Inspiring Generations, Nancy J. King Jan 2004

Inspiring Generations, Nancy J. King

Michigan Law Review

It is difficult to imagine Michigan Law School without Yale Kamisar. He seems as much a part of the place as the Reading Room, the heavy oak doors, and the sounds of the marching band practicing, the steam heaters knocking, and the footsteps on the stone floors. That Michigan students will no longer experience his inspiration and guidance in person is sad, but inevitable. Fortunately, law students everywhere, and the law that they have learned to love, will never escape his influence. The editors of this issue have encouraged us to relate our own experiences with Yale. Mine started long …

The Illusion Of Law: The Legitimating Schemas Of Modern Policy And Corporate Law, Ronald Chen, Jon Hanson Jan 2004

The Illusion Of Law: The Legitimating Schemas Of Modern Policy And Corporate Law, Ronald Chen, Jon Hanson

Michigan Law Review

This Article is about some of the schemas and scripts that form and define our lives. It is about the knowledge structures that shape how we view the world and how we understand the limitless information with which we are always confronted. This Article is also about the "evolution of ideas" underlying corporate law and all of modern policymaking. It is about the ways in which schemas and scripts have influenced how policy theorists, policymakers, lawyers, and many others (particularly in the West) understand and approach policymaking generally and corporate law specifically. It is about both the invisibility and blinding …

Satirical Legal Studies: From The Legists To The Lizard, Peter Goodrich Jan 2004

Satirical Legal Studies: From The Legists To The Lizard, Peter Goodrich

Michigan Law Review

In Part I, I expand on the distinction between the Horatian and the Menippean forms of satire and then suggest that a similarly bold division can be used to map satirical legal studies. In support of that argument, I use the example of the earliest surviving satirical legal poem within the Western tradition. My analysis of this exemplary satirical legal artifact delineates four principal modes of legal satire that will organize the ensuing discussion of more contemporary examples of the genre. In Part II, I will address the currently popular and yet somewhat novel mode of ad hominem or nominate …

Trade Liberalization, Food Security And The Environment: The Neoliberal Threat To Sustainable Rural Development, Carmen G. Gonzalez Jan 2004

Trade Liberalization, Food Security And The Environment: The Neoliberal Threat To Sustainable Rural Development, Carmen G. Gonzalez

Faculty Articles

This article examines the historic and contemporary roots of chronic malnutrition and environmental degradation in the developing world. It chronicles the patterns of trade and production that contribute to this problem from the colonial period until the present, and analyzes the role of contemporary trade, aid and development practices in ameliorating or exacerbating the problem. The article argues that the neoliberal economic reforms imposed on developing countries through the International Monetary Fund (IMF), the World Bank, and the World Trade Organization (WTO) exacerbate hunger and environmental degradation by reinforcing pre-existing inequities in the global trading system that relegate many developing …

Education doctoral students in five different courses demonstrated their understanding of key concepts though creating multimedia learning products. This demonstration looks at the use of student-generated multimedia products as a pedagogical strategy to encourage learners to think more deeply about academic content. This demonstration shares over 20 different multimedia products from these different courses. The products are encouraging since students demonstrated a deeper level of academic understanding and a higher level of student engagement.

Reconstructing Electronic Surveillance Law, Daniel J. Solove Jan 2004

Reconstructing Electronic Surveillance Law, Daniel J. Solove

GW Law Faculty Publications & Other Works

After the September 11th attacks in 2001, Congress hastily passed the USA-Patriot Act which made several changes to electronic surveillance law. The Act has sparked a fierce debate. However, the pros and cons of the USA-Patriot Act are only one part of a much larger issue: How effective is the law that regulates electronic surveillance?

The USA-Patriot Act made a number of changes in electronic surveillance law, but the most fundamental problems with the law did not begin with the USA-Patriot Act. In this article, Professor Solove argues that electronic surveillance law suffers from significant problems that predate the USA-Patriot …

Sexual Misconduct And Ecclesiastical Immunity, Ira C. Lupu, Robert W. Tuttle Jan 2004

Sexual Misconduct And Ecclesiastical Immunity, Ira C. Lupu, Robert W. Tuttle

GW Law Faculty Publications & Other Works

This paper critically analyzes the possibility and structure of First Amendment defenses to actions, both private and public, arising out of sexual misconduct by members of the clergy. Part I traces the expansion of relevant theories of tort and criminal liability, and the waning of immunities, constitutional and statutory, that once applied to such actions. Part II of the paper advances a normative theory of the constitutional distinctiveness of religion, and ties that theory to the possibility of ecclesiastical immunity. Most conceptions of such immunity represent assertions of the liberty of religious organizations, and are grounded in the Constitution's Free …

The Effects Of A Distractor On Reaction Time Tasks In Rats: Mode Vs. Distribution Skew, Karen Melissa Damico Jan 2004

The Effects Of A Distractor On Reaction Time Tasks In Rats: Mode Vs. Distribution Skew, Karen Melissa Damico

Honors Theses

Animal models of attention have been used by researchers to better understand the neurophysiological basis of attention, as well as attentional disorders such as Alzheimer’s Disease and ADHD. Acetylcholine has been found to play a significant role in the ability of subjects to maintain focused attention in studies evaluating both human and animal performance. Percent omissions committed, performance accuracy, and reaction time are variables that have been interpreted by researchers as measures of attention. An alternate method for evaluating attention has been proposed that is based on dividing overall reaction time into initiation time and movement time. The initiation time …

An Analysis Of Pascal Lamy's Proposal On Collective Preferences, Steve Charnovitz Jan 2004

An Analysis Of Pascal Lamy's Proposal On Collective Preferences, Steve Charnovitz

GW Law Faculty Publications & Other Works

In September 2004, then-European Commissioner for Trade Pascal Lamy released his study on the political challenge of 'collective preferences' for the world trading system. Lamy defines 'collective preferences' as 'the end result of choices made by human communities that apply to the community as a whole'. The adoption of collective preferences by governments can complicate international trade when a good or service from an exporting country is not acceptable in an importing country. Collective preferences cause a problem for the WTO if the resulting measure violates WTO rules and yet the measure is too popular in the regulating country for …

Civic Renewal And The Regulation Of Non-Profits, Miriam Galston Jan 2004

Civic Renewal And The Regulation Of Non-Profits, Miriam Galston

GW Law Faculty Publications & Other Works

Civic Renewal and the Regulation of Non-profits analyzes four understandings of civic renewal, elaborated in the wake of Robert Putnam's book Bowling Alone, in light of the federal regulatory scheme imposed upon voluntary associations that qualify as "exempt organizations" under the Internal Revenue Code. These perspectives emphasize the primacy of one or more of the following as indispensable elements of civic health: (1) cooperation and effective collective action, (2) self-governance (3) equality and representative institutions, and (4) the moral character of the community or the public spiritedness of citizens. The study analyzes how the different assumptions and purposes of these …

Detection And Mapping Of Quantitative Trait Loci That Determine Responsiveness, Janet L. Mueller, E. A. Ellenberger, Linda K. Vaughn, John K. Belknap, Raymond M. Quock Jan 2004

Detection And Mapping Of Quantitative Trait Loci That Determine Responsiveness, Janet L. Mueller, E. A. Ellenberger, Linda K. Vaughn, John K. Belknap, Raymond M. Quock

Biomedical Sciences Faculty Research and Publications

Exposure to 70% N2O evokes a robust antinociceptive effect in C57BL/6 (B6) but not in DBA/2 (D2) inbred mice. This study was conducted to identify quantitative trait loci (QTL) in the mouse genome that might determine responsiveness to N2O. Offspring from the F2 generation bred from B6 and D2 progenitors exhibited a broad range of responsiveness to N2O antinociception as determined by the acetic acid-induced abdominal constriction test. QTL analysis was then used to dissect this continuous trait distribution into component loci, and to map them to broad chromosomal regions. To this end, …

Likelihood Of Confusion Jan 2004

Likelihood Of Confusion

San Diego Law Review

The primary objective of this Article is to illustrate the tendency of judges to inappropriately rely on personal intuition and subjective, internalized stereotypes when ruling on trademark disputes. Where jurists perceive consumers as ludicrously easily confused, trademark holders can exploit these views to secure broad trademark “rights,” often without offering a shred of evidentiary corroboration concerning such confusion. As a consequence, the proof required to support allegations that a trademark usage creates a likelihood of confusion is potentially lessened in all cases, making trademarks normatively stronger, broader, and ever easier to “protect” for mark holders. Whether consumers realistically benefit from …

History Of Costume : The Consumption, Governance, Potency And Patronage Of Attire In Colonial Western Australia, Damayanthie Eluwawalage Jan 2004

History Of Costume : The Consumption, Governance, Potency And Patronage Of Attire In Colonial Western Australia, Damayanthie Eluwawalage

Theses: Doctorates and Masters

This dissertation represents a new' departure in the study of dress in colonial Western Australia, focusing on the rationale behind individual and collective clothing practices in the new society. As a study of significant social and cultural practices, rather than an account of fashion, this research contributes to the understanding of previously disregarded elements in colonial Western Australian ethno-economic and social histories. The study investigates the internal and external influences which impacted upon colonial inhabitants' ways of dressing, their societal attitudes and social demeanour. The research compares the influences on attire and finery in colonial Western Australian society with the …
