Affordance, Attention And Laterality, Lari Vainio Jan 2004

Affordance, Attention And Laterality, Lari Vainio

School of Psychology Theses

This thesis examines object-guided actions. Recently, micro-affordance effects have shown that a visual object affords actions automatically. These effects are observed when the grasp type (precision and power grasp) is facilitated by size (small and large) of the categorized object (the object-size effect), or when right or left hand responses are facilitated by object orientation (the object-orientation effect). It has been shown elsewhere that attentional mechanisms have a vital role in visually guided movements. In addition, visually guided movements have associated with hemispheric lateralization. Thus, the central focus of the thesis was the role of different components of attention (location-based-, …

A Dictionary Of Middle Egyptian For Students Of Biblical Archaeology And Old Testament Studies, Robert D. Bates Jan 2004

A Dictionary Of Middle Egyptian For Students Of Biblical Archaeology And Old Testament Studies, Robert D. Bates

Dissertations

Problem. Middle Egyptian has played an increasingly important role in Biblical Archaeology and Old Testament studies. Much of biblical chronology is closely connected to Egyptian chronology; many biblical events record Egyptian involvement, and some of these are included on Egyptian monuments. A knowledge of Middle Egyptian has been crucial in understanding the historical background and cultural context of the biblical world because this phase of the Egyptian language influenced the widest range of Egyptian writing, particularly as it pertains to Old Testament history. Unfortunately, students do not have all the necessary tools for searching for unfamiliar words in Middle Egyptian. …

Bolling Alone, Richard A. Primus Jan 2004

Bolling Alone, Richard A. Primus

Articles

Under the doctrine of reverse incorporation, generally identified with the Supreme Court's decision in Bolling v. Sharpe, equal protection binds the federal government even though the Equal Protection Clause by its terms is addressed only to states. Since Bolling, however, the courts have almost never granted relief to litigants claiming unconstitutional racial discrimination by the federal government. Courts have periodically found unconstitutional federal discrimination on nonracial grounds such as sex and alienage, and reverse incorporation has also limited the scope of affirmative action. But in the presumed core area of preventing federal discrimination against racial minorities, Boiling has virtually no …

Reparations As Redistribution, Kyle D. Logue Jan 2004

Reparations As Redistribution, Kyle D. Logue

Articles

The most controversial, and most intriguing, remedy sought by proponents of slavery reparations involves massive redistribution of wealth from whites to blacks within the United States. This is not to say that reparations proponents have focused only on racial redistribution. Some have called for an official apology from the U.S. government. Others seek the creation of a foundation or institute, funded by U.S. tax dollars, to be devoted to furthering the interests of African Americans, including the funding of K- 12 educational programs for black children and the funding of general civil rights advocacy to counteract the lingering effects of …

The Confrontation Clause Re-Rooted And Transformed, Richard D. Friedman Jan 2004

The Confrontation Clause Re-Rooted And Transformed, Richard D. Friedman

Articles

For several centuries, prosecution witnesses in criminal cases have given their testimony under oath, face to face with the accused, and subject to cross-examination at trial. The Confrontation Clause of the Sixth Amendment to the U.S. Constitution guarantees the procedure, providing that ‘‘[i]n all criminal prosecutions, the accused shall enjoy the right . . . to be confronted with the witness against him.’’ In recent decades, however, judicial protection of the right has been lax, because the U.S. Supreme Court has tolerated admission of outof- court statements against the accused, without cross-examination, if the statements are deemed ‘‘reliable’’ or ‘‘trustworthy.’’ …

Global Climate Change And Shifting Sea Ice: Planning For New Fishery Development In The Arctic, Kimberly Anne Lellis Jan 2004

Global Climate Change And Shifting Sea Ice: Planning For New Fishery Development In The Arctic, Kimberly Anne Lellis

Open Access Master's Theses

This thesis examines the implications of global warming for fisheries management in the Arctic waters off Alaska. In particular, the purpose of this thesis is to ascertain the current level of awareness, concern, and planning by physical scientists, social scientists, and federal and state resource managers for a potential future scenario that could develop in Alaska if: 1) warming ocean temperatures cause an expansion or a shift in the ranges of commercial fish species; and 2) the retreat of sea ice due to climate change allows commercial fishing fleets to expand into new areas such as the Chukchi Sea. Commercial …

Experimentalist Equal Protection, Brandon L. Garrett, James S. Liebman Jan 2004

Experimentalist Equal Protection, Brandon L. Garrett, James S. Liebman

Faculty Scholarship

Elsewhere Garrett and Liebman have recounted that though James Madison is considered "the Father of the Constitution," his progeny disappointed him because it was defenseless against self-government's "mortal disease " – the oppression of minorities by local majorities – because the Framers rejected the radical structural approach to equal protection that Madison proposed. Nor did the framers of the Fourteenth Amendment's Equal Protection Clause and federal courts enforcing it adopt a solution Madison would have considered "effectual." This Article explores recent subconstitutional innovations in governance and public administration that may finally bring the nation within reach of the constitutional polity …

Fear And Loathing In Massachusetts: Same-Sex Marriage And Some Lessons From The History Of Marriage And Divorce, Joanna L. Grossman Jan 2004

Fear And Loathing In Massachusetts: Same-Sex Marriage And Some Lessons From The History Of Marriage And Divorce, Joanna L. Grossman

Hofstra Law Faculty Scholarship

When Massachusetts became the first and only state in the union to issue legal marriage licenses to same-sex couples last May, the state's Governor, Mitt Romney, warned that "Massachusetts should not become the Las Vegas of same-sex marriage." Romney's warning makes sense only as a reference to Las Vegas' reputation for the "quickie" divorce - a heavily disparaged historical practice in which residents of other states would seek a divorce in Nevada because their home states would not grant them one, at least not on the terms or at the pace they desired. This essay retraces the history of divorce …

The State Of New York Does Exist: How States Control Compliance With International Law, Julian G. Ku Jan 2004

The State Of New York Does Exist: How States Control Compliance With International Law, Julian G. Ku

Hofstra Law Faculty Scholarship

Although most courts and commentators presume that the states disappear when it comes to foreign relations, states actually play a crucial role in fulfilling U.S. obligations under international law. In many circumstances, state governments are the only institutions responsible for carrying out treaty and customary international law obligations on behalf of the United States. Not only have states always played this role, but state control over the implementation of such obligations is likely to become even more important in the future because the implementation of many private international law and international human rights treaties is controlled by the states. This …

Harnessing The Treaty Power In Support Of Environmental Regulation Of Activities That Don't "Substantially Affect Interstate Commerce": Recognizing The Realities Of The New Federalism, Katrina Fischer Kuh Jan 2004

Harnessing The Treaty Power In Support Of Environmental Regulation Of Activities That Don't "Substantially Affect Interstate Commerce": Recognizing The Realities Of The New Federalism, Katrina Fischer Kuh

Hofstra Law Faculty Scholarship

This Article proposes a framework for applying the treaty power that would accomplish these goals. This framework would be applied where the President has signed, and Congress has ratified, a treaty and Congress has enacted domestic legislation in some way satisfying the goals or requirements of the treaty. Under this framework, the inquiry into whether the treaty power could appropriately be used by Congress in excess of its Article I, Commerce Clause powers would be indexed to the strength of (1) the contract- like nexus between the necessarily reciprocal requirements and the goals of the treaty and the specific statutory …

In Praise Of Statutes Of Limitations In Sex Offense Cases, James Herbie Difonzo Jan 2004

In Praise Of Statutes Of Limitations In Sex Offense Cases, James Herbie Difonzo

Hofstra Law Faculty Scholarship

This Article explores what happens when spectacular scientific breakthroughs are administered within a criminal justice system whose stance of impartiality is often undermined by sloppy or tainted analysis and testimony as it copes with the pressure to resolve an enormous backlog of DNA samples. A hypothetical case involving the problems an attorney might face in representing a client many years after an accusation of rape serves as the frame for a discussion of both the serious issues and suggested reforms. After this Introduction, Part II reconsiders the policy behind statutes of limitations, both as originally understood and in light of …

Tradeoffs In Community Properties Through Time In A Desert Rodent Community, Ethan P. White, S.K. Morgan Ernest, K. M. Thibault Jan 2004

Tradeoffs In Community Properties Through Time In A Desert Rodent Community, Ethan P. White, S.K. Morgan Ernest, K. M. Thibault

Biology Faculty Publications

Resource limitation represents an important constraint on ecological communities, which restricts the total abundance, biomass, and community energy flux a given community can support. However, the exact relationship among these three measures of biological activity remains unclear. Here we use a simple framework that links abundance and biomass with an energetic constraint. Under constant energetic availability, it is expected that changes in abundance and biomass can result from shifts in the distribution of individual masses. We test these predictions using long-term data from a desert rodent community. Total energy use for the community has not changed directionally for 25 years, …

Two-Phase Species-Time Relationships In North American Land Birds, Ethan P. White Jan 2004

Two-Phase Species-Time Relationships In North American Land Birds, Ethan P. White

Biology Faculty Publications

The species-time relationship (STR) is a macroecological pattern describing the increase in the observed species richness with the length of time censused. Understanding STRs is important for understanding the ecological processes underlying temporal turnover and species richness. However, accurate characterization of the STR has been hampered by the influence of sampling. I analyzed species-time relationships for 521 breeding bird survey communities. I used a model of sampling effects to demonstrate that the increase in richness was not due exclusively to sampling. I estimated the time scale at which ecological processes became dominant over sampling effects using a two-phase model combining …

Temporal Dynamics In The Structure Andcomposition Of A Desert Rodent Community, K. M. Thibault, Ethan P. White, S.K. Morgan Ernest Jan 2004

Temporal Dynamics In The Structure Andcomposition Of A Desert Rodent Community, K. M. Thibault, Ethan P. White, S.K. Morgan Ernest

Biology Faculty Publications

The rank-abundance distribution (RAD) represents the manner in which species divide resources. Community-specific division rules that determine resource allocation among species, and thereby the shape of the RAD, have been hypothesized to account for observed stability of local species richness over time. While the shape of the RAD has been well studied, the temporal dynamics of this distribution have received much less attention. Here we assess changes in the shape of the RAD through time in a desert rodent community in Arizona (USA). Because energy use may be more appropriate for studying resource division than abundance, we also evaluate an …

Since flight imposes physical constraints on the attributes of a flying organism, it is expected that the distribution of body sizes within clades of small-bodied flying vertebrates should share a similar pattern that reflects these constraints. We examined patterns in similarities of body mass distributions among five clades of small-bodied endothermic vertebrates (Passeriformes, Apodiformes + Trochiliformes, Chiroptera, Insectivora, Rodentia) to examine the extent to which these distributions are congruent among the clades that fly as opposed to those that do not fly. The body mass distributions of three clades of small-bodied flying vertebrates show significant divergence from the distributions of …

Thresholds Of Significance, Carmela M. Campbell Jan 2004

Thresholds Of Significance, Carmela M. Campbell

Master's Projects

This report provides a comprehensive understanding of environmental “Thresholds of Significance” by including a broad discussion of the general concepts associated with thresholds and by also providing a sample thresholds document for projects that occur on unincorporated Santa Clara County lands. The California Environmental Quality Act (CEQA) defines a thresholds as an identifiable quantitative, qualitative or performance level of a particular environmental effect. Non-compliance with a threshold results in a determination that a particular project may have a significant effect on the environment and necessitates preparation of an Environmental Impact Report.

CEQA encourages public agencies to adopt thresholds to standardize …

The Specter Of Speciesism: Buddhist And Christian Views Of Animals, Christopher Key Chapple Jan 2004

The Specter Of Speciesism: Buddhist And Christian Views Of Animals, Christopher Key Chapple

Theological Studies Faculty Works

Waldau's meticulous study assesses the origins of the term “speciesism,” coined by Ryder in 1970, and explores the link between speciesism and slavery, colonization, and the oppression of women and children. Just as ethical discourse has been transformed throughout history regarding these issues, the author argues that as more information becomes available, human attitudes regarding animals will evolve. Based on scientific research, he asserts that a new morality will arise that acknowledges the inherent moral standing of animals and will overturn the long-held view that animals serve only one purpose: to serve humanity.
