The Frictions Of Federalism: The Rise And Fall Of The Federal Common Law Of Interstate Nuisance, Robert V. Percival

Faculty Scholarship

Prior to the erection in the 1970s of a comprehensive federal regulatory infrastructure to protect the environment, transboundary pollution disputes frequently were adjudicated by the U.S. Supreme Court, exercising its original jurisdiction over disputes between states. In a series of cases commencing at the dawn of the Twentieth Century, the Court served as a national arbiter of interstate pollution disputes. This paper reviews the history of the Supreme Court's use of these cases to develop a federal common law of interstate nuisance.

At an induction ceremony at Governors State University Wednesday, October 15, 36 of the university's top undergraduate students became the first inducted into Gamma Sigma Upsilon, the newest chapter of the Alpha Sigma Lambda National Honor Society. The new GSU chapter becomes the 325th for the national honor society.

Referendum Petition To Overturn Amendments To Health Care Coverage Requirements

REFERENDUM PETITION TO OVERTURN AMENDMENTS TO HEALTH CARE COVERAGE REQUIREMENTS. If signed by the required number of electors and timely filed with the Secretary of State, this petition will prevent implementation of Chapter 673, Statutes of 2003, previously approved by the Legislature and Governor, unless and until it is approved by a majority of voters. Measure creates mandatory employee health care benefits program for employers with 20 or more employees. Employees working 100 hours per month are covered. Fee for coverage paid at least 80% by employer and up to 20% by employee contribution. Exempts employers providing for alternative coverage.
