Transportation And Land Use Patterns: Monitoring Urban Change Using Aerial Photography, Portland, Oregon 1925-1945, Paul Hagen Fyfield

American urban neighborhoods are a patchwork; the spatial arrangement of types is a reflection of the dominant transportation technology at the time of their development. The earliest suburban areas were made accessible by fixed route systems such as the electric streetcar, followed by the widespread adoption of the automobile; each transportation epoch resulted in characteristic patterns of land use. This study uses aerial photographic coverage of Portland, Oregon from the years 1925, 1936, and 1945, a time of decline for the once popular trolley lines and dramatic increase in automobile usage, to monitor change within the residential areas of Portland's …

A Comparative Review Of A College Education's Effect On Law Enforcement Officers Relating To Internal Affairs Complaints, Bill Griffin

The purpose of this research is to determine if a relationship exists between higher education levels and misconduct allegations for Deputy Sheriffs. Official documentation from 128 internal affairs reports were collected from the Palm Beach County Sheriff's Office. Significant relationships were found to exist between higher education levels and the misconduct allegations. While some college exposure may be beneficial for job performance, a four-year degree may not yield the desired results.

Reexamining The Posse Comitatus Act: Toward A Right To Civil Law Enforcement, Sean J. Kealy

The military is currently prohibited by federal statute from participating in domestic law enforcement. The Posse Comitatus Act of 1878 ("PCA") establishes criminal penalties for people who willfully use members of the Army or the Air Force to execute the laws. Although a product of the Reconstruction Era, this law reflects a strong American tradition against the domestic use of the military that stretches back before the founding of the nation.

Secret Settlements And Practice Restrictions Aid Lawyer Cartels And Cause Other Harms, David A. Dana, Susan P. Koniak

In this article, the authors argue that the use of secrecy agreements and practice restrictions in settlement contracts should be prohibited not only by the ethics rules, but also by criminal and civil law. The authors begin by discrediting four arguments that are traditionally employed to support the use of secrecy agreements and practice restrictions. They then argue that the use of secrecy agreements and practice restrictions generate substantial costs, but do not secure any legitimate benefits that could not be attained by other, less costly means. A recent Court of Appeals decision has made it more difficult for judges in the United States to second-guess arbitrators in international cases. To understand the significance of the recent decision, one must remember that the Federal Arbitration Act (FAA) has been interpreted to permit vacatur of awards in an international arbitration on the same grounds available in domestic cases. Thus, a litigant who is unhappy with an arbitrator's decision gets a chance to re-argue the case by alleging "manifest disregard of the law," a ground for judicial review created fifty years ago by Supreme Court dictum.

Selected Nevada law enforcement officers participated in the mandatory collection of traffic stop data in the calendar year 2002. The requirement was a temporary one-year study mandated by the 2001 Nevada Legislature. The primary objective of this paper is to provide insight into the behavioral response of law enforcement with respect to mandatory data collection. Data for this study was obtained from the use of a self-administered mail survey from law enforcement officers from five of the nine Nevada police agencies required to collect traffic stop data. The Wetlands Park Nature Preserve in Clark County Nevada is a constructed wetland that is home to several species of fish. The purpose of this study is to report on the fluctuations of the fish populations during the first 20 months of monitoring at the Wetlands Park Nature Preserve. This thesis analyzes the fish monitoring data in order to assess the behavior of the fish population of the Wetlands Preserve. Patent Thickets: Strategic Patenting Of Complex Technologies, James Bessen

Patent race models assume that an innovator wins the only patent covering a product. But when technologies are complex, this property right is defective: ownership of a product's technology is shared, not exclusive. In that case I show that if patent standards are low, firms build "thickets" of patents, especially incumbent firms in mature industries. When they assert these patents, innovators are forced to share rents under cross-licenses, making R&D incentives sub-optimal. On the other hand, when lead time advantages are significant and patent standards are high, firms pursue strategies of "mutual non-aggression." Then R&D incentives are stronger, even optimal.

The election of 1800 was one of the most contested - and important - in American history. After it became clear that neither President John Adams nor a Federalist majority in Congress had been reelected, they acted during the lame-duck period to preserve their influences far into the future. They did so by appointing John Marshall as Chief Justice, ratifying the Treaty with France, creating numerous new federal judicial positions, and filling many of those positions with friends, family, and Federalists (including William Marbury). Among the many efforts to improve the IC test process are tests that attempt to differentiate between healthy and defective or low reliability ICs by manipulating the operating conditions of the IC being tested. This thesis attempts to improve the common understanding of multiple and targeted temperature testing by evaluating work published on the subject to date and by presenting previously unpublished empirical observations. The empirical observations are made from SCAN and LBIST based MinVDD measurements, Static IDD measurements, as well as parametric measurements of transistor characteristics. Government officials regularly use the power of eminent domain to benefit private entities, and just as regularly justify their actions with assertions about the need to promote "economic development." Rather, the remarkable thing about these cases is that the courts questioned the government's right to do so. In Hawaii Housing Authority v. Midkiff, the United States Supreme Court reaffirmed that the Fifth Amendment demands broad deference to a government's decision to exercise the power of eminent domain. Midkiff makes clear that "public use" challenges are subject to rational-basis review. That is, so long as a taking can be justified by …

In this paper, we provide a Schwarz preconditioner for the hybridized versions of the Raviart-Thomas and Brezzi-Douglas-Marini mixed methods. The preconditioner is for the linear equation for Lagrange multipliers arrived at by eliminating the ux as well as the primal variable. We also prove a condition number estimate for this equation when no preconditioner is used. Although preconditioners for the lowest order case of the Raviart-Thomas method have been constructed previously by exploiting its connection with a nonconforming method, our approach is different, in that we use a new variational characterization of the Lagrange multiplier equation. Our objective was to determine the usefulness of polyamines, particularly putrescine, and amino acids such as arginine, as foliar indicators of abiotic stress in visually asymptomatic trees. An evaluation of apparently healthy trees is essential in developing risk assessment and stress remediation strategies for forest trees prior to the onset of obvious decline. Previous research by our group established a positive correlation between putrescine in red spruce foliage and A1:Ca ratios in the forest soil. A positive correlation was also observed between foliar putrescine and nitrogen deposition in the soil in pine, maple, and oak at Harvard Forest, MA. Preliminary …

The traditional view of sovereign debt as a relationship between a developing country government and and its foreign private creditors is increasingly out of date. Financial institutions and individuals inside the borrowing countries are are becoming more and more important as creditors to their governments. At the same time, as countries remove restrictions on cross-border capital flows, foreign creditors are participating more actively in domestic law, local-currency debt markets. These developments imply fundamental changes in lending decisions and, where the loan goes bad, in the sovereign debt workout process.

This purpose of this study is to incorporate women into the history of homelessness. Women's experience is missing from the narrative of industrial era homelessness, which causes researchers to make a distinction between the modem day homeless population and its predecessors. This distinction prevents researchers from examining the long term structural causes of homelessness and analyzing the role homelessness plays in U.S. society. This study explores the population characteristics and living conditions of three groups of women who were considered homeless during the early decades of the twentieth century in Portland. Approximately 10% of American children experience an emotional or behavioral disorder that causes some level of impairment in their development, learning, or functioning in daily life, and the numbers of those affected appear to be growing (U.S. Public Health Service, 2000). With the entry of many family caregivers into the workforce, increasing numbers of children with these challenges are enrolling in child care settings that offer services to infants, toddlers, young children, or school aged youth (Shonkoff & Phillips, 2000). This research consisted of designing and evaluating portable document format (PDF) print estimating system to commercial systems. Taking into account functionality, reliability, standardization, and integration, the conventional design method (Pressman, 1997) was used to develop the print estimating system. Considering the printer's viewpoint, added features make the system function online and offline and compatible with all common computer platforms. After the system was developed, experts and entry-level users evaluated the system for software usability (Nielsen, 2000; Shneiderman, 1998). A total of 26 experts and 38 entry-level users responded to 14 questions about usability in a personal interview survey. Statistical analysis …
