Avoiding The Golden Fleece: Licensing Agreements For Archives, Nancy E. Loe

Library Scholarship

The need to negotiate licenses protecting the rights to intellectual property in archives is an emerging and complex area. This article provides archivists with a better understanding of the legal and economic issues arising from commercial requests for archival materials, examining five key areas relating to licensing: the technology, the players, the economics, the rights and the consequences. The article presents guidelines, strategies, and a sample licensing agreement to help archivists make informed decisions about whether and on what terms to license materials from their collections for commercial use.

Translocation As A Strategy To Rehabilitate The Queen Conch (Strombus Gigas) Population In The Florida Keys, Gabriel A. Delgado, Claudine T. Bartels, Robert A. Glazer, Nancy J. Brown-Peterson, Kevin J. Mccarthy Apr 2004

Translocation As A Strategy To Rehabilitate The Queen Conch (Strombus Gigas) Population In The Florida Keys, Gabriel A. Delgado, Claudine T. Bartels, Robert A. Glazer, Nancy J. Brown-Peterson, Kevin J. Mccarthy

Faculty Publications

Queen conch (Strombus gigas) stocks in the Florida Keys once supported commercial and recreational fisheries, but overharvesting has decimated this once abundant snail. Despite a ban on harvesting this species since 1985, the local conch population has not recovered. In addition, previous work has reported that conch located in nearshore Keys waters are incapable of spawning because of poor gonadal condition, although reproduction does occur offshore. Queen conch in other areas undergo ontogenetic migrations from shallow, nearshore sites to offshore habitats, but conch in the Florida Keys are prevented from doing so by Hawk Channel. The present study was initiated …

Endangered Species Act Innovations In The Post-Babbittonian Era--Are There Any?, J.B. Ruhl Apr 2004

Endangered Species Act Innovations In The Post-Babbittonian Era--Are There Any?, J.B. Ruhl

Vanderbilt Law School Faculty Publications

One of the mysteries of environmental policy in the Bush Administration will be how and why it squandered an opportunity to continue market-based administrative reforms of the Endangered Species Act begun, ironically, in the Clinton Administration under the direction of then Secretary of the Interior Bruce Babbitt. This article traces the momentum built for reform in the Babbittonian era and examines what has not happened since then.

The Battle Over Endangered Species Act Methodology, J.B. Ruhl Apr 2004

The Battle Over Endangered Species Act Methodology, J.B. Ruhl

Vanderbilt Law School Faculty Publications

The substantive contours of the Endangered Species Act (ESA) have been largely worked out for quite some time. Starting in the mid-1990s, however, opponents of Fish and Wildlife Service and National Marine Fisheries Service decisions realized that the methodological contours of the ESA were not nearly as settled as their substantive kin. Industry and environmental interests alike appreciate that how these methodological rules get worked out could revolutionize the ESA for decades to come, and during the 1990s they opened the debate over ESA methodology and have been going strong at it ever since. This Article explores the breadth and …

“We Navigated By Pure Understanding”: Bishop George T. Sevey's Account Of The 1912 Exodus From Mexico, Michael N. Landon Apr 2004

“We Navigated By Pure Understanding”: Bishop George T. Sevey's Account Of The 1912 Exodus From Mexico, Michael N. Landon

BYU Studies

During July and August 1912, thousands of Mormon colonists fled the turmoil of the Mexican Revolution (fig. 1). As bishop of the Colonia Chuichupa ward, George Sevey led his ward members out of war-torn Mexico and into the United States. The scene was not unfamiliar. During the nineteenth century, Latter-day Saints had fled from Missouri and Illinois, and thousands more had experienced the great exodus across the plains to the Salt Lake Valley. Such epic events enrich the heritage of Latter-day Saints, providing cultural meaning and shared identity forged by hardship and tragedy. Perhaps the effort to chronicle flight from …

Developmental Changes In Pedunculopontine Nucleus (Ppn) Neurons, T. Kobayashi, C. Good, J. Biedermann, Christina B. Cooley, R. D. Skinner, E. E. García-Rill

Chemistry Faculty Research

The developmental decrease in rapid-eye-movement (REM) sleep in man occurs between birth and after puberty. We hypothesize that if this decrease in REM sleep does not occur, lifelong increases in REM sleep drive may ensue. Such disorders are characterized by hypervigilance and sensory-gating deficits, such as are present in postpubertal onset disorders like schizophrenia, panic attacks (a form of anxiety disorder), and depression. The decrease in REM sleep in the rat occurs between 10 and 30 days of age. We studied changes in size and physiological properties of pedunculopontine nucleus (PPN) cells involved in the control of arousal, i.e., waking …

A Comparison Of Anuran Species Richness Between Primary And Secondary Forest In São Francisco Do Pará, Michael Reichert Apr 2004

A Comparison Of Anuran Species Richness Between Primary And Secondary Forest In São Francisco Do Pará, Michael Reichert

Independent Study Project (ISP) Collection

Deforestation in the Amazon has become a serious conservation issue. The process of destruction of primary forest results in the creation of secondary forest that differs from primary forest in a number of important ways. Anurans (frogs and toads) are one group that may be affected by the loss of primary forest and creation of secondary forest areas, and are an important focus for conservation efforts. Previous studies on anuran reactions to loss of primary forest have been few and inconclusive. This study examined anuran species richness in an area of primary and secondary forest in order to determine whether …

Un Tren Que Pasa: La Lucha De La Faa Por Alcanzar La Representación En El Mercosur, Heather John Apr 2004

Un Tren Que Pasa: La Lucha De La Faa Por Alcanzar La Representación En El Mercosur, Heather John

Independent Study Project (ISP) Collection

In response to the Common Market of the South (MERCOSUR) process of regional economic integration which began in 1991, in 1994 national organizations of family farmers from the member countries formed a transnational coalition entitled La Coordinadora de Organizaciones Agricultores Familiares del MERCOSUR (COPROFAM) to represent themselves at the regional level. This study examines the reasons why the Federación Agraria Argentina (FAA), the largest member from Argentina and a longstanding Argentine institution, chose to represent itself as part of a transnational coalition at this regional level. Furthermore, it attempts to answer what the obstacles and successes of COPROFAM have been …

Commons Ignorance: The Failure Of Environmental Law To Produce Needed Information On Health And The Environment, Wendy E. Wagner Apr 2004

Commons Ignorance: The Failure Of Environmental Law To Produce Needed Information On Health And The Environment, Wendy E. Wagner

Duke Law Journal

One of the most significant problems facing environmental law is the dearth of scientific information available to assess the impact of industrial activities on public health and the environment. After documenting the significant gaps in existing information, this Article argues that existing laws both exacerbate and perpetuate this problem. By failing to require actors to assess the potential harm from their activities, and by penalizing them with additional regulation when they do, existing laws fail to counteract actors' natural inclination to remain silent about the harms that they might be causing. Both theory and practice confirm that when the stakes …

Monuments To A Lost Nation, Theodore Karamanski Apr 2004

Monuments To A Lost Nation, Theodore Karamanski

History: Faculty Publications and Other Works

With the bright orange glow of the setting sun at their backs, the chiefs and headmen of the Potawatomi people faced the commissioners of the United States government. Most were grave and morose as they signed the treaty ceding their homelands in the Chicago area and agreeing to removal beyond the Mississippi. The 1833 Treaty of Chicago was one of a series of agreements that terminated the native title to the American heartland and seemed to end Native American presence in the life and culture of Chicago. But a rediscovery of the city's native roots emerged in the late nineteenth …

Exploring Perimeter And Area With 4th Graders, Amber Lieberg Winkler Apr 2004

Exploring Perimeter And Area With 4th Graders, Amber Lieberg Winkler

The Mathematics Enthusiast

I am going to teach basic introductory geometry skills to 4th graders using Geometry’s Sketchpad. At this age, children are only beginning to learn about geometry in their math classes, and I would like for the students to understand these basic concepts using technology. This problem is so important for the students to learn early, and learn correctly. These skills will involve finding the area and perimeter of regular polygons, basic skills using Geometry’s Sketchpad, and activities that will apply these introductory concepts; directly correlating within the national geometry standards of mathematics. Children use geometry everyday, even when they don’t …
