Indefinite Material Witness Detention Without Probable Cause: Thinking Outside The Fourth Amendment, Michael Greenberger Nov 2004

Indefinite Material Witness Detention Without Probable Cause: Thinking Outside The Fourth Amendment, Michael Greenberger

Faculty Scholarship

A constitutional issue recently addressed by the United States Court of Appeals for the Second Circuit in United States v. Awadallah, 349 F.3d 42 (2003), has not received the widespread attention of high-profile litigation concerning the Justice Department's other controversial counter-terrorism policies. It is equally important. The issue arises out of Attorney General Ashcroft's announcement shortly after the terrorist attacks of September 11, 2001 that the aggressive detention of material witnesses [was] vital to preventing, disrupting or delaying new attacks. Since that time, the Department of Justice has used the federal material witness statute (18 U.S.C. Section 3144) to …

Pastoralist Livestock Marketing Behavior In Northern Kenya And Southern Ethiopia: An Analysis Of Constraints Limiting Off-Take Rates, Christopher B. Barrett, John G. Mcpeak, Winnie Luseno, Peter D. Little, Sharon M. Osterloh, Hussein Mahmoud, Getachu Gebru Nov 2004

Osterloh, Hussein Mahmoud, Getachu Gebru

Economics - All Scholarship

Pastoralists in East Africa's arid and semi-arid lands (ASAL) regularly confront climatic shocks that plunge them into massive herd die-offs and loss of scarce wealth. One of the most puzzling features of pastoralist behavior in times of stress has been their relatively low and non-responsive rate of marketed off-take of animals when faced with likely losses to herd mortality. As Figure 1, from Desta (1999), finds in 17-year herd history data from Borana pastoralists in southern Ethiopia, mortality always exceeds net sales as a share of beginning period herd size, with the latter never exceeding three percent and moving hardly …

Integration Through Narrative, Michael E. Cafferky Nov 2004

Integration Through Narrative, Michael E. Cafferky

Faculty Works

The purpose of this paper is to test the proposition that narrative contains an inherent power for integration of faith, life, and learning of business principles. This is done by a process of reviewing assertions from selected disciplines with the revealed will of God in Scripture. To accomplish this, the paper explores narrative in the context of cultural anthropology, education, business, and religion. From these fields, several parallels can be seen, and several values of narrative for the university business school classroom emerge. The concluding thoughts suggest how instructors can use stories for faith, life, and learning integration.

A Maximal Chain Approach For Scheduling Tasks In A Multiprocessor Systems, Sachin Pawaskar, Hesham Ali Nov 2004

A Maximal Chain Approach For Scheduling Tasks In A Multiprocessor Systems, Sachin Pawaskar, Hesham Ali

Computer Science Faculty Proceedings & Presentations

Scheduling dependent tasks is one of the most challenging versions of the scheduling problem in parallel and distributed systems. It is known to be computationally intractable in its general form as well as several restricted cases. As a result, researchers have studied restricted forms of the problem by constraining either the task graph representing the parallel tasks or the computer model. Also, in an attempt to solve the problem in the general case, a number of heuristics have been developed. In this paper, we study the scheduling problem for a fixed number of processors m. In the proposed work, we …

Multivariate Contrasts For Repeated Measures Designs Under Assumption Violations, Lisa M. Lix, Aynslie M. Hinds Nov 2004

Multivariate Contrasts For Repeated Measures Designs Under Assumption Violations, Lisa M. Lix, Aynslie M. Hinds

Journal of Modern Applied Statistical Methods

Conventional and approximate degrees of freedom procedures for testing multivariate interaction contrasts in groups by trials repeated measures designs were compared under assumption violation conditions. Procedures were based on either least-squares or robust estimators. Power generally favored test procedures based on robust estimators for non-normal distributions, but was influenced by the degree of departure from non-normality, definition of power, and magnitude of the multivariate effect size.

Pseudo-Random Number Generation In R For Commonly Used Multivariate Distributions, Hakan Demirtas Nov 2004

Pseudo-Random Number Generation In R For Commonly Used Multivariate Distributions, Hakan Demirtas

Journal of Modern Applied Statistical Methods

An increasing number of practitioners and applied statisticians have started using the R programming system in recent years for their computing and data analysis needs. As far as pseudo-random number generation is concerned, the built-in generator in R does not contain multivariate distributions. In this article, R routines for widely used multivariate distributions are presented.

On A Simple Method For Analyzing Multivariate Survival Data Using Sample Survey Methods, Pingfu Fu, J. Sunil Rao Nov 2004

On A Simple Method For Analyzing Multivariate Survival Data Using Sample Survey Methods, Pingfu Fu, J. Sunil Rao

Journal of Modern Applied Statistical Methods

A simple technique is illustrated for analyzing multivariate survival data. The data situation arises when an individual records multiple survival events, or when individuals recording single survival events are grouped into clusters. Past work has focused on developing new methods to handle such data. Here, we use a connection between Poisson regression and survival modeling and a cluster sampling approach to adjust the variance estimates. The approach requires parametric assumption for the marginal hazard function, but avoids specification of a joint multivariate survival distribution. A simulation study demonstrates the proposed approach is a competing method of recent developed marginal approaches …

Costs And Benefits Of Strategic Acquisition Of Limited Access Right-Of-Way At Freeway Interchange Areas, Kristine M. Williams, Huaguo Zhou, Larry Hagen Nov 2004

Costs And Benefits Of Strategic Acquisition Of Limited Access Right-Of-Way At Freeway Interchange Areas, Kristine M. Williams, Huaguo Zhou, Larry Hagen

Transportation Planning, Policy, and Processes (TP3) Final Reports

The purpose of this research is to assess the cost effectiveness of purchasing additional limited access rightof- way at the time of construction in lieu of retrofitting interchange areas after functional failure. The findings indicate that the long term safety, operational, and fiscal benefits of purchasing additional limited access ROW at interchange areas, significantly exceed the initial up-front right-of-way costs. This is particularly true for new interchanges in areas where land has not yet been extensively subdivided and developed. Additional research is suggested to further refine and expand upon the results. Nonetheless, the magnitude of these results suggests that state …

A Tail-Recursive Machine With Stack Inspection, John Clements, Mathias Felleisen Nov 2004

A Tail-Recursive Machine With Stack Inspection, John Clements, Mathias Felleisen

Computer Science and Software Engineering

Security folklore holds that a security mechanism based on stack inspection is incompatible with a global tail call optimization policy; that an implementation of such a language must allocate memory for a source-code tail call, and a program that uses only tail calls (and no other memory allocating construct) may nevertheless exhaust the available memory. In this article, we prove this widely held belief wrong. We exhibit an abstract machine for a language with security stack inspection whose space consumption function is equivalent to that of the canonical tail call optimizing abstract machine. Our machine is surprisingly simple and suggests that …
