Survey Of Salamanders In Mississippi Limestone Caves, John G. Himes, David C. Beckett, Austin W. Trousdale Jan 2004

Survey Of Salamanders In Mississippi Limestone Caves, John G. Himes, David C. Beckett, Austin W. Trousdale

Faculty Publications

During 2000-2002 we surveyed for salamanders in the larger limestone caves of Mississippi, all within the Vicksburg Group rock unit. We found four species: Plethodon mississippi was the most abundant, followed by Eurycea guttolineata, Eurycea cirrigera, and Desmognathus conanti. We did not find Pseudotriton montanus in any of the caves, and question the validity of an investigator's statement made nearly 45 years ago that, "it is one of the most numerous salamanders in Mississippi. limestone caves." The salamander fauna we found is similar to that of the only other comprehensive survey of salamanders in Mississippi caves, conducted almost thirty years …

Lessons From La Morenita Del Tepeyac, Ana M. Novoa Jan 2004

Lessons From La Morenita Del Tepeyac, Ana M. Novoa

Faculty Articles

The concept that the powerful and wealthy have the absolute obligation to offer political, financial, and social liberation to those at the margins of society should have special importance to those who are lawyers and professionals of color. People spend considerable time working through, working in, and centered in the dominant, or caucasian European culture. The legal system regularly fails to see, accept, realize, or believe when truth is presented at the margins. Nonetheless, it is at the margins that true legal and personal reform take place. Even in a friendly environment, where people are encouraged to step outside the …

Law And Bioterrorism By Victoria Sutton (Book Review), Jeffrey F. Addicott Jan 2004

Law And Bioterrorism By Victoria Sutton (Book Review), Jeffrey F. Addicott

Faculty Articles

The best primer for constructing a legal framework surrounding bioterrorism is a wonderfully researched and incisive book by Professor Victoria Sutton. Sutton brings a vast background of experience and expertise to her book, titled Law and Bioterrorism, which is in fact the first legal textbook in the field of law and bioterrorism.

The book begins with a brief examination of the history of law and bioterrorism, from ancient biological warfare to modern times. Drawing upon the lessons of this history, Sutton discusses historical events such as the use of anthrax in World War I, and further examines the rapidly growing …

"Power Over This Unfortunate Race," Race, Power And Indian Law In U.S. V. Rogers, Bethany Berger Jan 2004

"Power Over This Unfortunate Race," Race, Power And Indian Law In U.S. V. Rogers, Bethany Berger

Faculty Articles and Papers

In 1846, the Supreme Court held in United States v. Rogers that a white man who had become a citizen of the Cherokee Nation through marriage was not an Indian for purposes of federal criminal jurisdiction. This article examines the extensive fabrications of law and fact that underlie the decision, and its part in a campaign by the executive branch to increase federal power over Indian people. The campaign involved the Attorney General of the United States arguing before the Supreme Court for the right to prosecute a man that had died ten months earlier. More profoundly, the campaign was …

Indian Policy And The Imagined Indian Woman, Bethany Berger Jan 2004

Indian Policy And The Imagined Indian Woman, Bethany Berger

Faculty Articles and Papers

In this contribution to the symposium on Santa Clara Pueblo v. Martinez held by the Tribal Law Center at the University of Kansas, I reflect (with pictures!) on the role of women in federal American Indian policy and tie this history to current debates about the Martinez decision. I argue that the perception by non-Indians that they were riding to the rescue of oppressed and exploited Indian women was always a powerful justification for Indian policy, but that the Indian women whose plight called out for European and American protection were not real women, but were instead imagined by the …

Spatial Updating Of Virtual Displays During Self- And Display Rotation, Maryjane Wraga, Sarah H. Creem-Regehr, Dennis R. Proffitt Jan 2004

Spatial Updating Of Virtual Displays During Self- And Display Rotation, Maryjane Wraga, Sarah H. Creem-Regehr, Dennis R. Proffitt

Psychology: Faculty Publications

In four experiments, we examined observers' ability to locate objects in virtual displays while rotating to new perspectives. In Experiment 1, participants updated the locations of previously seen landmarks in a display while rotating themselves to new views (viewer task) or while rotating the display itself (display task). Updating was faster and more accurate in the viewer task than in the display task. In Experiment 2, we compared updating performance during active and passive self-rotation. Participants rotated themselves in a swivel chair (active task) or were rotated in the chair by the experimenter (passive task). A minimal advantage was found …

Mainstreaming Complementary And Alternative Medicine In The Face Of Uncertainty, Barbara L. Atwell

Elisabeth Haub School of Law Faculty Publications

Part I of this article provides an overview of the medical necessity test, and examines the decision-making process pursuant to the test, including who makes coverage determinations and what criteria are used in making them. Part I also sets forth examples of conventional treatments that insurers routinely cover despite their questionable efficacy from a medical necessity perspective. Part II explores CAM disciplines and describes how they differ from conventional medicine. Part III discusses the legal challenges CAM faces and explores the limited extent to which CAM is covered by health insurance and the failure of state laws to provide mandates …
