Traditional design of numerical software with result verification is based on the assumption that we know the algorithm f(x_1,...,xn) that transforms input x1,...,xn into the output y=f(x1,...,xn), and we know the intervals of possible values of the inputs. Many real-life problems go beyond this paradigm. In some cases, we do not have an algorithm f, we only know some relation (constraints) between xi and y. In other cases, in addition to knowing the intervals [xi], we may know some relations between xi; we may have some information about the probabilities of different values of xi, and we may know the …

According to many philosophers, psychological explanation canlegitimately be given in terms of belief and desire, but not in termsof knowledge. To explain why someone does what they do (so the common wisdom holds) you can appeal to what they think or what they want, but not what they know. Timothy Williamson has recently argued against this view. Knowledge, Williamson insists, plays an essential role in ordinary psychological explanation.Williamson's argument works on two fronts.First, he argues against the claim that, unlike knowledge, belief is``composite'' (representable as a conjunction of a narrow and a broadcondition). Evaluating The Risks Of Market Swaps, Maurice Stucke

An asset swap between two competitors can be (i) per se illegal under Section 1 of the Sherman Act or (ii) a potentially legitimate sale of assets under Section 7 of the Clayton Act. The case law and antitrust commentary vary as to which standard should be applied, and the impication can be significant for the business entities contemplating the deal. This article outlines five factors to assist in evaluating the asset swap's legality under the federal antitrust laws, and the critical determination of which standard to apply to a potentially high risk transaction.

“Regulatory Daubert”: A Proposal To Enhance Judicial Review Of Agency Science By Incorporating Daubert Principles Into Administrative Law, Alan Charles Raul, Julie Zampa Dwyer

Law and Contemporary Problems

In Daubert v. Merrell Dow Pharmaceuticals Inc, the US Supreme Court empowered federal judges to reject irrelevant or unreliable scientific evidence. Daubert provides a suitable framework for reviewing the quality of agency science and the soundness of agency decisions consistent with the standards established for review of agency rulemakings under the Administrative Procedure Act.

Painting, Photography And Fidelity In The Tragic Muse, Adam Sonstegard

Photographs can approach the elegance of paintings, but reproductions can show the distortion of photographs - so The Tragic Muse (1890) suggests, complicating critical understandings of James and visual art. Dramatizing artists' fidelity, James resists assuming that families, races, and genders provide similar options. Fidelity in art can mean 'infidelity' in life, lead to 'adulterated' reproductions, and impugn understandings of inherited and performed identities - concerns which resurface in The American Scene (1907) when James contemplates immigrant populations and in A Small Boy and Others (1913) when a family daguerreotype becomes evidence of his own fidelity.

A Review by James C. McKusick. In Romanticism and the Materiality of Nature, Onno Oerlemans embarks upon an ambitious project to re-situate Romantic poetry in the hard, physical reality of the material world. This study endeavors to place several of the Romantic poets, especially Wordsworth and Shelley, within the larger intellectual and material contexts of their period, attending not only to the social and cultural currents that shape poetic discourse, but also to the concrete physical substrate of poetic production.

The multiple corporate collapses and scandals of recent years, for which "Enron" is a convenient shorthand, resulted from a perfect storm in which regulatory oversight, the law of fiduciary duty, gatekeepers, market discipline, and contractual incentives all failed to prevent gross self-dealing, conflicts of interest, and deception, or themselves produced perverse consequences. The story of this simultaneous failure of the structures in place since the New Deal and before, has received considerable attention in both the popular and scholarly literature, but is summarized here to provide a context for consideration of the contributions that lawyers made to the perfect storm. …

Waddington’S Widget: Hsp90 And The Inheritance Of Acquired Characters, Douglas M. Ruden, Mark D. Garfinkel, Vincent E. Sollars, Xiangyi Lu

Conrad Waddington published an influential model for evolution in his 1942 paper, Canalization of Development and Inheritance of Acquired Characters. In this classic, albeit controversial, paper, he proposed that an unknown mechanism exists that conceals phenotypic variation until the organism is stressed. Recent studies have proposed that the highly conserved chaperone Hsp90 could function as a “capacitor,” or an “adaptively inducible canalizer,” that masks silent phenotypic variation of either genetic or epigenetic origin. This review will discuss evidence for, and arguments against, the role of Hsp90 as a capacitor for morphological evolution, and as a key component of what …

Any recording that focuses solely upon the music of Andrea Gabrieli, the other Gabrieli, risks languishing in store bins, forgotten by all but the most musicological of listeners. This recording, fortunately, should not suffer that fate.

Director Timothy Roberts, His Majestys Sagbutts and Cornetts and the newly formed His Majestys Consort of Voices have put together a celebration of Andrea Gabrieli that is as well performed as it is researched. Though some of the scoring choices are unusual, the performances are nearly impeccable with but a few exceptions.
