Three Steps And You're Out: The Misuse Of The Sequential Evaluation Process In Child Ssi Disability Determinations, Frank S. Bloch Oct 2003

Three Steps And You're Out: The Misuse Of The Sequential Evaluation Process In Child Ssi Disability Determinations, Frank S. Bloch

University of Michigan Journal of Law Reform

The federal Supplemental Security Income (SSI) program provides cash benefits to financially needy persons who are 65 years of age or older, blind, or disabled. It also provides cash benefits to children with disabilities under the age of 18. This Article examines three sets of regulatory efforts to implement special disability standards for children, based first on the original SSI legislation, then on a seminal Supreme Court decision, and finally on amendments to the Social Security Act overruling the Court's decision, and shows how the "sequential evaluation process," which has been useful for adjudicating adult disability claims, has been a …

On Katherine Frank's G-Strings And Sympathy: Strip Club Regulars And Male Desire, Kristen Schilt

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Katherine Frank's book, G-Strings and Sympathy, provides an anthropological look into the fantasies of male strip club regulars in a Southern City she calls Laurelton. Turning the gaze onto the gazers, a group left unstudied in the majority of literature on sex work, Frank unpacks how trips to the strip club are closely linked with discourses about sexuality, consumption and masculinity. Through six years of participant observation at a variety of clubs in Laurelton and in-depth interviews with thirty self-professed strip club regulars, Frank delves into not only why these men attend strip clubs but how these visits …

Construction Of Tire Shreds Test Embankment, Rodrigo Salgado, Sungmin Yoon, Nayyar Zia Siddiki Oct 2003

Construction Of Tire Shreds Test Embankment, Rodrigo Salgado, Sungmin Yoon, Nayyar Zia Siddiki

JTRP Technical Reports

According to recent research, it is estimated that there are more than 500 million tires stockpiled across the United States, and 270 million more are generated each year. A significant number of tires are left in empty yards and even dumped illegally. Tires have characteristics that make them not easy to dispose, and potentially combustible. For these reasons, there is a strong need to find beneficial ways to recycle or reuse tires. Civil engineering applications constitute one of biggest markets for scrap tires. Tire shreds can be used as fill material, for example. The objective of this research is to …

Implementation Of Steel Bridge Protection Policy, Luh M. Chang, Po-Han Chen, Sangwook Lee

JTRP Technical Reports

Many Departments of Transportation (DOTs) have made tremendous efforts for managing their civil infrastructure systems effectively and to meet public demands for their performance and safety. The introduction of warranties help many DOTs keep their construction with better quality by shifting post-construction responsibilities to contractors. Warranties are applied to numerous items according to each DOT’s needs, and this research focuses on steel bridge painting protection policy for Indiana Department of Transportation (INDOT). This research represents the development of an implementable warranty clause for protecting steel bridge painting and the image processing technique for the objective and quantitative painting quality assessment. …

On-Station Production Of Native Speargrass Hay In Western Australia, G L. Krebs, Robert R. Rouda, S P. Van Wyngaarden

Bulletins 4000 -

This report documents the practical and economic feasibility of on-station harvesting and production of speargrass hay and haylage and its subsequent feeding to cattle and sheep in the extensive regions of south-eastern Western Australia. Four hundred and ten bales weighing an average 275 kg were produced from a total harvested area of 40.6 ha in the vicinity of Duck Dam on Kanandah Station. In the lead up to harvesting, seasonal conditions were among the best on record. Half of the bales produced were further processed into haylage. Two feeding trials, involving wethers at Arubiddy and steers at Kanandah, were undertaken …

Chapter 11 At Twilight, Robert K. Rasmussen, Douglas G. Baird

Coase-Sandor Institute for Law & Economics Research Paper Series

In The End of Bankruptcy we set out the forces that have rendered obsolete traditional conceptions of corporate reorganization. Lynn LoPucki wrote a critique that asserted that our paper lacked empirical foundation. In this response, we draw on LoPucki’s data set of the reorganization of large, publicly held entities to show the robustness of our claims, both empirical and theoretical. Looking in detail at the firms whose Chapter 11 cases ended in 2002, most of which concluded after we completed our original piece, we find that in over 80% of the cases the assets of the firm were either sold …

The Growing Importance Of Advance Medical Directives In The Military, Thaddeus A. Hoffmeister Oct 2003

The Growing Importance Of Advance Medical Directives In The Military, Thaddeus A. Hoffmeister

School of Law Faculty Publications

While the litigation in the Terri Schiavo case is an extreme example of what can go wrong in the health care decision-making process, it highlights the importance of advance medical directives (AMD) in helping to ensure patient autonomy during end-of-life medical treatment. Unfortunately, large segments of society, to include the military, are still unclear about the role of AMDs in patient care. Thus, this article provides a broad overview of AMDs and their legal applications with a particular emphasis on expanding their use in the military community. This article begins with a discussion of living wills and durable powers of …

International Royalty And Continental Shelf Limits: Emerging Issues For The Canadian Offshore, Aldo Chircop, Bruce Marchand

Dalhousie Law Journal

Article 82 of the United Nations Convention on the Law of the Sea, 1982, provides a novel obligation in international law that is likely to become operative within the decade. It establishes an international royalty on production from the utilization of non-living resources (such as oil and gas) on the continental shelf beyond 200 nautical miles, but within the outer limit of a coastal state's jurisdiction. Producing states will have an obligation to make payments or contributions in kind that are calculated on the basis of an incremental rate applicable as from the sixth year of production and reaching a …

Restoration Treatments In The Middle Rio Grande Bosque: Effect On Soil Compaction, Cody Lee Stropki Oct 2003

Restoration Treatments In The Middle Rio Grande Bosque: Effect On Soil Compaction, Cody Lee Stropki

Water Resources Professional Project Reports

Mechanical removal of exotic woody plants that fuel catastrophic fires in the Middle Rio Grande Bosque (riparian forest) of New Mexico has the potential to compact bosque soils and alter soil properties. Salt cedar and Russian olive trees were introduced to the area in the early 1900's for erosion control and bank stabilization. In some areas these exotic trees out compete the native cottonwoods and willows. Flood control projects have exasperated the problem. Historic over-bank flooding helped to remove dead and downed wood while providing the right conditions for Cottonwood regeneration.
