"Don't Pooh-Pooh Our Poo Poo": Penalty, Subsidy, And Refusal To Fund In The Aftermath Of National Endowment For The Arts V. Finley, James Gaddy

Legal scholars said the National Endowment for the Arts v. Finley decision would create a "chilling effect" in government subsidy programs, and it unlawfully expanded the government speech doctrine. By analyzing cases that subsequently use Finley for a substantive part of their rationale, this article argues the opposite: the courts have rejected the government's attempts to interpret the decision as one that allows viewpoint discrimination and have not allowed the government to further a broad reading of the decision. The article also argues that, under the government speech doctrine, Finley provides the controlling precedent for truly "hybrid speech" cases where …

Rice bran oil (RBO) has been considered healthy cooking oil with potent effects to reduce the risks of atherosclerosis and coronary heart disease. The relatively high level of unsaponifiable components contributes to the healthy benefits of RBO. This study investigated the possibility that the cholesterol-lowering effects of oryzanol are through increased fecal steroid excretion. The objective was to compare fecal cholesterol and bile acid excretion as well as bioavailability among different forms of oryzanol. Bakso (Traditional Indonesian Meatball) Properties With Postmortem Condition And Frozen Storage, Dino Rahardiyan

Bakso is a finely comminuted boiled Indonesian meat product that is traditionally made of starch, salt and emulsified prerigor or early postmortem meat and often sold from street vendors. Recently processors have begun to commercially manufacture bakso. This research was conducted to investigate the substitution of early postmortem meat with postrigor meat to allow more efficient manufacturing and raw material procurement. The first experiment was to determine the properties of bakso with three tapioca starch concentrations added to early or late postmortem beef. No differences (p<0.05) were observed in bakso properties of composition and texture, though bakso made of post-rigor meat had slightly less elasticity, strength and shear. These disadvantages were compensated by incorporating 15% starch concentration, indicating that the replacement of early postmortem meat with postrigor meat was applicable in industrial mass production of bakso. The second phase of experiments was to investigate the properties of bakso with different frozen storage times of raw postrigor meat and after different times of frozen storage for bakso made from postrigor and early postmortem meat. Postrigor meat substitution for early postmortem meat in bakso with 15% tapioca starch resulted in minimum composition and textural differences (p>0.05). The profession of landscape architecture has struggled with public perception since the mid-nineteenth century. Community programs, coloring books, and educational toolkits are just some of the methods employed in the profession's attempt to improve public perception. Very little research has been conducted to test the efficiency of these educational attempts. The goal of this thesis is to create a Web-based program to effectively educate young members of the public. The program uses five "mini lessons" to present information about landscape architecture to the student. The Atchafalaya Basin in the Southern United States is a cultural, environmental, historical and natural land region of such universal importance, designation as a World Heritage Site is appropriate. This thesis provides a justification for this designation through compliance with cultural and natural criteria detailed in the Convention Concerning the Protection of the World Cultural and Natural Heritage of 1972. The treaty, also known as the World Heritage Convention (WHC) promotes natural and cultural landscape preservation on an international level. This thesis lists the cultural and natural arguments for nominating the Atchafalaya Basin to the World Heritage Site list.

This thesis takes a close look at the lived world of Jamaican Rastafarians through the lens of food-related practices and preferences, working to define the group's characteristic strategies for maintaining wellness and illuminating their tastes and sensibilities. It strives to evoke a sensorial and discursive awareness of the activities through which Rastafarians nourish and heal their physical and social bodies, by focusing on ways in which they produce and use I-tal food-medicines. Bioavailability and nutrient effects on the trophic transfer of Cadmium (Cd) associated with microalgae to the marine amphipod, Leptocheirus plumulosus, were investigated. Cd assimilation efficiencies (AE) were measured by a pulse-chase technique using a radiotracer. Cd AE in L. plumulosus significantly varied among algal species tested, and was highest (38.8 %) for the benthic diatom Nitzschia punctata, lowest (5.9%) for the planktonic diatom Thalassiosira weissflogii, and intermediate (15.6%) for the planktonic dinoflagellate Isochrysis galbana. Instantaneous egestion rates of Cd displayed a typical biphasic pattern over 96 h of depuration. Depuration in seawater-only of L. plumulosus yielded the highest Cd AE …

Lutein (3,3’-dihydroxy-alpha-carotene) has been identified by the Age-Related Eye Disease Study (AREDS) of the National Institute of Health (NIH) as a dietary compound with the ability to delay the onset and/or progression of age-related and/or diabetes-related vision loss. Lutein can also be useful in the prevention of other angiogenic diseases such as breast and colon cancer. This biographical study of the development of Marge Yates Jenkins into Louisiana's pre-eminent plantswoman examines the issues of culture and regional history, particularly the history of the horticultural industry in Louisiana. It traces how a self-taught botanist overcame the obstacles of gender and post-war depression to become an innovator in the nursery business, experimenting with native plants of the Southeast, as well as exotics imported from as far away as New Zealand. This research investigated the growth kinetic parameters (Ks and µmax) of the Kluyveromyces marxianus yeast strain for a batch process under aerobic and anaerobic conditions at 45oC using the Two-Liter Bioflo® 2000 Fermentors and the Orbital Shaker Bed with 250mL flasks (New Brunswick Scientific). This yeast strain was grown in twelve different glucose media concentrations (Anderson et al. 1986), ranging from 200 mg/L to 80,000 mg/L. Mummification can preserve a body for several millennia, but it is a popular misconception that these bodies are in pristine condition. The activities of tomb robbers, archaeological excavation and transportation, and the embalming process itself may damage the body. This thesis examines published reports on Egyptian mummies from museums in the United States, Europe, and Egypt for the presence of osteological fractures, dislocations and other related damage. These reports include biographical information and the results of investigations made by one or more of the following techniques: unwrapping, autopsying, x-raying, and CT-scanning. This work analyzes the concept of randomness in binary sequences from three different perspectives: mathematically, statistically, and psychologically and examines the research on human perception of randomness and the question of whether or not humans can simulate random behavior. Generally, research shows that human subjects have great difficulty producing random sequences, even when they are instructed and motivated. We survey some of the literature and present some leading theoretical proposals. Finally, we present some basic statistical tests that can be used to evaluate randomness in a given binary sequence.

The purpose of the current study was to examine the effectiveness of group-based language-literacy training for child care workers. The first phase of the study followed a pre-post single group comparison design and involved 23 child care providers. The independent variable was the teacher training and the dependant variable was scores from a questionnaire. The second phase of the study involved a sub-group of four child care workers who received one-on-one follow up training after the group sessions. Two laboratory feeding trials were conducted to quantify differences in the digestibility and absorption of dietary amino acids provided in intact protein or in purified amino acid mixtures. In the first experiment, 36 channel catfish (346 ± 47 g) were force-fed one of six practical feed ingredients (blood meal, corn meal, fish meal, meat and bone meal, soybean meal or wheat middlings), or a mixture of crystalline amino acids designed to duplicate the amino acid composition of each of the practical ingredients. Molecular evolution recovers the history of living species by comparing genetic information, exploring genome structure and function from an evolutionary perspective. Here we infer substitution rates and ancestral reconstructions, to better understand mutation responses to some known biochemical phenomena. Mutation processes are commonly inferred using parsimony, maximum likelihood and Bayesian. Parsimony is not explicitly model-based, and is statistically biased due to unrealistic assumptions. The model-based maximum likelihood approaches become computationally inefficient while analyzing large or high-dimensional datasets, leaving little opportunities to incorporate complex evolutionary models. We implemented a posterior probability (Bayesian) approach that evaluates evolutionary models, applying it to primate …

Defenders of transformative uses have invoked the First Amendment to bolster claims that such uses should not be subject to the copyright owner’s permission. But this focus on transformation is critically incomplete, leaving unchallenged much of copyright’s scope, despite the large number of nontransformative copying activities that are also instances of free speech. The current debate leaves the way open for expansions of copyright that, while not targeted at dissenting viewpoints, nonetheless may have a profoundly negative effect on freedom of speech. My thesis is that the left's problem regarding criminal justice is at least partially of its own making. Specifically, the problem stems from deep contradictions in the left's positions. Progressives have not one position on crime, but at least seven different ones, and these positions cannot be reconciled. Most of this essay consists of a taxonomy of conflicting progressive views on criminal justice. Before I begin, however, I need to qualify my thesis in three important ways. Northern bobwhite (Colinus virginianus) populations have been declining throughout their range during the past 30 years primarily because of a result of loss of early successional habitat. Specifically, intensive silviculture practices and reduction in the use of prescribed fire has led to this loss. I studied effects of management practices (selective herbicides, mowing, and prescribed fire) on male and covey distribution, and brood-rearing habitats on Jackson-Bienville Wildlife Management Area (JBWMA). These studies were conducted to elucidate the regional analgesic effect that is observed clinically after treatment of orthopedic disorders with application of extracorporeal shock waves in horses. Regional analgesia after treatment with extracorporeal shock waves presents a concern because it may eliminate protective limiting mechanisms and may place equine athletes with predisposing lesions at risk of sustaining career- or life-ending injuries. Direct percutaneous application of non-focused extracorporeal shock waves to palmar digital nerves in the pastern area of horses resulted in decreased sensory nerve conduction velocities compared with untreated control nerves at 3, 7, and 35 days after treatment. The photographers who worked for the Farm Security Administration Historical Section from 1935-1942 produced a large body of photographic work that now resides in the Library of Congress. These photographs serve as valuable visual resources for depicting an economically deprived section of America's population during the Great Depression and the Dust Bowl. Some of these photographers, like Walker Evans and Dorothea Lange, are widely recognized for their work, while others remain obscure. Microfocus x-ray computed tomography (μCT) is a powerful non-destructive scanning technique to study the internal fabric of granular materials. In this thesis, μCT was applied to two cases. The first case involves studying the behavior of particles in a triaxial specimen during shearing. Three-dimensional translation and rotation of the particles were tracked throughout the shearing process, and they were used to calculate the local strain distributions. Moreover, the local dilatancy angle distribution was calculated throughout experiment. What are the mechanisms underlying adaptation to load by locomotor systems? Amphibious shore crabs (Carcinus maenas) must routinely accommodate large load changes as they move in and out of water, where buoyancy supports a large percentage of their weight. Terrestrial fiddler crabs (Uca pugilator), aquatic red claw crabs (Sessarma mederi) and aquatic spider crabs (Libinia emarginata) are not routinely exposed to such large load changes. By comparing these species walking underwater and on land, it is possible to gain insight into general principles underlying load accommodation during locomotion.
