A Chose By Any Other Name: Domain Names As A Security Interest, Andrew B. Cochran Apr 2004

A Chose By Any Other Name: Domain Names As A Security Interest, Andrew B. Cochran

Canadian Journal of Law and Technology

There has been increasing study of the issues involved in using intellectual property as a security interest, but little corresponding consideration of domain names. The ascendancy in value of domain names to modern business increases their usefulness as a security interest to lenders and borrowers alike. Their use in this respect appears not to be weighed down by two of the most difficult issues facing intellectual property, namely conflicting jurisdiction between federal statutory interests and provincial property interests, together with establishing more readily acceptable methods of valuation. However, there is ambiguity about the actual form of ownership interest involved with …

Supporting The Critical Administrative Leadership Role Of County Directors, David Campbell, Jim Grieshop, Al Sokolow, Joan Wright Apr 2004

Supporting The Critical Administrative Leadership Role Of County Directors, David Campbell, Jim Grieshop, Al Sokolow, Joan Wright

Journal of Extension

With a foot in both the university and local communities, Cooperative Extension county directors have unique opportunities to network, scan opportunities, identify assets, design and market programs, build public support, and solve problems. A survey of the administrative workload, satisfactions, and frustrations of California county directors finds these leadership roles are insufficiently supported. The data suggest the need to 1) alter merit review policies to reward community connections and networking, 2) reinvent university support bureaucracies to treat county directors as valued customers, and 3) reassert a robust vision of county-based Extension at the highest levels of the organization.

Engaging County Educators In Science Education Reform: The New York 4-H Environmental Inquiry Program, Timothy Depriest, Marianne Krasny Apr 2004

Engaging County Educators In Science Education Reform: The New York 4-H Environmental Inquiry Program, Timothy Depriest, Marianne Krasny

Journal of Extension

We attempted to engage 4-H educators in facilitating science research experiences for youth. Through interviews and surveys of county educators and on-site observations, we determined that although nearly all educators implemented youth research projects, they faced challenges related to their own and their partner educators' lack of research experience and to fitting research projects into ongoing school curricula and county Extension programs. Future efforts might consider providing short research experiences for county educators and teachers to better enable them to facilitate research experiences for youth and thus to help schools meet inquiry-based science education standards.

An Educational Program Model For Pork Producers Pursuing Value-Added Marketing Opportunities, M Todd See Apr 2004

An Educational Program Model For Pork Producers Pursuing Value-Added Marketing Opportunities, M Todd See

Journal of Extension

An Extension program was developed to assist producers who are targeting products toward value-added markets. Market hogs from 11 producers were evaluated for hot carcass wt, lean composition, and fresh pork quality. Pork quality classification significantly differed by producer. These results were shared with producers during an educational program that described quality measures, presented individual results, and described methods to improve quality at the farm level. Producers were able to learn recommended production practices and share knowledge among their peer group. This program has helped pork producers improve pork quality, gain entry into value-added markets, and secure repeat sales.

Casablanca: Judgment And Dynamic Enclaves In Law And Cinema, Shulamit Almog, Amnon Reichman Apr 2004

Casablanca: Judgment And Dynamic Enclaves In Law And Cinema, Shulamit Almog, Amnon Reichman

Osgoode Hall Law Journal

By interpreting the narrative and imagery of the film Casablanca, this article seeks to explore the concept of law as enclave. An enclave is a domain-physical, virtual-emotional, conceptual, social or other-defined by certain boundaries and rules of entrance and exit. We argue that Casablanca is about constructing and reconstructing such enclaves. The structure of a pending journey between enclaves organizes the events taking place in Casablanca and constitutes their dynamic nature. Enclaves, we argue, are central to the structure and operation of the law. Recognizing the enclitic nature of law allows us a better grasp of the ethical dimensions of …

Blessed Broken Bodies: Exploring Redemption In Central Station And Breaking The Waves, Jeanette Reedy Solano Apr 2004

Blessed Broken Bodies: Exploring Redemption In Central Station And Breaking The Waves, Jeanette Reedy Solano

Journal of Religion & Film

I focus specifically on the theme of redemption as it is presented in two very different films: Walter Salles' moving Central Station (1998) from Brazil and Dane Lars Von Trier's haunting Breaking the Waves (1996). The former provides us with a tale of dual redemption while the latter film reinterprets the power of bodily redemption as Bess uses her body to broker salvation and healing for her paralyzed husband. Both these films force the viewer to critique traditional notions of redemption and revision alternatives. Both have broken women's bodies as pivotal symbols/events in the story and both affirm feminist theology's …

Money That Burns Like Oil: A Sri Lankan Cultural Logic Of Morality And Agency, Michele Ruth Gamburd Apr 2004

Money That Burns Like Oil: A Sri Lankan Cultural Logic Of Morality And Agency, Michele Ruth Gamburd

Anthropology Faculty Publications and Presentations

New labor opportunities have drawn Sri Lankan women to work as domestic servants in the Middle East. Many migrants complain that their remittances "burn like oil," disappearing without a trace. The gendered discourse on burning remittances both draws on and contradicts an older cultural system that fetishizes money. The emerging logic provides symbolic resources for women to spend their remittances on advancements for the nuclear family, distancing themselves from other kin. Felony Jury Sentencing In Practice: A Three-State Study, Nancy J. King, Rosevelt L. Noble Apr 2004

Felony Jury Sentencing In Practice: A Three-State Study, Nancy J. King, Rosevelt L. Noble

Vanderbilt Law Review

The Court's recent decision in Apprendi v. New Jersey, 530 U.S. 466 (2000), has prompted renewed interest in sentencing by jury in non-capital cases. Yet jury sentencing in felony cases remains one of the least understood procedures in contemporary American criminal justice. This Article looks beyond idealized visions of jury sentencing to examine for the first time how felony jury sentencing actually operates in three different states-Kentucky, Virginia, and Arkansas. Dozens of interviews with prosecutors, defenders, and judges, as well as an analysis of state sentencing data, reveal that this neglected corner of state criminal justice provides a unique window …

Bucking The Trend: The Unsupportability Of Index Providers' Imposition Of Licensing Fees For Unlisted Trading Of Exchange Traded Funds, Peter N. Hall Apr 2004

Bucking The Trend: The Unsupportability Of Index Providers' Imposition Of Licensing Fees For Unlisted Trading Of Exchange Traded Funds, Peter N. Hall

Vanderbilt Law Review

Exchange traded funds (ETFs) are popular investment products that have recently generated substantial investment press, several new regulations, huge earnings for the securities markets, and potential legal conflicts that will likely lead to major litigation. ETFs are derivative securities that represent ownership in funds, unit investment trusts, or depositary receipts with portfolios of securities designed to track the performance and dividends of specific securities indices.' ETFs track indices by holding a representative sampling of securities in the index, thus approximating investment results of the index as a whole. They may or may not hold all the stocks in a particular …

Comparative Analysis Of Serologic Assays For The Detection Of Antibodies To Eastern Equine Encephalomyelitis Virus In Sentinel Chickens, Christy L. Voakes Apr 2004

Comparative Analysis Of Serologic Assays For The Detection Of Antibodies To Eastern Equine Encephalomyelitis Virus In Sentinel Chickens, Christy L. Voakes

USF Tampa Graduate Theses and Dissertations

Florida's mild climate supports year round enzootic transmission of arthropod-borne (arbo) viruses, such as St. Louis Encephalitis virus (SLEV), West Nile virus (WNV), and Eastern Equine Encephalomyelitis virus (EEEV). First isolated in 1960 from two Florida blue jays, Highlands J virus (HJV) is endemic to the state and vectored by the same mosquitoes as EEEV (Henderson et al, 1962). EEEV and HJV are both alphaviruses, but HJV is not pathogenic to humans, occasionally causes encephalitis in horses, and is a recognized pathogen in some bird species (turkeys, emus, etc) (Cilnis et al, 1996).

The Florida Sentinel Chicken Arboviral Surveillance …

Seed Bank Response To Fire And Successional Trajectory Of A Virginia Small Depression Pocosin, Jay F. Bolin Apr 2004

Seed Bank Response To Fire And Successional Trajectory Of A Virginia Small Depression Pocosin, Jay F. Bolin

Biological Sciences Theses & Dissertations

Pocosins are depressional wetlands maintained by fire. Plants in fire adapted systems can use a variety of mechanisms for survival and recruitment. I examined the seed bank response to fire (500 to 700 °C) and wet heat treatments (50 and 75 °C) in a Virginia small depression pocosin. I quantified seedling abundance, richness, and Sphagnum density. Extant vegetation was sampled with a nested plot design at each seed bank sampling area. The seed flora was compared with the extant vegetation at three size classes with Sorenson similarity values. Data from the fire treatment indicates that a simulated drought burn may …

Nutrient Concentrations In Manure Storage Facilities, John Harrison, Dallen Smith Apr 2004

Nutrient Concentrations In Manure Storage Facilities, John Harrison, Dallen Smith

All Current Publications

The objective of this fact sheet is to help producers understand the nutrient loss and retention characteristics of different types of manure storage. The concentration of nutrients in manure storage facilities is important for planning land application activities. Nutrient concentration is usually the critical factor in determining the amount of manure to be spread per acre of land. Manure systems similar in type and management may have characteristically similar concentrations of manure nutrients.
