The goal of this study was to increase the probability of success for future mitigation wetland projects by performing a hydrologic investigation at three constructed mitigation wetland sites and one natural reference wetland site. In addition, a numerical groundwater model was developed for a portion of one of the constructed mitigation wetlands.;Hydrologic, meteorologic, topographic, and geotechnical data were collected at three constructed mitigation wetlands and one reference natural wetland. Hydrologic data were collected using monitoring wells, piezometers, automated water level recorders, and a water level meter. Solid particle erosion in ductile materials is a common problem in many industrial applications. It is defined as material loss resulting from the mechanical contact between the particle and the metal surface. Many experimental studies were reported in the past to determine the loss of the material due to these ductile impacts. The objective was to study the effects of nicotine and cigarette smoke on mechanical properties of cortical bone. Experiments were conducted for 5 weeks with New Zealand White Rabbits. The first experiment of 18 rabbits studied the effect of nicotine levels delivered via a nicotine patch (5.25, 10.5, 21 ng/ml), measured by different mechanical tests, porosity, and composition. There was no significant difference between the control and the treatment groups.;The second experiment of 22 rabbits studied the effects of nicotine delivered via a nicotine patch (10.5 ng/ml) and via a smoking chamber on fracture toughness and porosity. This article will discuss the case at the trial and appellate levels. It will specifically address the underlying policy debate between the majority and the dissenting decisions at the Federal Court of Appeal. The author will compare this debate to two similar international cases involving Lego’s infamous intellectual property litigation. With this recent finding in the 40-year-old saga of international case law surrounding Lego’s trade-mark enforcement strategy, the Appeal Division of the Federal Court of Canada joins the ranks of several other courts that have similarly excluded protection for Lego based on the doctrine of functionality. How can groups elicit and aggregate the information held by their individual members? There are three possibilities. Groups might use the statistical mean of individual judgments; they might encourage deliberation; or they might use information markets. In both private and public institutions, deliberation is the standard way of proceeding; but for two reasons, deliberating groups often fail to make good decisions. First, the statements and acts of some group members convey relevant information, and that information often leads other people not to disclose what they know. Second, social pressures, imposed by some group members, often lead other group members to …

Reported enrollments of students taking online courses in institutes of higher learning in the 2000-01 academic years were estimated at 3.077 million, according to the U.S. Department of Education’s National Center for Educational Statistics (NCES). Dramatic enrollment increases have led to a need for research that involves both the comparison of learning achievement based on delivery mediums, and student attitudes concerning alternative delivery methods. This study compared the learning achievement of students when the deliveries of course lectures were presented both in-class and online, as well as measured attitudes of students concerning delivery mediums. Geographically widespread ectotherms encounter thermal gradients that generate variation in behavior, physiology and life-history. Because rates of physiological processes are very sensitive to temperature, cold environments are thought to favor genotypes that have relatively high capacities for growth despite environmental constraints. Two different adaptive responses can occur: (1) mothers in colder environments can allocate more energy to each offspring, or (2) offspring in colder environments make more efficient use of available resources. In this study, I examined both maternal adaptations and embryonic adaptations to environmental temperature. We tested the hypothesis that glucose-insulin-potassium (GIK)-induced protection against myocardial infarction depends on ATP-dependent K+ (KATP) channel activation and is abolished by hyperglycemia before the ischemia. Dogs were subjected to a 60-min coronary artery occlusion and 3-h reperfusion in the absence or presence of GIK (25% dextrose; 50 IU insulin/l; 80 mM/l KCl infused at 1.5 ml·kg−1·h−1) beginning 75 min before coronary artery occlusion or 5 min before reperfusion. The role of KATP channels was evaluated by pretreatment with glyburide (0.1 mg/kg). The efficacy of GIK was investigated with increases in blood …

A 2-day hands-on workshop was developed in collaboration with industry partners. The objectives are to provide participants with a basic understanding of the beef grading system and Beef Quality Assurance (BQA) and to demonstrate how these principles relate to them and the beef industry as a whole. Each workshop is limited to 20 participants, with sponsorship from various industry groups, including the Utah Cattlemen's Association. Participants are taken through various exercises, including live animal and carcass evaluation and fabrication of carcasses into wholesale and retail product. This article describes the results of three integrated pest management (IPM) surveys of corn, soybean, and small grains farmers in the coastal plains region of Virginia. Farmers identified their weed, disease, insect, and animal pests, and the reasons they use (or do not use) IPM practices for those pests.

An opportunity arose at Louisiana State University (LSU) to teach a forage ecology and management course over distance education to 30 Extension agricultural field agents. Many of these agents had not taken a college-level course in several years. All of the agents performed well in the course. While the distance education technology worked reasonably well in this course, the majority of the agents indicated that they would still rather take courses in a conventional classroom setting. Results of this teaching experience indicate that distance education technologies provide unique opportunities but that maintaining direct student-instructor interaction can be a challenge.

Previous studies of advice characterized it as a discourse in which authority is afforded to the giver by virtue of being asked for advice. As an authoritative discourse, advice sets the standards by which interlocutors base their judgments of normalcy. The consequences of these judgments are multiplied when advice is given as part of public, institutional talk, such as with radio call-in programs. This thesis examines how the authoritative discourse of global advice (public, commercial advice) is used to construct and normalize human experiences, specifically gender and sexuality. This Article starts with a general doctrinal introduction to the Bankruptcy Code sections and case law that control the creation and appointment of committees. The Article then provides case studies from four large corporate reorganizations: Enron, Kmart, Global Crossing, and Pacific Gas and Electric. These case studies reveal the wide variety of factual and legal setting in which the appointment of special interest committees can become an important threshold legal issue in bankruptcy law. "Textualism" is a very general and abstract term that represents a variety of views about the interpretation of legal texts. One strand of textualism is conceptual and descriptive; this strand makes claims about what texts actually mean. Another strand of textualism is normative; this strand makes claims about how judges ought to proceed when they interpret particular kinds of legal texts, such as constitutions and statutes. Steven Hartwell explores the growth and value of teaching experientially in this article. Experiential teaching emerged when clinical legal education grew in response to student demands for a more relevant education. The educational advantages of the field clinic model are substantial: students are more motivated to lean, the learning is direct and based on real experience, it entails both cognitive and affective domains, and raises ethical issues by working with real clients. The author examines David Kolb's theory of experiential learning; the basic premise of that theory is that effective learning takes place experientially in a continuous, circular four-stage sequence. …

General jurisdiction is one of the most controversial aspects of the current jurisprudence of personal jurisdictions. General jurisdiction refers to a state's exercise of personal jurisdiction over a nonresident defendant in a lawsuit not arising out of or related to the defendant's contacts with the forum. General jurisdiction is particularly controversial in international litigation involving foreign defendants who do business in the United States. This article examines the potential limitations on the exercise of general jurisdiction in the context of international civil litigation.

The American Constitution at its founding is often associated with "the Enlightenment," and modern liberal constitutionalism continues to be associated with what Bruce Ackerman refers to as "the spirit of the Enlightenment." This article contrasts the essential features of the classical or historical Enlightenment with those of the modern Enlightenment, as reflected in the thinking of theorists like Rawls, Dworkin, and others and as embodied in a good deal of modern constitutional doctrine. The article argues that the modern Enlightenment is more accurately viewed as an inversion than a continuation of the classical Enlightenment. Moreover, this inversion threatens to undermine …

This fact sheet provides pasture managers with a technique to improve their abilities to budget forage to livestock and determine amounts of forage to reserve for mechanical harvest. They can also use the technique to estimate harvest efficiency and pasture growth rates, forecast future forage supply and plan adjustments in stocking rate to balance forage supply with livestock demand.

Cynthia Hallen invited students in her History of the English Language course to search for conjoined word pairs in the scriptures as a term project. They searched for pairs of words linked with conjunctions in order to better understand the meaning of selected set expressions in the King James Bible and the Book of Mormon. Since time immemorial, humans have found meaning and purpose in revering sites because of events that transpired there. Such sites offer an opportunity for pilgrims to visit sacred places. Members of the Church of Jesus Christ have tried not to create shrines or pilgrimage sites per se, but they often experience deep religious attachment to sacred places where significant events occurred. In the early 19th century, however, relatively few people traveled for tourism or pleasure. Noted historian Donald Jackson described Lewis and Clark as “the writingest” explorers of their time. It is simply amazing that a significant amount of their journals survived the explorations across the North American continent from 1803 to 1806. However, the task to organize those journal notes into a comprehensive report also proved to be a challenge that eventually took longer than the expedition itself.
This report documents another lengthy journey—and in a more timely manner. That journey is the one taken by the dedicated people who organized the 200th anniversary commemoration of Lewis and Clark’s journeys through what is now …
