There was a time when observers had the impression that European companies could think of no better gift from the government than a subsidy of some sort. Scrutiny of such governmental largess at the E.U. level was perceived as lax and any consequences for violating the E.U. competition rules against such handouts were seen as remote and timid. The Spirit Of Trips And The Importation Of Medicines Made Under Compulsory License After The August 2003 Trips Council Agreement, Jessica J. Fayerman

The Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement has changed prospects for access to necessary medications in the developing world. The use of compulsory licensing for pharmaceutical products embodied in Article 31 of TRIPS has been a contentious issue. Prior to 2003, countries with no manufacturing capacity of their own were not allowed to import medicines made under compulsory license, rendering the protections of Article 31 of little use to them. The 2003 Motta Agreement changed this. This expansion of the compulsory licensing power is both an impractical solution and it dilutes the premises upon which TRIPS was originally …

Odor problems are a common complaint from residents living near landfills. Many compounds can cause malodorous conditions. However, hydrogen sulfide (h2s) has been identified as a principal odorous component from construction and demolition (c&d)debris landfills. Although several studies have reported the ambient concentrations of h2s near c&d landfills, few studies have quantified emission rates of h2s. The most widely used and proven technique for measuring gas emission rates from landfills is the flux chamber method. Typically the flux chamber is a cylindrical enclosure device with a spherical top which limits the gas emission area. Pure zero grade air is introduced …

This Note explores the compatibility of the EC's GMO regulations within the framework of the Agreement on the Application of Sanitary and Phytosanitary Measures ("SPS Agreement"), the Agreement on Technical Barriers to Trade ("TBT Agreement"), and the General Agreement on Tariffs and Trade 1994 ("GATT 1994" or "GAT"), all integral parts of the WTO Agreement. Part II presents arguments for or against the use of GM-products. Part III explores the concept of ecolabeling by analyzing the general goals of such programs, including the economic theory behind green consumerism and the characteristics necessary for effective schemes. Regulation Of Stem Cell Research: A Recommendation That The United States Adopt The Australian Approach, Bryn E. Floyd

Research using embryonic stem cells may lead to great medical advances because of their ability to differentiate into nearly any type of human tissue. Currently, the United States regulates embryonic stem cell research by limiting the stem cell lines that can be studied using federal money or by scientists working at federally-funded institutions. The states are left to regulate privately funded research, if they choose. This creates a situation in which federally-funded research is severely limited, while private funds may be used to conduct ethically problematic research. Cajuns call it “choupique” (say “shoe-pick”), from its Choctaw name. Elsewhere, it’s the dogfish, blackfish, grindle, cottonfish, or cypress trout. Its official common name is “Bowfin” (Amia calva)1. But to most anglers, this is the “mudfish,” a strange, unusual, and much-maligned fish, most everywhere considered a useless trash fish. One look and the words relict, prehistoric, primitive, and living fossil come to mind. Indeed, the bowfin is the last of its line, the sole-surviving species of a very ancient group of fishes. Its predecessors flourished in the Jurassic and Cretaceous periods during the Mesozoic (= Middle-Animal) Era, a …

To provide a framework for assessment of mine development projects in the Pilbara, as well to plan conservation of groundwater biodiversity, the Department of Conservation and Land Management (CALM) is undertaking a five-year survey (2002 to 2007) of Pilbara stygofauna. The project aims to map regional patterns in subterranean biodiversity by sampling the range of groundwater environments that can be accessed via bores, wells, caves, springs, spring-brooks and hyporheic habitats. The first year of sampling has revealed many new stygal species, and indicate that stygofauna is abundant and widely distributed across the region, and occurs in several different aquifer types. …

White catfish (Ameiurus catus) is native to the Hudson River and is now coexisting with the recently established channel catfish (Ictalurus punctatus). These species were sampled from four freshwater reaches and four habitat types of the Hudson River estuary to assess whether the two species overlapped in their habitat use, and whether any impact on the native species was evident. Catfishes were sampled in 1998 and 1999 using baited hoop nets (N = 708 net nights). Catch-per-unit-effort (CPUE, number of fish per net night; total catch = 368) of white catfish was significantly different among reaches …

Multiculturalism And The Future Of Tribal Sovereignty, Scott C. Idleman

American Indian tribes would appear to be natural constituents and beneficiaries of the multiculturalism movement. Their members are generally conceptualized as racial or ethnic minorities; they have endured social and legal oppression and continue to encounter structural and even intentional discrimination; and, not least importantly, they possess genuinely different cultures and consequently add diverse perspectives to society. Despite this apparent fit, this Article questions the extent to which tribes and tribal members actually should align themselves with multicultural proponents and initiatives. The basis for this inquiry is that, unlike other societal subgroups, each recognized tribe is a distinct geopolitical entity …
