students in that they felt alienated and disenfranchised from the school community. The emotional climate of a school stems from the nature of the relationship that exists between the students and staff of the school. A movement to establish caring community schools that promote the …

Can Anybody Own The Internet? : Microsoft, Open-Source And The Debate About Intellectual Property, Greg Stratton Jan 2004

Can Anybody Own The Internet? : Microsoft, Open-Source And The Debate About Intellectual Property, Greg Stratton

Theses : Honours

The Internet has become one of the most important mediums of communication and information in modem society. For many, the rapid adoption of these technologies into mainstream society has been combined with a reliance on commercial software, most notably the Microsoft Corporation's Windows operating system. Question arise out of the commercial dominance in a realm that until recently was characterised by the collective sharing of information and ideas. Although there is a lack of established sociological literature in this field, established literature on ownership, global capital, political economy and social exclusion have been identified and drawn upon to fill this …
